【摘要】：網(wǎng)絡(luò)犯罪是一類新興犯罪，隨著技術(shù)的進(jìn)步，，通過(guò)網(wǎng)絡(luò)實(shí)施犯罪的手段已經(jīng)為越來(lái)越多的犯罪份子所利用，，網(wǎng)絡(luò)犯罪所具有的高隱蔽性、跨地域性以及難以取證等特點(diǎn)使得網(wǎng)絡(luò)犯罪與傳統(tǒng)犯罪相比有著“高收益、低風(fēng)險(xiǎn)”的優(yōu)勢(shì)，這就直接導(dǎo)致了網(wǎng)絡(luò)犯罪問(wèn)題爆炸式的增長(zhǎng)。傳統(tǒng)的偵破案件的手段在對(duì)付具有高科技、高智商特點(diǎn)的網(wǎng)絡(luò)犯罪往往顯得捉襟見(jiàn)肘，破案效率極為低下。而隨著日益成熟的互聯(lián)網(wǎng)無(wú)所不在，存在于虛擬世界中的網(wǎng)絡(luò)犯罪產(chǎn)業(yè)鏈也不斷成熟，正如有犯罪學(xué)家預(yù)言的那樣，未來(lái)犯罪分子最強(qiáng)大的武器將會(huì)是網(wǎng)絡(luò)，未來(lái)絕大多數(shù)犯罪將會(huì)利用網(wǎng)絡(luò)進(jìn)行，即使是某些惡性的人身傷害也會(huì)直接或間接的利用網(wǎng)絡(luò)進(jìn)行。網(wǎng)絡(luò)犯罪所具有的極大的社會(huì)危害性使得正視網(wǎng)絡(luò)犯罪問(wèn)題刻不容緩。在現(xiàn)代化的環(huán)境下，偵查員如何充分利用現(xiàn)有技術(shù)遏制越來(lái)越猖狂的網(wǎng)絡(luò)犯罪問(wèn)題，提高偵查效率是本文重點(diǎn)討論的問(wèn)題。 犯罪心理畫(huà)像技術(shù)是一門(mén)新興的學(xué)科，它旨在通過(guò)對(duì)人性的深入分析，結(jié)合行為人的作案手法和行為人在現(xiàn)場(chǎng)遺留的行為證據(jù)來(lái)推動(dòng)案件的進(jìn)展。心理畫(huà)像技術(shù)在國(guó)外往往被用來(lái)解決疑難懸案，它所發(fā)揮的作用已經(jīng)足以使其成為一門(mén)專門(mén)的學(xué)科來(lái)研究。如何利用犯罪心理畫(huà)像這門(mén)新技術(shù)來(lái)解決當(dāng)今世界越來(lái)越突出的新型犯罪問(wèn)題，是本文探討的主題。 本文主要分三大部分，全文共計(jì)兩萬(wàn)兩千余字。第一部分首先概括闡明了網(wǎng)絡(luò)犯罪的一些基本問(wèn)題，在明確網(wǎng)絡(luò)犯罪的定義的前提下，對(duì)網(wǎng)絡(luò)犯罪分類和特點(diǎn)以及與傳統(tǒng)犯罪的區(qū)別作了詳細(xì)的說(shuō)明；第二部分簡(jiǎn)要介紹了犯罪心理畫(huà)像技術(shù)這一新興犯罪偵查手段，追溯了心理畫(huà)像技術(shù)的歷史和這門(mén)技術(shù)的運(yùn)作原理以及利用這一技術(shù)推動(dòng)網(wǎng)絡(luò)犯罪問(wèn)題偵破的優(yōu)越性。第三部分是本文的重點(diǎn)，主要說(shuō)明如何利用犯罪心理畫(huà)像技術(shù)對(duì)網(wǎng)絡(luò)犯罪的偵破提供幫助。通過(guò)構(gòu)建一個(gè)利用心理畫(huà)像技術(shù)偵破網(wǎng)絡(luò)犯罪的模型，針對(duì)網(wǎng)絡(luò)犯罪主體動(dòng)機(jī)的不同劃分出不同的心理畫(huà)像描述模板，再把這些模板應(yīng)用到具體的案件偵查實(shí)踐中，通過(guò)案例說(shuō)明如何利用心理畫(huà)像技術(shù)來(lái)解決網(wǎng)絡(luò)犯罪問(wèn)題。希望自己的一點(diǎn)拙見(jiàn)可以為我國(guó)的犯罪理論研究建設(shè)添磚增瓦。
[Abstract]:Network crime is a kind of new crime. With the progress of technology, more and more criminals have been used by the means of committing crimes through the network. The characteristics of network crime are high concealment, cross regional and difficult to obtain evidence, which makes network crime have the advantage of "high income and low risk" compared with traditional crime. There is a direct result of the explosive growth of cyber crime. The traditional means of detection of the cases are often difficult to deal with, and the efficiency of the case is very low. As the criminologist predicted, the most powerful weapon of the future criminals will be the network, and the vast majority of the crimes in the future will be carried out on the Internet, even if some malignant personal injuries will be used directly or indirectly by the network. The great social harmfulness of the network crime makes it engraved on the problem of network crime. In the modern environment, how to make full use of the existing technology to contain more and more rampant network crime and improve the efficiency of investigation is the focus of this paper.
The criminal psychological picture technology is a new subject. It aims to promote the progress of the case by analyzing the human nature deeply, combining the perpetrator's writing technique and the behavior evidence left by the actor on the scene. The psychological picture technology is often used to solve the difficult case abroad, and its function has already been enough to make it a one. The subject of this article is how to use the new technology to solve the new crime problem that is becoming more and more prominent in today's world.
This article is mainly divided into three parts, the full text totalling twenty thousand words. The first part first summarizes some basic problems of the network crime. On the premise of defining the definition of the network crime, the classification and characteristics of network crime and the difference from the traditional crime are explained in detail. The second part briefly introduces the psychological picture of the crime. Technology, a new method of criminal investigation, traces back the history of psychological portrait technology and the operation principle of this technology and the superiority of using this technology to promote the detection of network crime. The third part is the focus of this article, mainly explaining how to help the detection of network crime by using criminal psychological picture technology. A model that uses psychological picture technology to detect network crime is divided into different mental picture description templates, and then the template is applied to specific case investigation practice, and the case shows how to use psychological picture technology to solve the problem of network crime. It can add bricks and tiles to the research of crime theory in China.
