【摘要】：二戰(zhàn)以后,世界上絕大多數(shù)國(guó)家相繼開(kāi)始了現(xiàn)代化的進(jìn)程。在這一發(fā)展過(guò)程中,不論是發(fā)達(dá)國(guó)家還是發(fā)展中國(guó)家,官員的腐敗問(wèn)題是一直困擾這些國(guó)家的一些大問(wèn)題。腐敗活動(dòng)制造社會(huì)矛盾,引發(fā)社會(huì)沖突,對(duì)經(jīng)濟(jì)建設(shè)和政局穩(wěn)定起著破壞作用,許多國(guó)家身受其害。當(dāng)中國(guó)全面進(jìn)入現(xiàn)代化進(jìn)程和市場(chǎng)經(jīng)濟(jì)建設(shè)的關(guān)鍵階段的今天,腐敗問(wèn)題的來(lái)勢(shì)之猛,范圍之廣,危害之烈都超出了我們的心理準(zhǔn)備。腐敗與我們黨的性質(zhì)、宗旨不符,反腐敗斗爭(zhēng)關(guān)系到我國(guó)改革開(kāi)放的成敗,關(guān)系到黨和國(guó)家的興衰命運(yùn),是“關(guān)系黨和國(guó)家生死存亡的嚴(yán)峻斗爭(zhēng)”。在這種形勢(shì)下,筆者認(rèn)為,職務(wù)犯罪防控,是我國(guó)社會(huì)發(fā)展到一定歷史階段,作為維護(hù)社會(huì)穩(wěn)定、經(jīng)濟(jì)發(fā)展、社會(huì)進(jìn)步而實(shí)施的一項(xiàng)長(zhǎng)期的戰(zhàn)略任務(wù),是我國(guó)反腐方略從單純打擊走向打防并舉、標(biāo)本兼治、逐步成熟的表現(xiàn)。本文基于此種現(xiàn)狀,運(yùn)用比較研究方法,理論與實(shí)踐緊密結(jié)合,對(duì)職務(wù)犯罪防控體系進(jìn)行了深入探討,并就當(dāng)前如何完善我國(guó)職務(wù)犯罪防控體系提出了若干建議,以期為我國(guó)廉政建設(shè)貢獻(xiàn)綿薄之力。 本文主要通過(guò)對(duì)我國(guó)職務(wù)犯罪現(xiàn)狀的反思,在總結(jié)西方預(yù)防職務(wù)犯罪的成功經(jīng)驗(yàn)和我國(guó)古代職務(wù)犯罪防控經(jīng)驗(yàn)的基礎(chǔ)上,對(duì)建構(gòu)我國(guó)職務(wù)犯罪防控體系進(jìn)行探討。本文分為四個(gè)部分: 第一部分介紹了職務(wù)犯罪防控體系的現(xiàn)狀及其存在的缺陷。本文認(rèn)為,我國(guó)職務(wù)犯罪正處于高發(fā)期,發(fā)案率一直居高不下, 涉案金額越來(lái)越大,罪犯的職務(wù)也越來(lái)越高,職務(wù)犯罪現(xiàn)狀非常嚴(yán)重。而其原因在于沒(méi)有形成一個(gè)完善的職務(wù)犯罪防控體系。目前我國(guó)職務(wù)犯罪防控體系的缺陷主要表現(xiàn)在七個(gè)方面,本文對(duì)這七個(gè)方面進(jìn)行了具體分析。 第二部分介紹了國(guó)外職務(wù)犯罪防控體系的現(xiàn)狀。職務(wù)犯罪長(zhǎng)期以來(lái)一直是困擾國(guó)際社會(huì)的一個(gè)問(wèn)題。世界上很多國(guó)家都在積極探索,試圖尋找到治理職務(wù)犯罪的行之有效的方法和手段。各國(guó)
[Abstract]:After the Second World War, the vast majority of the countries in the world have begun the process of modernization. In this process, the corruption of officials, whether developed and developing, is a major problem that has plagued these countries. Corruption creates social contradictions, causes social conflicts, and breaks down economic construction and political stability. Bad effects, many countries suffer. Today, when China has fully entered the process of modernization and the key stage of the construction of market economy, the fierce, wide range of corruption is beyond our psychological preparation. Corruption is not in conformity with the nature of our party and the purpose of our party, and the struggle against corruption is related to the success or failure of China's reform and opening up. It is related to the rise and fall of the party and the state, which is "a grim struggle against the survival and death of the party and the state". Under this situation, the author thinks that the prevention and control of the duty crime is a long-term strategic task for our society to develop to a certain historical stage and as a safeguard for social stability, economic development and social progress. It is the anti corruption strategy of our country. On the basis of this situation, this paper, based on the present situation, combined the comparative research method and the theory and practice closely, makes a thorough discussion on the prevention and control system of the duty crime, and puts forward some suggestions on how to perfect the system of duty crime prevention and control in our country, with a view to the construction of a clean government in our country. Contribute to a little effort.
On the basis of summarizing the successful experience of the prevention of duty crime in the West and the experience of preventing and controlling the duty crime in our country, this paper mainly discusses the construction of the system of prevention and control of duty crime in China. This article is divided into four parts:
The first part introduces the status and defects of the system of duty crime prevention and control. This article holds that the duty crime in China is in high incidence, the rate of crime is always high, the amount involved in the case is more and more large, the duty of the criminals is higher and higher and the status of the duty crime is very serious. The reason is that there is no perfect job crime. Prevention and control system. At present, the defects of our country's duty crime prevention and control system are mainly manifested in seven aspects. This paper makes a concrete analysis of these seven aspects.
The second part introduces the status of the system of foreign duty crime prevention and control. The duty crime has been a problem that has plagued the international community for a long time. Many countries in the world are actively exploring and trying to find effective methods and means to deal with the crime of managing duties.
