【摘要】：關于勞動教養(yǎng)的性質,各方至今爭論不一,未有定論。從“已然”和“實然”兩個層面,對現(xiàn)行勞動教養(yǎng)制度的性質進行辨析和再認識,在勞教制度的立法和制度重構時,應將其性質定位介于行政制裁和刑法制裁之間的一種特殊的準司法強制措施,是隸屬保安處分體系中的限制人身自由的保安措施種類。
[Abstract]:On the nature of reeducation through labor, the parties have not yet come to a conclusion. From the two aspects of "already" and "reality", this paper distinguishes and reunderstands the nature of the current re-education through labor system, and in the process of legislation and system reconstruction of the re-education through labour system, Its nature should be defined as a special quasi-judicial coercive measure between administrative sanction and criminal law sanction, which is a kind of security measure that restricts personal freedom in the system of security measures.
