【摘要】：關(guān)于勞動教養(yǎng)的性質(zhì),各方至今爭論不一,未有定論。從“已然”和“實然”兩個層面,對現(xiàn)行勞動教養(yǎng)制度的性質(zhì)進行辨析和再認識,在勞教制度的立法和制度重構(gòu)時,應(yīng)將其性質(zhì)定位介于行政制裁和刑法制裁之間的一種特殊的準(zhǔn)司法強制措施,是隸屬保安處分體系中的限制人身自由的保安措施種類。
[Abstract]:On the nature of reeducation through labor, the parties have not yet come to a conclusion. From the two aspects of "already" and "reality", this paper distinguishes and reunderstands the nature of the current re-education through labor system, and in the process of legislation and system reconstruction of the re-education through labour system, Its nature should be defined as a special quasi-judicial coercive measure between administrative sanction and criminal law sanction, which is a kind of security measure that restricts personal freedom in the system of security measures.
