【摘要】：未成年人曾經(jīng)被比作是早晨七八點(diǎn)鐘的太陽,未成年人的發(fā)展關(guān)系著國家和民族的命運(yùn)。然而,目前未成年人犯罪在各國都是日益突出的社會問題,未成年人犯罪始終是困擾著社會與發(fā)展的一個大問題,這一問題不僅危及社會的穩(wěn)定及和諧秩序的構(gòu)建,而且嚴(yán)重影響了國家對未成年人發(fā)展各項(xiàng)政策的實(shí)施與實(shí)現(xiàn)。 相對與成年人,未成年人是一類特殊群體,這是因?yàn)樗麄兊纳怼⑿睦淼确矫媾c成年人都有很大的不同,因此從保護(hù)未成年人的權(quán)益出發(fā),世界上大多數(shù)國家都有針對未成年人犯罪的救濟(jì)政策。我國自改革開放以來,致力于針對違法犯罪未成年人的保護(hù),在不同的時代背景下,不斷地修正國內(nèi)的救濟(jì)政策,取得了顯著的效果。本文從公共政策的角度對這一問題進(jìn)行了分析,把未成年人犯罪救濟(jì)政策作為研究對象,把違法犯罪未成年人作為政策的目標(biāo)群體,把完善我國的未成年人犯罪救濟(jì)政策作為本論文的研究目標(biāo)。通過對公共政策理論、國家親權(quán)理論,保護(hù)處分理論的學(xué)習(xí),論述了我國未成年人犯罪救濟(jì)政策的演變,分析了當(dāng)前我國未成年人犯罪救濟(jì)政策的偏差,并借鑒國外發(fā)達(dá)國家未成年人犯罪救濟(jì)政策的長處,為更好的完善未成年人犯罪救濟(jì)政策提出了一些建議和思考。
[Abstract]:Minors used to be compared to the sun at seven or eight o'clock in the morning. The development of minors is related to the fate of the country and the nation.However, at present, juvenile delinquency is an increasingly prominent social problem in all countries. Juvenile delinquency has always been a major problem puzzling society and development, which not only endangers the stability of society and the construction of harmonious order.And has seriously affected the implementation and realization of various national policies for the development of minors.Compared with adults, minors are a special group, because they are very different from adults in physical, psychological and other aspects. Therefore, in order to protect the rights and interests of minors,Most countries in the world have relief policies against juvenile delinquency.Since the reform and opening to the outside world, China has devoted itself to the protection of minors in violation of the law and crimes. Under different background of the times, it has constantly revised its domestic relief policy and achieved remarkable results.This paper analyzes this problem from the angle of public policy, regards the relief policy of juvenile delinquency as the research object, and regards the juvenile delinquent as the target group of the policy.The aim of this thesis is to perfect the relief policy of juvenile delinquency in our country.Through the study of the theory of public policy, the theory of national parental authority and the theory of protection and disposition, this paper discusses the evolution of the relief policy for juvenile delinquency in China, and analyzes the deviation of the relief policy for juvenile delinquency in our country at present.And draw lessons from the advantages of juvenile crime relief policy in developed countries, and put forward some suggestions and thoughts for the better improvement of juvenile delinquency relief policy.
