【摘要】： 20世紀(jì)中葉以來,特別是近二十年,伴隨著人類文明的進(jìn)程,世界各國都在不斷進(jìn)行刑罰制度的改革和創(chuàng)新,嘗試用最有效、最人道、最文明的方式處理犯罪和犯罪人,社區(qū)矯正就是在這種背景下誕生的一種新的刑罰方式。 社區(qū)矯正與中國的傳統(tǒng)文化以及當(dāng)前創(chuàng)建和諧社會(huì)的理念是相統(tǒng)一的,體現(xiàn)著以人為本的精神追求。一方面,在建設(shè)和諧社會(huì)的背景下要將和諧思維滲透到社區(qū)矯正工作之中;另一方面,以和諧思維為指導(dǎo)的社區(qū)正工作將促進(jìn)犯罪人、被害人、社會(huì)及其三者之間的和諧,最終促進(jìn)和諧社會(huì)的發(fā)展。 目前,社區(qū)矯正試點(diǎn)工作已在全國25個(gè)省(市)展開,取得了較大發(fā)展,探索了很多成功的經(jīng)驗(yàn)和有效的做法,成果顯著。但同時(shí)也應(yīng)當(dāng)看到,我國社區(qū)矯正工作還處于試點(diǎn)階段,還存在一些問題。探索和研究社區(qū)矯正現(xiàn)階段存在的相關(guān)問題和對(duì)策,有助于進(jìn)一步改革我國的刑罰執(zhí)行制度,為構(gòu)建和諧社會(huì)提供司法保障。 本文除導(dǎo)言、結(jié)語之外,正文共分為四章。 第一章討論了和諧思維與傳統(tǒng)刑事司法。文章首先指出傳統(tǒng)的刑事司法理念存在的問題:一是存在著對(duì)犯罪人專政的思維;二是忽略了被害人的權(quán)益;三是會(huì)引發(fā)沖突與對(duì)抗。接著闡述了和諧思維下的社區(qū)矯正對(duì)傳統(tǒng)刑事司法的修正:通過社區(qū)矯正的施行,犯罪人不但沒有與社會(huì)相隔離,而且他們所遇到的困難和問題能夠獲得幫助和解決;社區(qū)矯正關(guān)注被害人的權(quán)利,能彌補(bǔ)被害人受到的損失;社區(qū)矯正改變對(duì)抗性思維,促進(jìn)犯罪人和被害人之間的和諧,消除對(duì)立情緒,化解矛盾沖突,最終實(shí)現(xiàn)社會(huì)的穩(wěn)定與和諧。 第二章敘述社區(qū)矯正工作的現(xiàn)狀。首先簡要地描述了從2002年至今社區(qū)矯正試點(diǎn)工作的推進(jìn)過程,接下來著重對(duì)北京、上海的社區(qū)矯正試點(diǎn)工作情況進(jìn)行論述,包括各自工作的開展,主要的特點(diǎn)以及存在的問題,以期對(duì)社區(qū)矯正工作微觀層面的問題進(jìn)行探討。 第三章分析了社區(qū)矯正工作面臨的問題。文章從宏觀上把握社區(qū)矯正工作中存在的問題,具體包括五個(gè)方面:一是立法方面的問題。當(dāng)前我國社區(qū)矯正的法律規(guī)格與立法主體較低,社區(qū)矯正的種類既少又單一,并且具體制度設(shè)計(jì)不足;二是適用方面的問題。目前我國社區(qū)矯正的適用率很低,而且適用條件苛刻;三是執(zhí)行方面的問題,這既包括執(zhí)行主體上的問題,也包括執(zhí)行工作中出現(xiàn)的問題;四是被害人的權(quán)益保護(hù)問題。目前被害人并沒有參與到社區(qū)矯正之中,其權(quán)益受到嚴(yán)重忽視;五是社區(qū)矯正隊(duì)伍問題,不但人員少、隊(duì)伍不穩(wěn)定,而且專業(yè)素質(zhì)有待提高。 第四章提出了和諧思維指導(dǎo)下社區(qū)矯正工作的完善。具體的措施包括:通過增設(shè)社區(qū)服務(wù)刑,增加和解與賠償措施進(jìn)行立法上的完善與改革;擴(kuò)大社區(qū)矯正的適用,尤其是擴(kuò)大緩刑、假釋的適用,并把刑釋人員納入社區(qū)矯正的對(duì)象范圍之中;理性設(shè)置社區(qū)矯正的執(zhí)行機(jī)構(gòu);規(guī)范社區(qū)矯正的專業(yè)隊(duì)伍,提高矯正工作者的專業(yè)素質(zhì);加強(qiáng)對(duì)被害人權(quán)益的保護(hù),確保被害人的基本權(quán)利得以實(shí)現(xiàn),使被害人參與到社區(qū)矯正中來。以和諧思維為指導(dǎo)的完善措施體現(xiàn)著和諧之道,實(shí)質(zhì)上是為了尋求犯罪人、被害人、社會(huì)這三者以及三者之間的和諧。
[Abstract]:Since the middle of the twentieth Century, especially in the past twenty years, along with the progress of human civilization, all countries in the world in the reform and innovation of the penal system, try to use the most effective, the most humane, civilized approach to crime and criminal, community correction, a new way of penalty is born in this background.
Community correction and China the traditional culture and the establishment of the concept of a harmonious society is the unity, embodies the people-oriented spirit pursuit. On the one hand, will penetrate into the harmonious thinking of community correction work in the context of building a harmonious society; on the other hand, with the guidance of the harmonious thought will promote the criminal community correction work the victim, and the three, between social harmony, and ultimately promote the development of harmonious society.
At present, the pilot work of community correction in the country has 25 provinces (city), has made great progress, to explore a lot of successful experience and effective practices, and remarkable achievements. But at the same time, China's community correction work is still in the pilot phase, there are still some problems. To explore and study the related issues of community correction at the present stage and countermeasures, contribute to the further reform of our penalty system, provide judicial protection for the construction of a harmonious society.
In addition to the introduction and conclusion, the text is divided into four chapters.
The first chapter discusses the harmonious thought and the traditional criminal justice. This paper points out the existing problems of the traditional criminal justice idea: one is the existence of the criminal dictatorship thinking; two is to ignore the rights and interests of the victims; three is the conflict and confrontation. Then elaborated the harmonious thinking of the community correction correction of the traditional criminal justice the community correction: through the implementation of the criminal is not isolated from the society, but also the difficulties and problems they encountered can get help and solve community correction; attention to the rights of victims, the victim can make up for the loss of community correction; change antagonistic thinking, promote the harmonious between the offender and the victim, eliminate antagonism finally, resolve conflicts, to achieve a stable and harmonious society.
The second chapter describes the current situation of community correction work. First described briefly since 2002 to promote the process of community correction work, then focuses on Beijing, Shanghai pilot work of community correction were discussed, including their work, the main characteristics and existing problems, the problem in the work of community correction in micro level carries on the discussion.
The third chapter analyzes the problems of community correction work. The grasp of community correction work of the existing problems from the macro, includes five aspects: one is the legislative problems. The current legal specifications and the legislative body of China's community correction is low, types of community correction is small and single, and the specific design of the system insufficient; is applicable to two aspects. At present our country community correction application rate is very low, but also for the harsh conditions; the implementation of the three aspects, which includes both the executive body of the problem, including in the enforcement work; four is the protection of the rights and interests of the victims. The victim was not involved community correction, its rights and interests have been seriously neglected; the five is the community correction team, not only less staff team is not stable, and professional quality to be improved.
The fourth chapter puts forward the improvement of community correction work in harmony under the guidance of thinking. Specific measures include: through the creation of community service punishment, increase reconciliation and compensation measures to improve and reform the legislation; to expand the application of community correction, especially the expansion of probation, parole application, and put the emancipists into the range of community correction objects rational setting executive mechanism of community correction;; specification of community correction professional team, improve the professional quality of correction workers; strengthen the protection of the rights of the victims, to ensure that the basic rights of victims to be realized, so the victim to participate in community correction. The harmonious thinking guidance measures embody the harmonious way, in essence in order to seek the offender, the victim, between the three and the three social harmony.
