【摘要】： 社區(qū)矯正是當(dāng)今世界國際司法的潮流,也是我國刑罰制度發(fā)展的必然趨勢。目前,我國共有21個省、自治區(qū)和直轄市在進(jìn)行社區(qū)矯正試點(diǎn)工作,內(nèi)蒙古自治區(qū)是其中僅有的兩個少數(shù)民族自治地區(qū)之一。但總的來看,社區(qū)矯正試點(diǎn)工作都是在我國一些大中城市中開展,對于像內(nèi)蒙古自治區(qū)這樣的少數(shù)民族地區(qū)以及廣大的農(nóng)村牧區(qū)如何開展適用社區(qū)矯正,目前理論上和實(shí)踐中都尚屬空白。本文試圖通過對國外社區(qū)矯正經(jīng)驗(yàn)及成果的研究借鑒和對我國第一批社區(qū)矯正試點(diǎn)省份已有的成就和不足進(jìn)行分析總結(jié),結(jié)合內(nèi)蒙古地區(qū)的實(shí)際情況,探討在內(nèi)蒙古開展社區(qū)矯正遇到的實(shí)際問題,并有針對性地提出解決和完善的建議,從而為建立起一套適合內(nèi)蒙古地區(qū)的、符合現(xiàn)代化行刑理念的社區(qū)矯正制度作一積極的探索。 本文共分四部分:第一部分,關(guān)于社區(qū)矯正的實(shí)踐。主要介紹刑罰觀念的變化、國外社區(qū)矯正制度的理論淵源以及國外社區(qū)矯正的產(chǎn)生發(fā)展?fàn)顩r和主要類型;第二部分,社區(qū)矯正的價(jià)值理念。作為現(xiàn)代刑罰適用和執(zhí)行方式的社區(qū)矯正,體現(xiàn)著刑罰的文明與進(jìn)步,蘊(yùn)含著正義、人道及效益的價(jià)值追求。因此,社區(qū)矯正被當(dāng)今世界大多數(shù)國家采用,也是當(dāng)前我國刑罰制度改革的有效模式;第三部分,內(nèi)蒙古地區(qū)開展社區(qū)矯正工作的優(yōu)勢和不足。內(nèi)蒙古地區(qū)開展社區(qū)矯正,有著國家特殊的少數(shù)民族刑事政策及少數(shù)民族立法,還有著一定的社會、人員隊(duì)伍及社區(qū)工作基礎(chǔ)。但是也存在著大量的問題,面臨著重重的困難,如觀念、立法滯后,經(jīng)費(fèi)、人員短缺,城市、農(nóng)村及牧區(qū)社區(qū)差異巨大等等;第四部分,內(nèi)蒙古地區(qū)社區(qū)矯正地方立法的構(gòu)想。針對內(nèi)蒙古地區(qū)幅員遼闊,蒙漢雜居,經(jīng)濟(jì)不發(fā)達(dá),社區(qū)建設(shè)不完善,鄉(xiāng)鎮(zhèn)蘇木并存等現(xiàn)狀,提出應(yīng)根據(jù)本地區(qū)特殊情況先進(jìn)行地區(qū)立法,同時(shí)加快社區(qū)建設(shè)的步伐,積極嘗試社區(qū)矯正的新形式,如為居住分散的農(nóng)牧民罪犯建立類似中途之家的集中矯治機(jī)構(gòu)。建立專門的社區(qū)矯正組織機(jī)構(gòu)和執(zhí)行隊(duì)伍,依靠司法機(jī)關(guān)、具有專業(yè)知識的社會工作者以及志愿者完成對在社區(qū)中服刑罪犯的管理、教育、考察和監(jiān)督工作。
[Abstract]:Community correction is the trend of international judicature in the world and the inevitable trend of the development of penalty system in our country.At present, there are 21 provinces, autonomous regions and municipalities directly under the Central Government to carry out community correction pilot work, Inner Mongolia Autonomous region is one of the only two minority autonomous areas.But in general, the pilot work of community correction is carried out in some large and medium-sized cities in China. For minority areas such as Inner Mongolia Autonomous region and the vast rural pastoral areas, how to carry out appropriate community correction,At present, the theory and practice are still blank.This paper attempts to analyze and summarize the achievements and shortcomings of the first batch of pilot provinces of community correction in China by studying the experience and achievements of community correction in foreign countries, and combining with the actual situation in Inner Mongolia.This paper probes into the practical problems encountered in carrying out community correction in Inner Mongolia, and puts forward some suggestions to solve and perfect them, so as to set up a set of suitable ones for Inner Mongolia.The community correction system in line with the modern execution concept is a positive exploration.This article is divided into four parts: the first part, the practice of community correction.It mainly introduces the change of penalty concept, the theoretical origin of foreign community correction system, the status and main types of the emergence and development of foreign community correction; the second part, the value concept of community correction.Community correction, as a modern way of penalty application and execution, embodies the civilization and progress of penalty, and contains the value pursuit of justice, humanity and benefit.Therefore, community correction is adopted by most countries in the world, and it is also an effective model for the reform of penalty system in our country. The third part, the advantages and disadvantages of carrying out community correction in Inner Mongolia.The Inner Mongolia region carries out community correction, has the national special minority nationality criminal policy and the minority nationality legislation, also has the certain society, the personnel troop and the community work foundation.But there are also a lot of problems, faced with many difficulties, such as concept, legislation lag, funding, staff shortage, urban, rural and pastoral communities, and so on; the fourth part, the concept of local legislation of community correction in Inner Mongolia.In view of the vast territory of Inner Mongolia, the mixed residence of Mongolian and Han, the undeveloped economy, the imperfect community construction and the coexistence of the town and township, the author puts forward that the local legislation should be carried out first according to the special situation of the region, and the pace of community construction should be quickened at the same time.Actively try new forms of community correction, such as the establishment of centralized correctional institutions similar to halfway houses for scattered farmers and herdsmen.To establish special community correction organizations and enforcement teams, rely on the judiciary, social workers with professional knowledge and volunteers to complete the management, education, inspection and supervision of criminals serving sentences in the community.
