【摘要】： 信息技術的普及和發(fā)展把人類推向了網(wǎng)絡化的時代。網(wǎng)絡改變了人類既有的靜態(tài)秩序,形成了高效快捷的工作、生活模式,網(wǎng)絡犯罪也隨之伴生。本文在考察國內(nèi)外網(wǎng)絡犯罪狀況和治理網(wǎng)絡犯罪對策的基礎上,對網(wǎng)絡犯罪的相關問題作一探討,并從綜合治理的角度,提出了打防管控等應對措施,使網(wǎng)絡服從服務于維護社會穩(wěn)定、推動經(jīng)濟社會發(fā)展、促進社會和諧的大局。 全文分為四大部分。第一部分網(wǎng)絡犯罪概述。該部分從網(wǎng)絡犯罪的概念著手,重點考察了國內(nèi)外理論界對網(wǎng)絡犯罪含義界定的各種觀點,結合自己的理解,總結網(wǎng)絡犯罪區(qū)別于傳統(tǒng)犯罪的特征,歸納了網(wǎng)絡犯罪的類型。同時以發(fā)展的觀點,對未來的網(wǎng)絡犯罪的趨勢進行了大膽預測,認為網(wǎng)絡犯罪將成為未來犯罪的主要形式,特別是指出了在當前國際反恐斗爭不斷加強的情況下,恐怖組織在傳統(tǒng)領域的活動空間受到限制,有逐漸向虛擬空間轉(zhuǎn)移的趨向。認識到國際恐怖主義通過互聯(lián)網(wǎng)勾聯(lián)聚合,可能利用網(wǎng)絡攻擊國家信息化的重要基礎設施,嚴重沖擊國家安全和社會穩(wěn)定。第二部分介紹了網(wǎng)絡犯罪的域外考察。分析了美國、德國、法國、日本等國外發(fā)達國家網(wǎng)絡犯罪的現(xiàn)狀,指出了各國網(wǎng)絡犯罪的共性特點:犯罪數(shù)量成倍增長,花樣不斷翻新,造成的經(jīng)濟損失巨大,網(wǎng)絡恐怖主義開始顯現(xiàn)。認為網(wǎng)絡犯罪已經(jīng)到了必須認真研究治理對策的時候了。通過考察國外發(fā)達國家和國際組織關于網(wǎng)絡犯罪的立法和國外網(wǎng)絡犯罪的對策,為下一步提出我國綜合治理網(wǎng)絡犯罪的對策做了鋪墊。第三部分,闡述了我國網(wǎng)絡犯罪治理的制約因素分析。一是分析了現(xiàn)行法律法規(guī)對網(wǎng)絡犯罪界定的局限性,特別是《刑法》的規(guī)定不能適應治理網(wǎng)絡犯罪的需要;二是分析了網(wǎng)絡安全管理中存在的問題,指出各監(jiān)管單位的工作職責不明確,沒有形成統(tǒng)一完備的互聯(lián)網(wǎng)管理制度體系,沒有形成完全固定的監(jiān)管模式。三是分析了打擊網(wǎng)絡犯罪的不力因素。指出了目前偵辦網(wǎng)絡犯罪案件過程中,存在犯罪事實發(fā)現(xiàn)難、案件管轄確定難、調(diào)查取證難、定罪難、偵查理念滯后、科技手段落后、專業(yè)人才匱乏等方面的制約因素。第四部分,提出借鑒我國社會治安綜合治理的做法,從打擊、防范、管理、機制建設、教育和協(xié)作等層面,應對新形勢下網(wǎng)絡犯罪的重大挑戰(zhàn),并提出了相應的立法對策、行政管理對策、刑事司法對策。 在結語部分,重申了前文的觀點,即:在網(wǎng)絡犯罪日益猖獗的今天,執(zhí)法部門不僅要掌握網(wǎng)絡犯罪的新動向和發(fā)展趨勢,而且還要在正確分析面臨的不利局面和制約因素的基礎上,充分履行職責,實行綜合治理,做好防范工作和打擊工作。
[Abstract]:The popularization and development of information technology has pushed human beings to the era of networking.The network has changed the static order of human beings, formed the efficient and fast work and life mode, and the network crime is accompanied by it.Based on the investigation of the situation of cybercrime at home and abroad and the countermeasures to deal with it, this paper discusses the related problems of cybercrime, and from the angle of comprehensive management, puts forward some countermeasures, such as attacking, preventing, controlling, and so on.Make network service serve to maintain social stability, promote economic and social development, and promote the overall situation of social harmony.The paper is divided into four parts.The first part is an overview of cybercrime.This part starts with the concept of cybercrime, and focuses on the domestic and foreign theoretical circles of the definition of cybercrime, combined with their own understanding, summed up the characteristics of cybercrime is different from the traditional crime, summed up the types of cybercrime.At the same time, from the point of view of development, this paper makes a bold prediction of the future trend of cybercrime, and holds that cybercrime will become the main form of future crime, especially in the context of the strengthening of the current international fight against terrorism.The activity space of terrorist organizations in traditional fields is restricted and tends to transfer to virtual space gradually.It is recognized that international terrorism may be used to attack the important infrastructure of national information by means of Internet linking and aggregation, which will seriously impact national security and social stability.The second part introduces the overseas investigation of cybercrime.This paper analyzes the present situation of cybercrime in developed countries such as the United States, Germany, France and Japan, and points out the common characteristics of cybercrime in various countries: the number of crimes increases exponentially, the patterns are constantly renovated, and the economic losses are enormous.Cyberterrorism is beginning to emerge.Think network crime already arrived must study management countermeasure seriously time.By investigating the legislation of overseas developed countries and international organizations on cybercrime and the countermeasures of foreign cybercrime, this paper paves the way for putting forward the countermeasures of comprehensive control of cybercrime in our country.The third part, elaborated our country network crime the restriction factor analysis.First, it analyzes the limitations of the current laws and regulations on the definition of cybercrime, especially the provisions of the Criminal Law can not meet the needs of the management of cybercrime; second, it analyzes the problems existing in the management of network security.It is pointed out that the responsibilities of each regulatory unit are not clear, the unified and complete system of Internet management system has not been formed, and the completely fixed supervision mode has not been formed.The third is to analyze the weak factors of cracking down on network crime.It is pointed out that in the process of investigating and handling network crime cases, there are some restrictive factors, such as the difficulty of finding out the facts of crime, the difficulty of determining the jurisdiction of the case, the difficulty of obtaining evidence through investigation, the difficulty of conviction, the lag of the investigation idea, the backwardness of scientific and technological means, and the shortage of professional talents.In the fourth part, the author puts forward some measures to deal with the major challenges of cybercrime in the new situation from the aspects of strike, prevention, management, mechanism construction, education and cooperation, and puts forward the corresponding legislative countermeasures.The administrative management countermeasure, the criminal judicature countermeasure.In the concluding part, we reiterate the previous view that, in today's increasingly rampant cybercrime, law enforcement departments should not only master the new trends and development trends of cybercrime,Moreover, on the basis of correctly analyzing the unfavorable situation and restricting factors, we should fully carry out our duties, carry out comprehensive management, and do a good job of preventing and cracking down.
