【摘要】：犯罪人既是刑法學(xué)中的一個(gè)十分重要的范疇,也是犯罪學(xué)研究的基本內(nèi)容之一。這是因?yàn)榉缸锶耸欠缸镄袨榈闹黧w,沒(méi)有犯罪人就無(wú)所謂犯罪的存在。因此, 研究犯罪就不能不研究犯罪人,就不能不研究人自身所固有的人性和人格。犯罪的預(yù)防在很大程度上表現(xiàn)為對(duì)犯罪人的預(yù)防。 本文從界定犯罪人的概念入手,以社會(huì)學(xué)中的社會(huì)化理論、結(jié)構(gòu)功能主義理論以及默頓的越軌理論等為分析依據(jù),在論述過(guò)程中引入了“人性”與“人格”變量來(lái)分析犯罪現(xiàn)象。人性確實(shí)對(duì)犯罪有著很大的影響,人自身既可以是犯罪行為的發(fā)起者,又可以是犯罪行為的控制者。也就是說(shuō),人對(duì)犯罪行為的發(fā)生具有雙重影響。這種影響主要通過(guò)“人格”這個(gè)中介機(jī)制發(fā)生作用。犯罪人格是犯罪人內(nèi)心潛在的反社會(huì)行為模式的總合,它決定了行為人實(shí)施犯罪行為的可能性。行為人因?yàn)樯鐣?huì)化缺陷導(dǎo)致個(gè)體需要結(jié)構(gòu)和滿足需要采取的手段、方式不能和社會(huì)相適應(yīng),只好以非法的手段和方式來(lái)滿足其欲求。在此過(guò)程中,犯罪意識(shí)與犯罪動(dòng)機(jī)不斷強(qiáng)化并逐漸形成犯罪人格,成為潛在的犯罪人。在遇到能夠激發(fā)犯罪意識(shí)的犯罪場(chǎng)里,行為人憑借所形成的犯罪意識(shí),通過(guò)自己的犯罪價(jià)值判斷來(lái)對(duì)客觀環(huán)境作出評(píng)估,以確定實(shí)施犯罪行為,從而完成一個(gè)犯罪人的生成過(guò)程。 最后,本文根據(jù)這一生成過(guò)程,有針對(duì)性地分別對(duì)犯罪人和犯罪場(chǎng)提出了防控措施,以社會(huì)治安綜合治理的方針為指導(dǎo),以“打防結(jié)合、以防為主”的思想為原則,以對(duì)特殊人群、特殊場(chǎng)所的管理控制為重點(diǎn),以社會(huì)控制漏洞的“再防控”為補(bǔ)充,堅(jiān)持司法預(yù)防、社會(huì)預(yù)防與情景預(yù)防相結(jié)合,堅(jiān)持人防、物防與技防相結(jié)合,構(gòu)建一個(gè)全方位、立體式良性運(yùn)行的綜合防衛(wèi)體系。
[Abstract]:Criminal is not only a very important category in criminal law, but also one of the basic contents of criminology.This is because the criminal is the subject of crime, there is no criminal existence.Therefore, the study of crime can not only study the criminal, but also the inherent human nature and personality.To a large extent, the prevention of crime is the prevention of the criminal.This paper begins with the definition of the criminal, based on the sociological theory of socialization, the theory of structural functionalism and Merton's theory of transgression.In the process of discussion, the variables of human nature and personality are introduced to analyze the phenomenon of crime.Human nature does have a great influence on crime. People themselves can be both initiators and controllers of criminal acts.That is to say, people have double influence on the occurrence of criminal behavior.This kind of influence mainly through "personality" this intermediary mechanism produces the function.Criminal personality is the summation of the latent antisocial behavior pattern in the criminal heart, which determines the possibility of the perpetrator to carry out the criminal act.Because of the socialized defect, the individual needs the structure and the means to meet the needs, which can not be adapted to the society, so he has to satisfy his desires by illegal means and ways.In this process, criminal consciousness and motive are strengthened and criminal personality is gradually formed.In a crime scene which can arouse the crime consciousness, the perpetrator evaluates the objective environment through his own judgment of the value of the crime, with the crime consciousness formed, in order to determine the implementation of the criminal act,In order to complete a criminal generation process.Finally, according to this generation process, this article puts forward the prevention and control measures to the criminal and the crime farm separately, takes the social public security comprehensive management policy as the guidance, takes "the attack and the prevention unifies, prevents primarily" the thought as the principle,Focusing on the management and control of special people and special places, taking the "re-prevention and control" of social control loopholes as a supplement, insisting on the combination of judicial prevention, social prevention and situational prevention, and insisting on the combination of civil air defense, material control and technical prevention,Build an all-round, three-dimensional benign operation of the comprehensive defense system.
