【摘要】：公安機(jī)關(guān)是國(guó)家政權(quán)的重要組成部分，承擔(dān)著鞏固黨的執(zhí)政地位、維護(hù)國(guó)家長(zhǎng)治久安、保障人民安居樂(lè)業(yè)、促進(jìn)經(jīng)濟(jì)社會(huì)發(fā)展的重大政治責(zé)任，，在建設(shè)社會(huì)主義法治國(guó)家事業(yè)中發(fā)揮著舉足輕重的作用。六七十年代《一分錢(qián)》的兒歌塑造了今天大多數(shù)中國(guó)人關(guān)于警察的初始印象，即“警察叔叔”的和善形象；八十年代電視連續(xù)劇《便衣警察》的播出，更讓人們對(duì)警察肅然起敬，警民關(guān)系如魚(yú)水之情；九十年代推出的濟(jì)南交警及福建漳州110則讓公眾對(duì)“嚴(yán)格執(zhí)法，熱情服務(wù)”及“有困難找警察”等口號(hào)耳熟能詳。然而，在警察天天忙忙碌碌為公眾熱情服務(wù)時(shí)，警民關(guān)系卻越來(lái)越不和諧。重要原因就是隨著公安工作從管理型向綜合型的轉(zhuǎn)變，警察面臨的非警務(wù)活動(dòng)日益增多，嚴(yán)重影響了警察形象，導(dǎo)致警民關(guān)系的緊張和對(duì)立；引起群眾的不滿(mǎn)和反感，遭到群眾謾罵、圍攻，甚至毆打警察的事件時(shí)有發(fā)生。警察過(guò)多地參與非警務(wù)活動(dòng)早已引發(fā)各地人大代表、政協(xié)委員的普遍關(guān)注。賈春旺部長(zhǎng)、周永康部長(zhǎng)也在講話(huà)中明確提出嚴(yán)禁警察從事非警務(wù)活動(dòng)，胡錦濤總書(shū)記在同第二十次全國(guó)公安會(huì)議部分代表座談時(shí)強(qiáng)調(diào)：“不得隨意指派公安機(jī)關(guān)參與非警務(wù)活動(dòng)�！比绾谓鉀Q，是一個(gè)重大的現(xiàn)實(shí)問(wèn)題�；诖�，我選擇“警察的非警務(wù)活動(dòng)研究”作為碩士學(xué)位論文的主題。 本文分為三章。第一章概述警察的非警務(wù)活動(dòng)。本章從西方國(guó)家的警察概念和我國(guó)警察概念的歷史沿革，分析警察概念的歷史演進(jìn)及發(fā)展。我國(guó)目前使用的警察一詞屬于外來(lái)詞匯，是指某人員而非機(jī)關(guān)，機(jī)關(guān)則被稱(chēng)為公安機(jī)關(guān)。從對(duì)警務(wù)活動(dòng)涵義的闡述分析即警察為實(shí)現(xiàn)國(guó)家目的而依法進(jìn)行的各種活動(dòng)，以及對(duì)警務(wù)活動(dòng)范圍的具體界定，并結(jié)合透視相關(guān)的法律法規(guī)總結(jié)出非警務(wù)活動(dòng)的概念：指公安機(jī)關(guān)及其人民警察所從事的超越法定職權(quán)范圍的各種活動(dòng)。從非警務(wù)活動(dòng)的發(fā)展回顧即上世紀(jì)警察參與計(jì)劃生育、參與催繳公糧、征收稅款、參
[Abstract]:The public security organs are an important part of the state power and bear the great political responsibility of consolidating the ruling position of the party, maintaining the long-term stability of the country, ensuring the people to live and work in peace and contentment, and promoting economic and social development.It plays an important role in building a socialist country ruled by law.The children's songs of the '60s and' 70s have shaped the initial impression of the police in most Chinese today, that is, the friendly image of "the police uncle"; and the broadcast of the 1980s TV series "plainclothes Police".It also makes people respect the police, and the relationship between the police and the people is like fish and water. The Jinan Traffic Police and Zhangzhou 110, Fujian Province, launched in the 1990s, have made the public familiar with slogans such as "strict law enforcement, enthusiastic service" and "finding the police in difficulty."However, while the police are busy serving the public enthusiastically every day, the relationship between the police and the public is becoming more and more disharmonious.The important reason is that with the change of the public security work from the management type to the comprehensive type, the non-police activities faced by the police are increasing day by day, seriously affecting the image of the police, leading to tension and opposition between the police and the people, causing dissatisfaction and antipathy among the masses.Incidents of abuse, besieging and even beatings of the police have occurred from time to time.The excessive participation of police in non-police activities has caused widespread concern among people's congresses and CPPCC members all over the country.In their speeches, Minister Jia Chunwang and Minister Zhou Yongkang also explicitly proposed that the police be strictly prohibited from engaging in non-police activities.General Secretary Hu Jintao, in a discussion with some representatives of the 20th National Public Security Conference, stressed: "Public security organs shall not be arbitrarily assigned to participate in non-police activities."How to solve, is a major practical problem.Based on this, I choose "the study of non-police activities of the police" as the theme of my master's thesis.This paper is divided into three chapters.The first chapter summarizes the non-police activities of the police.This chapter analyzes the evolution and development of the concept of police from the historical evolution of the concept of police in western countries and our country.The term "police", which is used in our country, is a foreign word, which refers to a person rather than an organ, and an organ is called a public security organ.From the elaboration and analysis of the meaning of the police activities, that is, the various activities carried out by the police in accordance with the law in order to achieve the national goal, and the specific definition of the scope of the police activities,Combined with the relevant laws and regulations, this paper summarizes the concept of non-police activities: the public security organs and the people's police engaged in activities beyond the scope of statutory powers.Reviewing the development of non-police activities in the last century, the police took part in family planning, called for public grain, collected taxes, and consulted.
