【摘要】：長沙市作為省會(huì)城市,其流動(dòng)人口犯罪不僅僅具備全國流動(dòng)人口犯罪的特征,更具有其自身的特點(diǎn)。實(shí)地調(diào)查掌握的數(shù)據(jù)資料表明：長沙市近五年來70%以上的刑事案件是流動(dòng)人口所為；長沙市流動(dòng)人口和出租屋治安管理中存在的“56789”現(xiàn)象越來越嚴(yán)重,且呈現(xiàn)出了性別、年齡、文化程度等多方面的犯罪特征。在所抓獲的流動(dòng)人口犯罪嫌疑人中,男性比女性更傾向于侵財(cái)犯罪,尤其在盜竊、搶劫等暴力犯罪中男性明顯高于女性。在年齡特征方面,年齡越小,其犯罪類型越集中于侵財(cái)方面,年齡越大,其犯罪類型則越分散,各種犯罪類型都占一定的比例,年齡越大,越偏向于實(shí)施詐騙、制販毒品等具有一定智能性和較大案值的犯罪行為。在文化程度方面,流動(dòng)人口犯罪嫌疑人文化程度整體上比較低；而且文化程度越低,涉嫌盜竊、搶劫、故意殺人等暴力犯罪所占的比重越高；文化程度越高,涉嫌受賄等智商犯罪的比重越高。長沙市流動(dòng)人口犯罪呈現(xiàn)上述特征,其原因是多方面的,其中流動(dòng)人口文化素質(zhì)偏低,法律意識(shí)淡漠、在社會(huì)競爭中處于劣勢,是流動(dòng)人口犯罪的個(gè)體原因；而政府對(duì)流動(dòng)人口管理服務(wù)不到位,流動(dòng)人口失去家庭甚至社會(huì)監(jiān)督等,是流動(dòng)人口犯罪的社會(huì)原因。因此,要預(yù)防長沙市流動(dòng)人口犯罪,首先應(yīng)通過教育、幫扶等手段提高流動(dòng)人口自身素質(zhì)和社會(huì)競爭力；其次應(yīng)從機(jī)構(gòu)、隊(duì)伍建設(shè)、管理辦法等方面強(qiáng)化流動(dòng)人口管理和服務(wù)舉措,加強(qiáng)對(duì)流動(dòng)人口的管理和服務(wù)；再次應(yīng)針對(duì)長沙市流動(dòng)人口犯罪的特點(diǎn)加大對(duì)流動(dòng)人口犯罪的打擊力度,以遏制和減少流動(dòng)人口違法犯罪。
[Abstract]:Changsha as the capital city, its floating population crime not only has the characteristics of the national floating population crime, but also has its own characteristics.The data obtained from the field investigation show that more than 70% of the criminal cases in Changsha in the past five years are the work of the floating population, and the phenomenon of "56789" in the management of floating population and rental houses in Changsha is becoming more and more serious, and the phenomenon of "56789" is more and more serious.Age, education, and other aspects of the crime characteristics.Among the arrested migrant criminal suspects, men are more likely than women to commit financial crimes, especially in crimes of theft, robbery and other violent crimes.In terms of age characteristics, the younger the age, the more concentrated the crime type is on the invasion of wealth, the older the age, the more dispersed the crime type is, and the more various types of crimes account for a certain proportion, the older the age, the more inclined to commit fraud.Making and selling drugs and other criminal acts with certain intelligence and larger case value.In terms of education level, the overall education level of the floating population criminal suspects is relatively low; and the lower the education level, the higher the proportion of violent crimes such as theft, robbery, intentional homicide, etc.; the higher the education level,The higher the proportion of intelligence crimes such as bribery.There are many reasons for the crime of floating population in Changsha. Among them, the cultural quality of floating population is low, the legal consciousness is indifferent, and they are at a disadvantage in social competition, which is the individual reason of floating population crime.But the government does not manage the service to the floating population in place, the floating population loses the family even the social supervision and so on, which is the social reason of the floating population crime.Therefore, in order to prevent the crime of floating population in Changsha, first of all, we should improve the quality and social competitiveness of the floating population by means of education, help and other means; secondly, we should build institutions and teams.To strengthen the management and service measures of floating population, and to strengthen the management and service of floating population; thirdly, to strengthen the crackdown on the crimes committed by floating population in Changsha,In order to curb and reduce the floating population illegal crime.
