犯罪學(xué)習(xí)與模仿問題研究

【摘要】: 犯罪既是一個歷史范疇,又是一個時代命題。同世界大多數(shù)國家一樣,正逐漸步入現(xiàn)代化的我國一直以來也在飽受犯罪問題的困擾。雖然犯罪的內(nèi)涵與外延以及對社會發(fā)展的影響都深深打上了時代烙印,但一些經(jīng)典的犯罪學(xué)理論仍可成為我們對付當前犯罪的理論武器。 正如其他社會行為可以通過相互學(xué)習(xí)而獲得一樣,犯罪行為也可以通過模仿而習(xí)得,因而在我國一些地方出現(xiàn)的犯罪傳播現(xiàn)象絕非偶然。然而令人不安的是,犯罪學(xué)習(xí)與模仿問題尚未引起我國社會有關(guān)部門的重視,或者未能針對犯罪復(fù)制與衍射采取富有成效的預(yù)防措施。 在這種情況下,以犯罪學(xué)習(xí)與模仿作為研究命題,通過對犯罪學(xué)習(xí)行為的剖析,揭示其系統(tǒng)構(gòu)成、發(fā)生機理等問題,以期在此基礎(chǔ)上以保障我國公共秩序和社會安定為目的,就犯罪預(yù)測、犯罪預(yù)防以及犯罪人矯治等提出政策導(dǎo)向和應(yīng)對措施方面的建議,無疑具有重要意義。 本文第一部分從人類的學(xué)習(xí)本能出發(fā),論證了在廣泛的社會教化之下,犯罪學(xué)習(xí)其實是一種必然的正常邏輯。并且,在批判犯罪遺傳學(xué)說的基礎(chǔ)上進一步得出了犯罪是可以習(xí)得的結(jié)論。 第二部分把對犯罪學(xué)習(xí)與模仿的探討置于社會學(xué)的視角下,指出犯罪學(xué)習(xí)作為一種特定的社會學(xué)習(xí),不僅是在社會生活中不同交往的結(jié)果,更是學(xué)習(xí)個體選擇與同化的過程。 第三部分指明了學(xué)習(xí)與模仿因素在犯罪綜合動因系統(tǒng)中的定位:學(xué)習(xí)并不是犯罪的全部原因,但卻是犯罪的重要促因。并且,多數(shù)人通過學(xué)習(xí)抑制犯罪而不去犯罪,具有模仿情結(jié)的人才易于犯罪學(xué)習(xí)與模仿。 第四部分分析了犯罪學(xué)習(xí)的系統(tǒng)構(gòu)成。心智健全的人都能學(xué)習(xí)犯罪,但有些人更具學(xué)習(xí)傾向。通過犯罪信息傳導(dǎo)和榜樣演示,他們可以學(xué)得幾乎所有的犯罪類型,并且犯罪思想或方法等同樣是學(xué)習(xí)內(nèi)容。 第五部分揭示了犯罪學(xué)習(xí)機制。如果說犯罪意志與犯罪心理的塑成是犯罪學(xué)習(xí)的一種必然,那么促使模仿發(fā)生的各種要素則是犯罪學(xué)習(xí)的一種必要,因而需要進一步了解犯罪學(xué)習(xí)的心理機制與動因機制。 第六部分旨在結(jié)合當前社會實踐,從法律的威懾效應(yīng)、未成年人犯罪的預(yù)防、傳媒的犯罪示范、刑事司法的啟示四個方面論述了犯罪學(xué)習(xí)理論在社會實踐與犯罪防控中的應(yīng)用。 本文最后指出,對犯罪學(xué)習(xí)的防控,實際上是犯罪整體防控的重要組成部分。盡管從根本上消除犯罪學(xué)習(xí)與模仿既不現(xiàn)實也不可能,然而我們?nèi)钥梢灾铝τ跍p少與控制它。這也正是本文寫作的初衷。
[Abstract]:Crime is not only a historical category, but also a proposition of the times.Like most countries in the world, our country has been plagued by crime problem.Although the connotation and extension of crime and its influence on social development are deeply branded by the times, some classical criminological theories can still become the theoretical weapon for us to deal with the current crime.Just as other social behaviors can be acquired by learning from each other, criminal behavior can also be learned by imitation, so the phenomenon of criminal communication in some parts of our country is not accidental.However, it is disturbing that the problem of learning and imitating the crime has not yet attracted the attention of the relevant departments of our society, or failed to take effective preventive measures against the crime replication and diffraction.In this case, taking the crime learning and imitation as the research proposition, through the analysis of the criminal learning behavior, it reveals the system composition, the occurrence mechanism and so on, in order to safeguard our country public order and the social stability on this foundation.It is undoubtedly of great significance to put forward policy guidance and countermeasures on crime prediction, crime prevention and correction of offenders.In the first part of this paper, from the learning instinct of human beings, it is proved that under the extensive social education, criminal learning is a kind of inevitable normal logic.Furthermore, on the basis of criticizing the theory of criminal genetics, the author draws the conclusion that crime can be learned.The second part puts the study of crime learning and imitation under the perspective of sociology, and points out that as a specific social learning, criminal learning is not only the result of different communication in social life, but also the process of individual choice and assimilation.The third part points out the orientation of the factors of learning and imitation in the system of comprehensive motivation of crime: learning is not all the causes of crime, but it is an important cause of crime.Moreover, most people do not commit crime by learning to suppress crime, and people with imitation complex are apt to learn and imitate crime.The fourth part analyzes the system constitution of crime learning.Sane people can learn to commit crime, but some are more inclined to learn.Through the transmission of crime information and demonstration of example, they can learn almost all types of crime, and crime ideas or methods are also learning content.The fifth part reveals the mechanism of crime learning.If the formation of criminal will and criminal psychology is a necessity of criminal learning, then it is necessary to promote the various elements of imitation. Therefore, it is necessary to further understand the psychological mechanism and motivation mechanism of criminal learning.The sixth part aims to discuss the application of crime learning theory in social practice and crime prevention from four aspects: deterrent effect of law, prevention of juvenile delinquency, demonstration of crime by the media and enlightenment of criminal justice.Finally, this paper points out that the prevention and control of crime learning is actually an important part of overall crime prevention and control.Although it is impractical and impossible to fundamentally eliminate crime learning and imitation, we can still work to reduce and control it.This is the original intention of this article.
