【摘要】： 網(wǎng)絡犯罪是一種新近出現(xiàn)的跨國犯罪類型,其所具有的專業(yè)性、隱蔽性、嚴重危害性等特點引起了國際社會的廣泛關注。從跨國犯罪的角度來重新審視網(wǎng)絡犯罪,不僅可以跳出以往過于糾纏網(wǎng)絡犯罪的概念、分類等傳統(tǒng)理論研究的框架,進一步拓寬網(wǎng)絡犯罪研究的視野,而且有助于全面了解網(wǎng)絡犯罪跨國化的趨勢對當今各國刑事立法與司法實踐所造成的影響和沖擊,并反思在防范網(wǎng)絡犯罪的對策方面各國國內(nèi)立法以及國際條約的利弊得失,也為我國司法部門解決實踐中的難題提供了參考。 在本文中,筆者對網(wǎng)絡犯罪的現(xiàn)狀進行了重新梳理,從跨國犯罪的視角對其重新分類,明確其特征,介紹國際社會及各國政府在反網(wǎng)絡犯罪方面的立法及實踐;分析并總結了制約反網(wǎng)絡犯罪實踐的若干問題,并對現(xiàn)有的相關觀點進行了評析;提出建立一體化的國際反網(wǎng)絡犯罪框架的設想,呼吁應從國際合作和國內(nèi)努力內(nèi)外兩方面對此框架進行完善,同時分析評論了中國國內(nèi)立法從中所應得到的啟示。
[Abstract]:Network crime is a new type of transnational crime, which has the characteristics of professionalism, concealment, serious harmfulness and so on. Not only can we jump out of the traditional theoretical research framework such as over-entanglement in the concept of cybercrime in the past and classify it, and further broaden the horizons of the research on cybercrime. Moreover, it is helpful to understand comprehensively the influence and impact of the trend of transnational cybercrime on the criminal legislation and judicial practice of various countries, and to reflect on the advantages and disadvantages of national legislation and international treaties in preventing cybercrime. It also provides a reference for the judicial department to solve the problems in practice. In this paper, the author reorganizes the present situation of cybercrime, reclassifies it from the perspective of transnational crime, clarifies its characteristics, and introduces the legislation and practice of international society and governments in anti-cybercrime. This paper analyzes and summarizes some problems that restrict the practice of anti-cybercrime, analyzes the existing related viewpoints, and puts forward the idea of establishing an integrated international anti-cybercrime framework. It calls for the improvement of this framework from the aspects of international cooperation and internal and external efforts, and analyzes and comments on the enlightenment that China's domestic legislation should get from it.
