【摘要】： 女性違法犯罪是以犯罪主體的性別特征為標(biāo)準(zhǔn)而劃分的犯罪類型。盡管女性犯罪因時(shí)代和國別的不同在數(shù)量、類型、量刑辦法上有所不同，但共同的趨勢是：隨著工業(yè)化的發(fā)展，女性社會參與的增加，女性違法犯罪呈增長的趨勢。 本文基于前人的研究平臺，注重從實(shí)證、歸納的分析方法入手，通過對女性罪犯心理研究所涉及的法理、近二十年中女性犯罪狀況及表現(xiàn)出的特征進(jìn)行了分析。在本土化的基礎(chǔ)上，結(jié)合寧夏回族自治區(qū)自治的主體民族，對該民族的女性犯罪與改造進(jìn)行研究，并提出相應(yīng)的構(gòu)建思路。 本文共分為四部分，，主要研究和分析了以下幾個(gè)方面的問題： 一、女性罪犯心理的法理分析 介紹、歸納了犯罪心理的滋生及其形成，女性犯罪心理致罪因素，結(jié)合中國女性罪犯現(xiàn)狀與特征，指出現(xiàn)有的女性犯罪理論研究及女性罪犯改造工作中的缺陷與不足。目的是以打擊犯罪和預(yù)防犯罪為前提，應(yīng)當(dāng)把研究女性犯罪心理作為長期的系統(tǒng)的社會工程。 二、回族共性問題研究 主要對回族共同的基本信仰和生活習(xí)慣的介紹，導(dǎo)讀回族的民族性格，揭示回族罪犯與漢族罪犯、回族女性罪犯與漢族女性罪犯的差異性，撩起回族女性犯罪神秘的面紗。 三、回族女性犯罪的特點(diǎn)與原因探析 用列表及實(shí)證分析的方法，對回族女性犯罪的特點(diǎn)及原因進(jìn)行了初步的探討，歸納出回族女性罪犯的思想行為特點(diǎn)、最為常見的犯罪形式和犯罪方法、在押回族女犯最突出的改造表現(xiàn)，明確回族女性犯罪與一般漢族女性犯罪的共性與個(gè)性，旨在體現(xiàn)在監(jiān)管工作中對回族女性罪犯的改造特色。 四、回族女性罪犯的改造方法研究 以中國司法部提出的對女子監(jiān)獄管理實(shí)行“法制化、科學(xué)化、社會化”為基礎(chǔ)，針對現(xiàn)有監(jiān)管改造中存在的缺憾與不足，提出構(gòu)建十大改造方法，正確引導(dǎo)回族女性罪犯的宗教信仰、服法守法意識，尋求回族女性罪犯回歸之路。
[Abstract]:Female delinquency is a type of crime that is classified by the gender characteristics of the subject of crime. Although the number, type and sentencing method of female crime vary according to the age and country. But the common trend is: with the development of industrialization and the increase of female social participation, the female crime is increasing. Based on the previous research platform, this paper focuses on the empirical, inductive analysis methods, through the psychological research of women criminals involved in the legal theory, On the basis of localization and the main ethnic group of Ningxia Hui Autonomous region, this paper makes a study on the female crime and reform of the female crime and reform of this nationality in the past two decades. And put forward the corresponding construction ideas. This paper is divided into four parts, the main research and analysis of the following aspects of the problems:. First, the legal theory analysis of female criminals' psychology. This paper introduces and summarizes the breeding and formation of criminal psychology, the factors leading to the crime of female criminal psychology, and the present situation and characteristics of female criminals in China. This paper points out the defects and deficiencies in the existing research on the theory of female crime and the reform of female criminals. The purpose is to combat crime and prevent crime, and the study of female criminal psychology should be regarded as a long-term systematic social engineering. Second, the study on the Common problems of Hui nationality. It mainly introduces the common basic beliefs and living habits of the Hui nationality, guides the national character of the Hui nationality, reveals the difference between the Hui criminals and the Han criminals, the Hui female criminals and the Han women criminals, and raises the mysterious veil of the Hui women's crimes. Third, the characteristics and reasons of Hui women's crime. By using the method of list and empirical analysis, this paper makes a preliminary discussion on the characteristics and causes of the crimes committed by Hui women, and concludes the ideological and behavioral characteristics, the most common forms of crime and the methods of crimes committed by the female criminals of the Hui nationality. The most prominent reform performance of female prisoners of Hui nationality in custody is to make clear the commonness and individuality of female crime of Hui nationality and that of common female crime of Han nationality, in order to reflect the reform characteristics of female criminals of Hui nationality in the supervision work. Fourth, research on the reform methods of Hui women criminals. Based on the "legalization, scientization and socialization" of the women's prison management proposed by the Ministry of Justice of China, and aiming at the shortcomings and shortcomings in the existing supervision and transformation, the author puts forward ten methods to construct the reform. We should correctly guide the religious beliefs of female Hui criminals, obey the law and obey the law, and seek the way to the return of female Hui criminals.
