【摘要】：初查概念是我國查辦貪污賄賂案件實(shí)踐的產(chǎn)物。國外的初步偵查程序在立法上有明確規(guī)定,并在立案前實(shí)施,其目標(biāo)是作出是否立案的結(jié)論,為后續(xù)偵查的順利開展打下基礎(chǔ)。根據(jù)我國偵查工作實(shí)踐,結(jié)合國外偵查經(jīng)驗(yàn),在反貪局內(nèi)分設(shè)初步偵查部門和特別偵查部門比較合適。
[Abstract]:The concept of initial investigation is the product of the practice of investigating corruption and bribery cases in our country. The preliminary investigation procedure in foreign countries is clearly stipulated in legislation and carried out before filing the case. Its goal is to draw a conclusion on whether or not to file a case. According to the investigation practice of our country and foreign investigation experience, it is appropriate to set up the preliminary investigation department and the special investigation department in the Anti-Corruption Bureau.
