【摘要】： 青少年犯罪已經(jīng)成為繼毒品犯罪、環(huán)境污染之后的世界第三大公害,青少年人數(shù)多、分布廣,因此分類別的進行犯罪預防的研究具有積極的作用。隨著我國高等職業(yè)教育的大眾化,全國高職院校在校生總?cè)藬?shù)已達到750萬左右,如此龐大的一個群體,對社會的影響非常巨大。近年來,高職學生犯罪數(shù)量呈上升趨勢,類型趨于多樣化,國內(nèi)學者對高職學生犯罪的研究相對缺乏。筆者針對當前情況對高職學生犯罪的案例進行調(diào)查、歸類、整理、研究,分析其特點,剖析其原因,尋求預防高職學生犯罪的途徑。 本文分六個部分:引言部分論述了高職學生犯罪現(xiàn)象與日俱增的事實,引出本文的論題,接著分析了研究本論題的現(xiàn)實價值;正文第一部分:在借鑒刑法學與犯罪學的基礎上,本著有利于犯罪預防的出發(fā)點,從廣義犯罪學的角度對高職學生犯罪的內(nèi)涵進行了歸納,它包括違反《刑法》的行為、違反《治安管理處罰法》的行為、《預防未成年人犯罪法》中規(guī)定的不良行為和嚴重不良行為;第二部分:綜述了高職學生犯罪的現(xiàn)狀。在分析現(xiàn)狀的基礎上剖析了高職學生犯罪的特點及發(fā)展趨勢;第三部分:高職學生犯罪的主要類型,對高職學生犯罪類型進行了粗略的歸類,分為財產(chǎn)性犯罪、暴力型犯罪、涉性類犯罪;第四部分:高職學生犯罪的原因分析。首先介紹了國內(nèi)外代表性的罪因理論,并進行了簡單的評析,然后分析高職學生犯罪的個人原因及社會原因,個人原因主要包括生理因素、心理因素、法律意識的因素等,社會原因主要包括經(jīng)濟因素、社會傳媒因素、學校因素、家庭因素等;第五部分:高職學生犯罪的預防措施。主要從三個方面進行論述——社會預防、學校預防、家庭預防。其中社會預防包括經(jīng)濟預防、政治預防、文化預防;學校預防包括建立犯罪預測制度、建立技術(shù)預防與觀念預防的雙重預防機制等方面;個人預防包括創(chuàng)建和諧的家庭關系、倡導良好的家庭美德、強化科學的家庭教育、重視家長的榜樣力量等。
[Abstract]:Juvenile delinquency has become the third largest public hazard in the world after drug crimes and environmental pollution. With the popularization of higher vocational education in China, the total number of students in higher vocational colleges has reached about 7.5 million, such a large group. The influence on society is very great. In recent years, the number of crimes of higher vocational students is on the rise, and the types tend to be diversified. According to the current situation, the author investigates, classifies, arranges, studies, analyzes its characteristics, analyzes its causes, and seeks ways to prevent higher vocational students from committing crimes. This paper is divided into six parts: the introduction discusses the fact that the crime phenomenon of higher vocational students is increasing, leads to the topic of this paper, and then analyzes the practical value of the study; The first part of the text: on the basis of drawing lessons from the criminal law and criminology, in the light of the starting point conducive to crime prevention, this paper sums up the connotation of the crime of higher vocational students from the angle of broad sense criminology, which includes the behavior of violating the Criminal Law. Acts in violation of the Law on the punishment of Public Security Administration, and bad and serious acts stipulated in the Law on the Prevention of Juvenile Delinquency; The second part: summarizes the present situation of higher vocational students' crime, analyzes the characteristics and development trend of higher vocational students' crime on the basis of analyzing the present situation, the third part: the main types of higher vocational students' crime, The crime types of vocational college students are roughly classified into property crime, violent crime and sex related crime. Part four: the analysis of the causes of higher vocational students' crime. Firstly, it introduces the theory of crime cause, which is representative at home and abroad. Then it analyzes the personal and social reasons of higher vocational students' crime. The personal reasons mainly include physiological factors, psychological factors, legal consciousness factors and so on. Social reasons mainly include economic factors. Social media factors, school factors, family factors, etc. Part V: preventive measures for higher vocational students' crime. It is mainly discussed from three aspects-social prevention, school prevention, family prevention, among which social prevention includes economic prevention. Political prevention, cultural prevention, school prevention including the establishment of a crime prediction system, the establishment of a dual prevention mechanism of technical prevention and conceptual prevention, personal prevention includes building harmonious family relations, advocating good family virtues, etc. Strengthen the scientific family education, attach importance to the role model of parents and so on.
