【摘要】：近現(xiàn)代警政歷史實踐表明,國家警察與地方警察的分設(shè)分權(quán)是民主與法治建設(shè)的重要組成部分。在我國,國家警察和地方警察混設(shè)共用給警察權(quán)運行帶來了種種弊端。地方警察權(quán)的明晰是當(dāng)代中國民主政治改革的重要趨勢,也是分稅制和分財制改革深化的必然結(jié)果之一。在具體制度設(shè)計上,應(yīng)當(dāng)精密論證、穩(wěn)步推進,既要注意充分利用現(xiàn)有警務(wù)資源,不增加法律成本,也要保證國、地警察職責(zé)劃界明確,分工合作高效。"兩警分權(quán)"的意義在于:將會更有效維護國家整體利益和民眾合法權(quán)益;將為警察隊伍的職業(yè)化建設(shè)和警務(wù)效能的提高創(chuàng)造更有利的條件;將更加適應(yīng)各省區(qū)非均衡發(fā)展的現(xiàn)狀,拓展出警務(wù)多元化發(fā)展的更大空間。
[Abstract]:The historical practice of police administration in modern times shows that the separation and separation of powers between the national police and the local police is an important part of the construction of democracy and the rule of law. The mixed sharing of the national police and the local police has brought all sorts of malpractices to the operation of the police power. The clarity of the local police power is an important trend of the democratic political reform in contemporary China. It is also one of the inevitable results of the deepening of the reform of the tax system and the financial system. In the design of the specific system, it should be precisely demonstrated and steadily advanced. It is necessary to pay attention to making full use of existing police resources, not only to increase the legal costs, but also to guarantee countries. The demarcation of duties of local police is clear, and the division of labor and cooperation is efficient. The meaning of "separation of powers between the two police" lies in: it will safeguard the national interests and the legitimate rights and interests of the people more effectively; It will create more favorable conditions for the professionalization of the police force and the improvement of police efficiency, adapt to the unbalanced development of the provinces and regions, and expand the space for the diversified development of the police.
