【摘要】：我國城市流動攤販管理面臨困境是不爭的事實,管理效果反復(fù),暴力沖突不斷,“禁”與“放”的尺度無法把握等難題使得城管執(zhí)法機關(guān)的形象嚴(yán)重受損,如何在維護(hù)社會和諧穩(wěn)定的前提條件下,由單純的以罰代管轉(zhuǎn)向管理與服務(wù)相結(jié)合,對流動攤販占道經(jīng)營進(jìn)行科學(xué)、高效的管理,是我們目前城市管理工作亟待解決的重要研究課題。 本文主要運用文獻(xiàn)資料分析法,對比分析法、調(diào)查研究和訪談法,對昆明市西山區(qū)流動攤販占道經(jīng)營管理現(xiàn)狀進(jìn)行分析,指出占道經(jīng)營管理過程中存在的問題,并從占道經(jīng)營攤販層面、占道攤點消費者層面、城管執(zhí)法機關(guān)及城管執(zhí)法人員層面、社會層面、政府管理層面多角度對昆明市西山區(qū)流動攤販占道經(jīng)營管理收效甚微的原因進(jìn)行深入研究。 通過對國內(nèi)外城市流動攤販占道經(jīng)營管理模式的總結(jié)和借鑒,梳理出昆明市西山區(qū)流動攤販占道經(jīng)營管理的方向和原則：在維護(hù)社會和諧穩(wěn)定的前提條件下,對流動攤販占道經(jīng)營進(jìn)行科學(xué)、高效的管理。并對流動攤販占道經(jīng)營管理的新方法進(jìn)行思考和探索,試圖通過創(chuàng)新流動攤販占道經(jīng)營的管理方式；暢通市民參與城市管理的有效渠道搭建公眾參與平臺,積極創(chuàng)建多元化城市管理的新格局等多方面的舉措為破解流動攤販占道經(jīng)營管理困境提供一些建議。
[Abstract]:It is an indisputable fact that the management of mobile vendors in cities in our country is faced with difficulties. The effect of management is repeated, the violent conflicts continue, and the scale of "ban" and "release" cannot be grasped, which makes the image of urban management law enforcement agencies seriously damaged. Under the premise of maintaining social harmony and stability, how to change the management from the pure punishment to the combination of management and service, and how to carry out scientific and efficient management of the mobile vendors' occupation management, and how to manage it scientifically and efficiently, in order to maintain social harmony and stability. Is our current urban management work to solve an important research topic. This article mainly uses the literature analysis method, the contrast analysis method, the investigation research and the interview method, carries on the analysis to the Kunming west mountain area mobile vendor to occupy the road management present situation, points out the existing problem in the occupation road management process, And from the level of business vendors, consumer level, urban management law enforcement agencies and urban management law enforcement officers, social level, This paper makes a deep study on the reasons for the little effect of mobile vendors' management in Xishan District of Kunming City from the government management level. Through summing up and using for reference the management mode of mobile street vendors at home and abroad, the paper puts forward the direction and principle of management of mobile vendors in Xishan area of Kunming: under the precondition of maintaining social harmony and stability, Scientific and efficient management is carried out on the mobile vendors' occupation management, and the new method of the mobile vendors' occupation management is considered and explored in order to try to innovate the management mode of the mobile vendors' occupation of the road. The effective channels for citizens to participate in urban management and the establishment of a platform for public participation, as well as the creation of a new pattern of diversified urban management, provide some suggestions for solving the plight of mobile vendors in the management of urban management.
