【摘要】： 本文分四部分，共四萬余字。對于網(wǎng)絡(luò)犯罪的研究，本文首先從網(wǎng)絡(luò)犯罪 概念的界定入手，運用歷史和比較的方法，介紹了網(wǎng)絡(luò)犯罪概念含義的發(fā)展變化 過程，探討了網(wǎng)絡(luò)犯罪概念的界定方法，從刑法學(xué)和犯罪學(xué)的角度對網(wǎng)絡(luò)犯罪的 概念進(jìn)行了界定，明確了網(wǎng)絡(luò)犯罪的概念。然后，本文從網(wǎng)絡(luò)犯罪的產(chǎn)生開始， 介紹了網(wǎng)絡(luò)犯罪的發(fā)展情況，研究了網(wǎng)絡(luò)犯罪的主要特點，并結(jié)合計算機網(wǎng)絡(luò)技 術(shù)的發(fā)展規(guī)律及國內(nèi)外學(xué)者對網(wǎng)絡(luò)犯罪趨勢的預(yù)測，從宏觀的角度對網(wǎng)絡(luò)犯罪的 發(fā)展趨勢進(jìn)行了預(yù)測。網(wǎng)絡(luò)犯罪是一種新的犯罪類型，具有不同于其他犯罪類型 的獨有的構(gòu)成特征。本文第三部分即在對“我國刑法學(xué)界關(guān)于網(wǎng)絡(luò)犯罪構(gòu)成特征 的各種觀點”進(jìn)行總體的“述、評、論”之基礎(chǔ)上，對網(wǎng)絡(luò)犯罪分別從犯罪主 體、犯罪主觀方面、犯罪客觀方面、犯罪客體這四個方面進(jìn)行了研討。最后，本 文第四部分對預(yù)防和控制網(wǎng)絡(luò)犯罪的刑事法律對策進(jìn)行了研究。該部分借鑒國外 有關(guān)預(yù)防和控制網(wǎng)絡(luò)犯罪的法律制度、司法先例，結(jié)合我國的實際情況，，分析了 我國現(xiàn)行刑事法律中關(guān)于網(wǎng)絡(luò)犯罪規(guī)定的不足，并從刑事立法、司法兩方面探討 了預(yù)防和控制網(wǎng)絡(luò)犯罪應(yīng)采取的法律對策，提出了完善我國預(yù)防和控制網(wǎng)絡(luò)犯罪 的刑事立法、司法對策的初步設(shè)想。
[Abstract]:This article is divided into four parts, a total of more than 40,000 words. For the study of cybercrime, this paper first from the network crime. Starting with the definition of the concept, using the method of history and comparison, this paper introduces the development and change of the meaning of the concept of cybercrime. This paper discusses the definition method of the concept of network crime, from the angle of criminal law and criminology, discusses the concept of network crime. The concept is defined and the concept of cybercrime is clarified. Then, this paper begins with the emergence of cybercrime. This paper introduces the development of the network crime, studies the main characteristics of the network crime, and combines the computer network technique. The law of the development of cybercrime and the prediction of the trend of cybercrime by scholars at home and abroad. The trend of development is forecasted. Cybercrime is a new type of crime, which is different from other types of crime. The third part of this paper is about the constitution of cybercrime in the field of criminal law of our country. On the basis of all kinds of viewpoints, such as "overall", "comment, comment", respectively, the authors of the crime on the basis of the network crime. Body, subjective aspect of crime, objective aspect of crime and object of crime are discussed. Part 4th studies the criminal legal countermeasures to prevent and control cybercrime. This part draws lessons from foreign countries. The legal system and judicial precedent for the prevention and control of cybercrime are analyzed in the light of the actual situation in China. The deficiency of the regulations on cybercrime in the current criminal law of our country, and the discussion from two aspects of criminal legislation and judicature. This paper puts forward the legal countermeasures to prevent and control cybercrime, and puts forward to perfect the prevention and control of cybercrime in our country. The tentative idea of criminal legislation and judicial countermeasures.
