【摘要】： 社區(qū)矯正制度是一種人道、高效、經(jīng)濟(jì)的罪犯處遇制度,被各國學(xué)者普遍認(rèn)為代表著犯罪矯正的未來走向。為此,社區(qū)矯正工作在世界各國全面展開,在歐美國家更是發(fā)展迅猛,己形成了一套完善的制度。我國是一個(gè)有著濃厚重刑主義傳統(tǒng)的國家,似乎“在重刑主義的氛圍下,只有徒刑才是刑罰�！盵1]目前,監(jiān)禁刑仍是我國刑罰體系的主體。雖然,經(jīng)過近幾年的理論探討與實(shí)踐摸索,我國也在加大社區(qū)矯正的工作力度,但總體發(fā)展水平仍比較低。在以人為本、構(gòu)建社會(huì)主義和諧社會(huì)、促進(jìn)中國和平崛起的大背景下,面對(duì)國際行刑領(lǐng)域,在具有監(jiān)禁刑無法比擬的巨大優(yōu)勢(shì)的社區(qū)矯正制度蓬勃發(fā)展的新形勢(shì)下,準(zhǔn)確地定位我國社區(qū)矯正的內(nèi)涵,把握我國社區(qū)矯正實(shí)踐中的突出問題,并有針對(duì)性地予以法律完善,無疑將對(duì)我國司法制度改革注入新鮮活力。在本文中,作者分別在我國社區(qū)矯正制度的內(nèi)涵、特點(diǎn)及意義、目前存在的不足與完善幾個(gè)方面對(duì)我國社區(qū)矯正制度進(jìn)行了分析闡述。
[Abstract]:The system of community correction is a humanitarian, efficient, economic criminal treatment system, scholars generally believe that the future direction of criminal rectification. Therefore, the work of community correction in the world in full swing, in Europe and the United States is developing rapidly, has formed a complete system of our country is a. There is a strong heavy doctrine of traditional country, seems to be in the severe punishment atmosphere, is the only prison penalty. "[1] at present, China is still the main imprisonment penalty system. Although, after discussion and practice in recent years, the theory of our country also increase the community correction work, but overall the development level is still relatively low. In people-oriented, building a socialist harmonious society, promote the background Chinese peaceful rise, in the face of the international field of execution, in a huge advantage can not be compared with the imprisonment of the community correction system to flourish Under the new situation of development, accurately positioning the connotation of community correction in China, grasp the prominent problems in the practice of community correction in China, and in the light of the legal perfection, will undoubtedly inject fresh vitality to the reform of the judicial system in China. In this paper, the author respectively in the connotation of community correction system in our country, the characteristics of and the significance, existing problems and improvement of several aspects of the analysis of China's community correction system.
