【摘要】： 自20世紀(jì)80年代初以來，隨著改革開放程度的不斷深入，我國經(jīng)濟(jì)取得了長足的發(fā)展，人民的生活水平普遍得到提高。但與此同時，分配不公、貧富懸殊、貪污腐化等社會不良現(xiàn)象也相繼出現(xiàn)。一些人心態(tài)失衡、道德淪喪、人性扭曲，致使我國物欲型犯罪急劇上升。在犯罪過程中，一些犯罪分子為聚集更大的犯罪能量，產(chǎn)生更大的犯罪效益，便糾合起來，組成犯罪組織，運用組織力量，實施各種犯罪，從此黑社會性質(zhì)組織犯罪在我國死灰復(fù)燃，并迅速得以滋生和蔓延。 黑社會性質(zhì)組織犯罪是一種原因復(fù)雜、具有嚴(yán)重危害性的犯罪。為了對黑社會性質(zhì)組織犯罪有一個更為深入的認(rèn)識，筆者搜集了30個典型案例，通過對這些案例的具體分析，并結(jié)合相關(guān)社會學(xué)方面的理論，總結(jié)、歸納出黑社會性質(zhì)組織犯罪的特征、形成原因及防范對策，為政府、司法機關(guān)防控這種犯罪提出自己的觀點、意見和建議。文章主體由三部分構(gòu)成： 一、黑社會性質(zhì)組織的特征。通過對案例的分析，筆者總結(jié)出黑社會性質(zhì)組織五個方面的特征，即結(jié)構(gòu)特征、成員特征、暴力性特征、獲利性特征及對國家公職人員的腐蝕性特征。其中獲利性特征是黑社會性質(zhì)組織的根本性和目的性特征；暴力性特征是黑社會性質(zhì)組織為達(dá)到控制一方、謀取暴利的手段性特征；對國家公職人員的腐蝕性則是黑社會性質(zhì)組織不斷發(fā)展壯大的不可缺少的外部性條件。 二、黑社會性質(zhì)組織犯罪產(chǎn)生的原因。黑社會性質(zhì)組織犯罪的產(chǎn)生有著深刻的社會背景，其原因是由多元性因素構(gòu)成的復(fù)雜系統(tǒng)。為此，本文從我國貧富差距的不斷分化，對外來人口的控制不力，基層組織建設(shè)滯后，對“兩勞”人員的教育管理缺位以及非法經(jīng)濟(jì)的大量出現(xiàn)等八個方面分析了黑社會性質(zhì)犯罪產(chǎn)生的原因。其中市場經(jīng)濟(jì)管理體制的不完善，腐敗現(xiàn)象日趨嚴(yán)重，，不良文化的泛濫是黑社會性質(zhì)組織犯罪產(chǎn)生的深層次原因。 三、黑社會性質(zhì)組織犯罪的防范對策。本章根據(jù)對黑社會性質(zhì)組織犯罪產(chǎn)生的原因分析，分別提出了不同的防控措施。并指出，對黑社會性質(zhì)組織犯罪的防控需要一種綜合性、長期性的策略，僅靠幾次“嚴(yán)打”運動是難以收到根本性的成效的。為此，我們必須做好長期應(yīng)對這種犯罪的準(zhǔn)備。
[Abstract]:Since the beginning of 1980s, with the deepening of reform and opening up, China's economy has achieved rapid development, people's living standards are generally improved. But at the same time, unfair distribution, the rich and the poor, corruption and degeneration and other negative phenomena in society have emerged. Some unbalance, moral decay, resulting in the distortion of human nature, material type of crime China's rise sharply. In the criminal process, some criminals to gather more crime energy, resulting in greater crime benefit, then gathered up, composed of criminal organizations, using organizational power, the implementation of all kinds of crimes, and the crime of the underworld organization in our country and the rapid growth and a stirring among the dry bones, can be spread.
The crime of the underworld organization is a kind of complex causes, with serious harm of crime. In order to have a more in-depth understanding of the crime of the underworld organization, the author collected 30 typical cases, through detailed analysis of these cases, combined with the related sociological theory, summarize, summed up the characteristics of the crime of the underworld organization, causes and preventive measures for the prevention and control of the government, the judicial organs of this crime and put forward its own views, opinions and suggestions. This paper consists of three parts:
A characteristic of the underworld organization. Through the analysis of cases, the author summarizes the characteristics of the five aspects of the underworld organization, namely the structure characteristics, member characteristics, violent characteristics, characteristics and profitability of public servants. The corrosive characteristics of the profitability of the characteristics is the fundamental purpose and characteristics of black social organization; violence is the underworld organization in order to control the party means of profiteering; corrosion of civil servants is the Mafia growing indispensable external conditions.
Two, because of the crime of the underworld organization. The crime of the underworld organization has profound social background, the reason is a complex system composed of multi factors. Therefore, this paper from the continuous differentiation of the gap between rich and poor, poor control of the foreign population, behind the building of grassroots organizations, the emergence of a large number of education the absence of management of "two labor personnel and illegal economic analysis of eight aspects of the causes of the crime of underworld generation. Three, countermeasures of the crime of the underworld organization. This chapter according to the causes of the crime of underworld organization analysis, proposed different control measures. And that requires a comprehensive prevention and control of organized crime syndicate, long-term strategy, relying on several "strike hard" campaign is difficult receive the fundamental results. Therefore, we must make long-term response of this crime.
