【摘要】：【研究背景及目的】 醫(yī)療事故技術(shù)鑒定結(jié)論直接關(guān)系到產(chǎn)生糾紛的醫(yī)患雙方的切身利益，又因其是否客觀公正常受到質(zhì)疑。2002年我國(guó)頒布實(shí)施的《醫(yī)療事故處理?xiàng)l例》規(guī)定由醫(yī)學(xué)會(huì)取代原醫(yī)療事故技術(shù)鑒定委員會(huì)進(jìn)行醫(yī)療事故技術(shù)鑒定，，目前已經(jīng)實(shí)踐了將近四年。本研究采用統(tǒng)計(jì)推斷和Logistic回歸分析的方法分別評(píng)估醫(yī)療事故技術(shù)鑒定改革的成效并探索與省級(jí)醫(yī)療事故技術(shù)鑒定結(jié)論相關(guān)的因素以及分析引起醫(yī)療事故爭(zhēng)議的醫(yī)療行為構(gòu)成及分布規(guī)律。 【方法】應(yīng)用橫斷面研究的方法對(duì)2002年9月～2005年8月四川省醫(yī)療事故技術(shù)鑒定辦公室組織的304例鑒定案例進(jìn)行回顧性調(diào)查。 【結(jié)果】(1)改革后的醫(yī)療事故技術(shù)鑒定組織市醫(yī)學(xué)會(huì)鑒定醫(yī)療事故的比例高于市鑒定委員會(huì)；(2)省級(jí)醫(yī)療事故技術(shù)鑒定結(jié)論與首次鑒定情況、醫(yī)院級(jí)別、醫(yī)務(wù)人員職稱、鑒定專家爭(zhēng)議和中止鑒定程序(主要是因?yàn)榛挤揭髮?duì)病歷真?zhèn)涡赃M(jìn)行鑒定，占54.54％)相關(guān)。與無首次鑒定相比，首次鑒定為醫(yī)療事故后再次鑒定為醫(yī)療事故的概率明顯增加；鑒定專家組專家對(duì)鑒定結(jié)論存在爭(zhēng)議使鑒定為醫(yī)療事故的概率增加；隨著醫(yī)院級(jí)別和醫(yī)務(wù)人員職稱的提高，被鑒定為醫(yī)療事故的概率降低；患方因提出對(duì)爭(zhēng)議病歷進(jìn)行真?zhèn)涡澡b定要求中止醫(yī)療事故鑒定程序，被鑒定為醫(yī)療事故的概率降低；(3)在構(gòu)成醫(yī)療事故的醫(yī)療過失行為中，以醫(yī)療技術(shù)方面的過失為
[Abstract]:[background and objective] the conclusion of technical identification of medical malpractice is directly related to the vital interests of both doctors and patients who have disputes. In 2002, the Regulation on the handling of Medical Accidents issued and implemented in China stipulated that the Medical Association should replace the original Medical accident Technical Appraisal Committee for the technical identification of medical accidents. At present, it has been practiced for nearly four years. In this study, statistical inference and Logistic regression analysis were used to evaluate the effectiveness of the technical identification reform of medical malpractice and to explore the factors related to the conclusion of technical identification of medical malpractice at the provincial level. This paper analyzes the constitution and distribution law of medical behavior which causes medical malpractice dispute. [methods] A retrospective investigation was conducted on 304 cases of medical malpractice technical identification organized by Sichuan Medical accident Technical Appraisal Office from September 2002 to August 2005 by cross-sectional study. [results] 1) the proportion of medical malpractice identified by the Municipal Medical Association was higher than that by the Municipal Medical Association after the reform. The dispute between experts and the suspension of the identification procedure (mainly because the patient requested to identify the authenticity of the medical record, accounting for 54.54) is related. Compared with the absence of the first identification, the probability of the first identification as a medical accident is obviously increased after re-identification as a medical accident; The probability of identification as medical malpractice is increased because of the dispute among experts of expert group, and the probability of being identified as medical accident decreases with the improvement of hospital level and professional title of medical personnel. Due to the request of the patient to suspend the medical malpractice identification procedure, the probability of being identified as a medical malpractice is reduced.) in the medical negligence that constitutes a medical malpractice, the medical technical fault is regarded as the fault of the medical treatment.
