【摘要】： 近年來，有組織犯罪活動(dòng)在全世界范圍內(nèi)日益猖獗，嚴(yán)重威脅各國的政治、經(jīng)濟(jì)生活，，引起各國人民的重視，也引發(fā)了理論界對(duì)有組織犯罪問題的重視和廣泛研究。本文從經(jīng)濟(jì)視角出發(fā)，著重關(guān)注有組織犯罪與經(jīng)濟(jì)利益的密切關(guān)系，并以此為基點(diǎn)探求有組織犯罪的發(fā)展特點(diǎn)和相應(yīng)對(duì)策。本文分為四個(gè)大部分的內(nèi)容，其中第二、三部分是文章的主體。第一部分是引言，簡述研究有組織犯罪及其與經(jīng)濟(jì)利益關(guān)系的重要意義；第二部分著重探討有組織犯罪與經(jīng)濟(jì)利益之間的關(guān)系，從歷史起源、組織基礎(chǔ)和現(xiàn)實(shí)作用三個(gè)方面探究經(jīng)濟(jì)因素對(duì)有組織犯罪的產(chǎn)生和發(fā)展所具有的重要意義，繼而對(duì)二者之間的基本關(guān)系加以概括，認(rèn)為經(jīng)濟(jì)利益是有組織犯罪產(chǎn)生的重要?jiǎng)右�，是有組織犯罪活動(dòng)的基本目標(biāo)，是有組織犯罪生存和發(fā)展的基本條件；第三部分從有組織犯罪與經(jīng)濟(jì)利益關(guān)系的角度出發(fā)，探討有組織犯罪經(jīng)濟(jì)利益的來源、有組織犯罪經(jīng)濟(jì)上的特點(diǎn)、發(fā)展現(xiàn)狀以及相應(yīng)對(duì)策等問題，認(rèn)為犯罪組織通過提供非法商品和服務(wù)、有組織地進(jìn)行傳統(tǒng)財(cái)產(chǎn)犯罪活動(dòng)以及進(jìn)行非法行業(yè)壟斷和敲詐勒索及洗錢、向合法經(jīng)濟(jì)滲透等活動(dòng)賺取經(jīng)濟(jì)利益，并有從合法市場和犯罪市場獲利，追求非法利潤的最大化，非法活動(dòng)與合法活動(dòng)相結(jié)合及以高度有組織化保證高額利潤的實(shí)現(xiàn)四個(gè)方面的特點(diǎn)，并以此為基礎(chǔ)提出相應(yīng)的對(duì)策；第四部分是結(jié)語，提出應(yīng)當(dāng)對(duì)我國的有組織犯罪問題予以更多的關(guān)注，并對(duì)全文內(nèi)容進(jìn)行總括。
[Abstract]:In recent years, organized crime is rampant in the world, a serious threat to national political, economic life, aroused people's attention, but also led to the theory of attention and extensive research of organized crime problems. From the economic perspective, mainly close close relationship between note organized crime and economic interests and as the basic characteristics of development, explore the organized crime and the corresponding countermeasures. This paper is divided into four parts, the second, third part is the main body of the article. The first part is the introduction, describes the research significance of organized crime and its relationship with economic interests; the second part focuses on the relationship between organized crime and economic interests from the historical origin, significance of the three aspects of organization basis and practical exploring the role of economic factors of the emergence and development of organized crime, and then on the two The basic relationship between the economic interests is summarized, that is an important cause of organizational crimes, is a basic goal of organized crime, organized crime is the basic conditions for survival and development; the third part starting from the relationship between organized crime and economic interests, to explore the source of organized crime economic interest. Has the characteristics of organized crime and economic development as well as the corresponding countermeasures, that criminal organizations by providing illegal goods and services are organized to traditional property crimes and illegal monopoly and to the legal and blackmail and impose exactions on money laundering, economic penetration and other activities to earn economic benefits, and profit from the legal market and criminal Market. To maximize the illegal profits, illegal activities and legal activities combined with highly organized and ensure the four aspects of the specific implementation of high profits On the basis of it, we put forward the corresponding countermeasures. The fourth part is the conclusion, and put forward that we should pay more attention to the organized crime in China, and summarize the contents of the full text.
