【摘要】： 20世紀(jì)90年代以來(lái)，貪污賄賂犯罪已成為全世界關(guān)注的焦點(diǎn)問(wèn)題，以貪污賄賂犯罪為主要形式的腐敗行為更是成了各國(guó)政府最大的敵人。我國(guó)政府一貫重視同貪污賄賂犯罪作斗爭(zhēng)，并取得了一定成效。但是，各種數(shù)據(jù)表明，近年來(lái)我國(guó)貪污賄賂犯罪總的來(lái)說(shuō)仍然呈現(xiàn)出持續(xù)增長(zhǎng)的趨勢(shì)，作為衡量貪污賄賂犯罪嚴(yán)重程度標(biāo)準(zhǔn)的重要指數(shù)即大案數(shù)量總體上也呈現(xiàn)出逐年上升的趨勢(shì)。貪污賄賂犯罪的高發(fā)，極大地?fù)p害著社會(huì)正義，破壞著經(jīng)濟(jì)發(fā)展，腐蝕著政治清明，動(dòng)搖著黨和政府在人民群眾心目中的威望，因此，研究貪污賄賂犯罪、找到切實(shí)有效的預(yù)防及控制手段仍然是十分重要而且十分必要的課題。本文堅(jiān)持辯證唯物主義的觀點(diǎn)和方法，以科學(xué)求實(shí)的態(tài)度，通過(guò)對(duì)河南省駐馬店市檢察機(jī)關(guān)2006年查辦的貪污賄賂犯罪全部案件進(jìn)行深入的調(diào)查和研究，整理分析了該市當(dāng)年貪污賄賂犯罪的現(xiàn)狀、特點(diǎn)以及成因，有針對(duì)性地提出了預(yù)防和控制貪污賄賂犯罪的對(duì)策。 全文共分三個(gè)部分。第一部分：2006年駐馬店市貪污賄賂犯罪現(xiàn)狀分析。為了解駐馬店市貪污賄賂犯罪的成因、特點(diǎn)，以探求預(yù)防和控制此類案件頻繁發(fā)生的有效措施，根據(jù)駐馬店市檢察機(jī)關(guān)反貪部門提供的資料，對(duì)該市2006年貪污賄賂案件從犯罪性質(zhì)、涉案金額、犯罪主體、犯罪形式、發(fā)案領(lǐng)域、作案手段等方面入手，深入分析了當(dāng)年該市貪污賄賂犯罪呈現(xiàn)出來(lái)的主要特點(diǎn)。 第二部分：駐馬店市貪污賄賂犯罪的成因。為探究預(yù)防和控制貪污賄賂犯罪的有效途徑，在上述調(diào)查研究的基礎(chǔ)上，結(jié)合本地區(qū)的實(shí)際情況，從思想、經(jīng)濟(jì)、制度以及執(zhí)法力度等方面分析了貪污賄賂犯罪的成因。 第三部分：貪污賄賂犯罪的預(yù)防和控制。通過(guò)前兩部分對(duì)駐馬店市貪污賄賂犯罪特點(diǎn)及其成因的分析總結(jié)，結(jié)合刑法學(xué)界對(duì)貪污賄賂犯罪在預(yù)防和控制領(lǐng)域已經(jīng)取得的研究成果，有針對(duì)性地提出了幾點(diǎn)預(yù)防和控制貪污賄賂犯罪的方法和途徑。一、加強(qiáng)思想道德教育，消除犯罪內(nèi)因；二、積極推進(jìn)公務(wù)員制度改革，建立公務(wù)員行為規(guī)范；三、完善各種規(guī)章制度，堵塞導(dǎo)致貪污賄賂犯罪發(fā)生的漏洞；四、推行政務(wù)信息公開(kāi)制度，加強(qiáng)輿論監(jiān)督；五、完善刑法規(guī)范，，嚴(yán)格執(zhí)法，加強(qiáng)對(duì)貪污賄賂犯罪的打擊。
[Abstract]:Since 1990s, the crime of corruption and bribery has become the focus of attention all over the world. Corruption in the form of corruption and bribery as the main form has become the greatest enemy of the governments of all countries. Our government has always attached importance to fighting corruption and bribery, and has achieved certain results. However, various data show that, In recent years, the crime of corruption and bribery in our country has, on the whole, shown a trend of continuous growth. As an important index to measure the severity of corruption and bribery crimes, that is, the number of major cases also shows a trend of increasing year by year. The high incidence of corruption and bribery crimes greatly damages social justice and undermines economic development. Eroding political Pure Brightness and shaking the prestige of the party and the government in the eyes of the masses of the people.Therefore, to study the crime of corruption and bribery, It is still very important and necessary to find effective means of prevention and control. This paper insists on the viewpoint and method of dialectical materialism and takes a scientific and realistic attitude. Through the thorough investigation and study of all the cases of corruption and bribery investigated by the procuratorial organs of Zhumadian City in Henan Province in 2006, this paper collates and analyzes the current situation, characteristics and causes of corruption and bribery crimes in Zhumadian City, Henan Province. The countermeasures to prevent and control the crime of corruption and bribery are put forward. In order to understand the causes and characteristics of corruption and bribery crimes in Zhumadian City in 2006, it is necessary to explore effective measures to prevent and control such cases. According to the information provided by the anti-corruption department of the procuratorial organ of Zhumadian, the corruption and bribery cases in the city on 2006 were started from the aspects of the nature of the crime, the amount involved in the case, the subject of the crime, the form of the crime, the field of the crime, the means of committing the crime, The main characteristics of corruption and bribery crime in the city were analyzed in depth. Part II: the causes of corruption and bribery crime in Zhumadian. In order to explore the effective ways to prevent and control corruption and bribery crimes, on the basis of the above investigation and research, combined with the actual situation in the region, from the thinking, economic, This paper analyzes the causes of corruption and bribery in the aspects of system and law enforcement. The third part: the prevention and control of the crime of corruption and bribery. Through the first two parts of the crime of corruption and bribery in Zhumadian City and its causes of analysis and summary, Based on the research results of the crime of corruption and bribery in the field of prevention and control, this paper puts forward some methods and ways to prevent and control the crime of corruption and bribery. First, we should strengthen the ideological and moral education and eliminate the internal causes of the crime; Second, actively promote the reform of the civil service system and establish a code of conduct for civil servants; third, improve various rules and regulations to plug the loopholes that lead to the crime of corruption and bribery; fourth, implement the system of open government information and strengthen supervision by public opinion; fifth, Improve criminal law norms, strictly enforce the law, and strengthen the fight against corruption and bribery.
