論行政指導(dǎo)在治安管理中的運用

【摘要】: 在我國加快建設(shè)社會主義市場經(jīng)濟和民主政治,努力構(gòu)建和諧社會的大背景下,公安機關(guān)作為集民主與專政兩項職能與一體的公共管理與公共服務(wù)機關(guān),單純依靠強制性管理手段開展治安管理,已無法適應(yīng)社會發(fā)展的需要。面對人民群眾權(quán)利意識的覺醒以及日益嚴峻的治安形勢,在治安管理中逐漸增加科學(xué)、民主和公正因素,已成為一種巨大的社會需求。行政指導(dǎo)作為一種新型的柔性管理方式,自20世紀(jì)30年代在日本產(chǎn)生以來,因其具有的非強制性、靈活性等特點,日益受到發(fā)達市場經(jīng)濟國家的關(guān)注和重視,并越來越廣泛地將其運用于經(jīng)濟與社會管理過程中,起著補充和替代、輔導(dǎo)和促進、協(xié)調(diào)和疏通、預(yù)防和抑制等多方面的積極作用,收到明顯的成效。 本文認為,公安機關(guān)在治安管理工作中,不僅應(yīng)依法運用法律賦予的行政許可、處罰、強制、檢查等強制性管理手段,加強對社會治安的管控,而且還應(yīng)借鑒吸收發(fā)達國家的經(jīng)驗做法,在依法行政的原則下,充分運用建議、鼓勵、教育、引導(dǎo)、勸阻和協(xié)商等非強制性的行政指導(dǎo)方式,發(fā)揮其柔性管理手段的功效,配合傳統(tǒng)的剛性管理手段,積極爭取行政相對人的支持與配合,及時消除各類不安定因素和治安隱患,依法保護人民群眾的民主權(quán)利和合法權(quán)益,維護良好的社會治安秩序,為社會主義市場經(jīng)濟保駕護航。 本文首先從公安機關(guān)參與構(gòu)建和諧社會、平衡公安機關(guān)行政權(quán)力與公民權(quán)利、公安機關(guān)角色定位演變發(fā)展、解決治安管理突出問題以及借鑒國外成功經(jīng)驗的需要五個方面論證了在治安管理中運用行政指導(dǎo)的必要性,并結(jié)合公安機關(guān)的行政理念和我國民眾的文化心理傳統(tǒng),論證了運用行政指導(dǎo)的可行性。同時,指出行政指導(dǎo)的有效運用離不開正確的定位。公安機關(guān)必須堅持在依法行政原則的指導(dǎo)下,正確處理好公安機關(guān)的權(quán)力性與行政指導(dǎo)的非強制性之間的關(guān)系,擺正行政指導(dǎo)在諸多治安管理手段中的位置,,揚長避短,剛?cè)岵拍苁剐姓笇?dǎo)在治安管理工作中充分發(fā)揮功效。 在此基礎(chǔ)上,本文結(jié)合行政指導(dǎo)的功能和治安管理工作的實際情況,論證了行政指導(dǎo)在治安管理中的若干制度構(gòu)建。指出應(yīng)建立健全治安管理告知、治安防范提示、治安建議書、治安管理激勵和治安管理示范等工作制度,使行政指導(dǎo)真正融入到日常治安管理工作之中,成為具體的、操作性強的工作制度,并轉(zhuǎn)化為實實在在的工作成效。 最后,本文還指出,行政指導(dǎo)作為一種新型的行政行為方式,在我國行政理論和實務(wù)界尚屬新生事物,對行政指導(dǎo)的行為性質(zhì)、具體形式、程序規(guī)制以及救濟方式等方面尚未形成統(tǒng)一權(quán)威的認識,公安機關(guān)對行政指導(dǎo)的了解、認同程度還不高,警員的專業(yè)知識和理論素養(yǎng)還不能適應(yīng)行政指導(dǎo)的要求。要使行政指導(dǎo)成為一種較規(guī)范的行政行為方式,被公安機關(guān)真正認可與廣泛接受,并有效運用于治安管理實踐,取得預(yù)期的效果,還有待理論與實務(wù)界進一步的不懈努力。
[Abstract]:China has accelerated the construction of socialist market economy and democratic politics, and strive to build a harmonious society background, the public security organs as a set of two functions of democracy and dictatorship and the development of public management and public service agencies, relying solely on the mandatory management measures to carry out security management, has been unable to meet the needs of social development. In the face of people's right consciousness the awakening and the increasingly grim security situation, security management gradually increase science, democracy and justice, has become a huge social needs. Administrative guidance as a new way of flexible pipe, since 1930s in Japan, because of its non mandatory, flexibility, increasingly developed market the national economic interest and attention, and more and more widely used in the economic and social management process, plays a complementary and alternative, counseling and promotion Progress, coordination and dredging, the active role of prevention and suppression, and so on, have received obvious results.
This paper argues that the public security organs in the management of public security work, not only should be in accordance with the law by the administrative license law, punishment, compulsory examination means, mandatory management, strengthen the social security management, but also should learn from experience and practice in developed countries, under the principle of administration according to law, make full use of advice, encouragement, education, guidance, administrative guidance and negotiation way to discourage non mandatory, its flexible management effect, with the traditional rigid management means, actively seek the support and cooperation of the administrative relative person, to eliminate all kinds of unstable factors and security risks, according to the law to protect people's democratic rights and legitimate rights and interests, maintain good society the order of the socialist market economy, to escort.
This paper from the public security organs involved in the construction of harmonious society, the balance of the public security organs of administrative power and civil rights, the public security organs role development, solve the problems of public security management and the successful experience from abroad to five aspects to prove the necessity of the use of administrative guidance in security management, and combining with the traditional cultural psychology of the public security organs of the administrative idea and the people of our country, demonstrates the feasibility of the use of administrative guidance. At the same time, pointed out that the effective use of administrative guidance cannot do without the correct localization. The public security organs must adhere to the principles of administrative law under the guidance of the relationship between non coercive power and correctly handle the administrative guidance of public security organs, position, straighten out the administrative guidance in many public security management means the weaknesses, firmness and flexibility, can make the full effect of administrative guidance in public security administration work.
On this basis, combining with the actual situation of administrative guidance function and security management, to construct the system of administrative guidance in security management. It is pointed out that should establish and improve the management of public security informed, public security tips, security proposal, security management and security management demonstration work incentive system, make administrative guidance into the daily real the security management work, be specific, practical work system, and transformed into real work.
Finally, this paper points out that the administrative guidance as a new type of administrative behavior, is still a new thing in our country's administrative theory and practice of administrative guidance, behavior, and specific forms of Procedural Regulation and the relief methods have not yet formed a unified understanding of the authority of the public security organs in the administrative guidance, the degree of recognition is not high, the police professional knowledge and theoretical knowledge can not meet the requirements. To make the administrative guidance, administrative guidance has become a relatively standardized administrative behavior, the public security organs to be truly recognized and widely accepted, and is effective for the practice of public security administration, to achieve the desired effect, and the theory and practice further to make unremitting efforts.
