人身?yè)p害賠償訴訟中司法鑒定調(diào)查分析

【摘要】:2005年10月1日,《全國(guó)人民代表大會(huì)常務(wù)委員會(huì)關(guān)于司法鑒定管理問(wèn)題的決定》施行,司法鑒定職責(zé)最終歸位于社會(huì)鑒定機(jī)構(gòu),這是司法改革的一項(xiàng)里程碑式進(jìn)步。制度運(yùn)行至今逾六年,其積極作用勿容置疑,但在人身?yè)p害賠償訴訟方面,暴露出許多缺陷,使得司法鑒定成為訴訟焦點(diǎn)、難點(diǎn)和怨點(diǎn),偏離了程序的正常價(jià)值軌道。本文以臺(tái)州市椒江區(qū)人民法院近三年民事審判數(shù)據(jù)、案例為調(diào)研對(duì)象,分析人身?yè)p害賠償訴訟中當(dāng)事人在司法鑒定程序上的耗時(shí)、耗費(fèi)及鑒定價(jià)值等,查找程序缺陷,探究原因,提出完善制度的若干構(gòu)想。 本文先通過(guò)統(tǒng)計(jì)分析方式,分析椒江法院人身?yè)p害賠償案件審理中司法鑒定程序存在的弊端,再?gòu)狞c(diǎn)到面,運(yùn)用實(shí)證分析法,剖析我國(guó)現(xiàn)行人身?yè)p害司法鑒定制度在立法層面的缺陷和司法實(shí)踐中存在的問(wèn)題,提出解決方案。文章主體分四大部分。 第一章是對(duì)椒江法院人身?yè)p害司法鑒定情況的調(diào)查。調(diào)查科目設(shè)置為司法鑒定案件占比、個(gè)案鑒定時(shí)間、鑒定費(fèi)用和鑒定認(rèn)定的不合理醫(yī)療費(fèi)用情況,調(diào)查數(shù)據(jù)采取列表方式比較分析,數(shù)據(jù)顯示,在人身?yè)p害賠償訴訟中,當(dāng)前的司法鑒定程序于效益于公正均有著明顯的阻滯作用,折射出的問(wèn)題有司法鑒定使用過(guò)度、鑒定占時(shí)過(guò)長(zhǎng)、鑒定費(fèi)支出過(guò)多、經(jīng)鑒定認(rèn)定為不合理的醫(yī)療費(fèi)過(guò)多等等。 第二章我國(guó)人身?yè)p害司法鑒定制度沿革。介紹我國(guó)人身?yè)p害司法鑒定制度經(jīng)歷職能部門多頭管理階段、混合管理階段和統(tǒng)一管理階段三個(gè)階段,現(xiàn)狀是愈發(fā)出現(xiàn)鑒定啟動(dòng)無(wú)序、鑒定實(shí)施費(fèi)時(shí)、鑒定費(fèi)用居高、鑒定公信力衰減、鑒定過(guò)度及鑒定質(zhì)證、認(rèn)證困難等問(wèn)題。 第三章我國(guó)人身?yè)p害司法鑒定制度的缺陷及原因。從立法層面分析《決定》存在的缺陷:沒(méi)有對(duì)司法鑒定啟動(dòng)制度作出規(guī)定、鑒定人出庭作證規(guī)定過(guò)于簡(jiǎn)單、沒(méi)有建立統(tǒng)一的司法鑒定標(biāo)準(zhǔn)、對(duì)鑒定人權(quán)利重視不夠、鑒定結(jié)論的認(rèn)證規(guī)定不夠具體;再?gòu)乃痉▽?shí)踐層面實(shí)證分析存在的問(wèn)題,包括司法鑒定管理仍處于無(wú)序局面、司法鑒定的啟動(dòng)程序操作不規(guī)范、重復(fù)鑒定、多頭鑒定問(wèn)題突出、司法鑒定從業(yè)人員良莠不齊、鑒定機(jī)構(gòu)的收費(fèi)無(wú)統(tǒng)一標(biāo)準(zhǔn)、鑒定人出庭率極低等。上述問(wèn)題產(chǎn)生的原因分析認(rèn)為有以下四項(xiàng),即立法不夠完善、鑒定人和法官的惰性和懈怠、鑒定人鑒定機(jī)構(gòu)及當(dāng)事人趨利、鑒定人受人情左右等。 第四章完善人身?yè)p害司法鑒定制度的構(gòu)想。作者對(duì)兩大法系的民事司法鑒定制度進(jìn)行了比較,啟示是我們?cè)诮梃b、移植的時(shí)候,沒(méi)有全面、系統(tǒng)地分析研究如何完善自身法律體系,致使相關(guān)制度不配套,理念和具體規(guī)定脫節(jié)。提出重構(gòu)人身?yè)p害司法鑒定制度的價(jià)值取向,在此基礎(chǔ)上大膽地提出完善我國(guó)人身?yè)p害司法鑒定制度的八大設(shè)想,內(nèi)容是制定專門統(tǒng)一的司法鑒定法律、規(guī)范管理鑒定機(jī)構(gòu)和鑒定人、完善鑒定人出庭質(zhì)證制度、、嚴(yán)格啟動(dòng)復(fù)核或重新鑒定程序、規(guī)范司法鑒定收費(fèi)標(biāo)準(zhǔn)、完善認(rèn)證規(guī)則、實(shí)行鑒定過(guò)錯(cuò)責(zé)任追究和保障制度及實(shí)行綜合治理,停止醫(yī)療費(fèi)用、誤工時(shí)間合理性的鑒定項(xiàng)目。
[Abstract]:In October 1, 2005, < > decision of the National People's Congress Standing Committee on the management of judicial authentication, judicial identification responsibility is ultimately returned to the social appraisal institutions, this is a milepost type progress in judicial reform. The system has been running for more than six years, its positive role undoubtedly, but in the personal injury compensation lawsuit, exposure a lot of defects, the judicial identification has become the focus of litigation, difficulty and resentment, deviate from the normal values of track program. This paper takes Taizhou District of Jiaojiang City People's court for nearly three years of civil trial data, the case as the research object, analysis of personal injury compensation lawsuit parties in judicial authentication procedure on time, cost and identification value, find the procedure defects and explore the reasons, put forward some ideas to improve the system.
In this paper, through statistical analysis, the existing problems of the Jiaojiang court hearing the case of personal injury compensation in the judicial authentication procedure, then from the point to the surface, by using empirical analysis method, analysis of our current personal injury judicial identification system exists in the legislation defects and problems in the judicial practice, put forward the main solutions. Divided into four parts.
The first chapter is the investigation of the Jiaojiang court of personal injury judicial identification case. Investigation subjects set to judicial identification case accounting, case identification time, unreasonable medical expenses that appraisal fees and identification, take a list of survey data comparison, data show that in the litigation for compensation of personal injury, the current judicial authentication procedure the benefits for a fair and have obvious retarding effects, reflecting the problems of forensic identification for the use of excessive, too long, the appraisal fee paid too much, identified as unreasonable medical cost too much.
The second chapter of our personal injury judicial identification system. Introduce our personal injury judicial identification institution has experienced long management stage, mixed management and unified management of the three stage, the status quo is increasingly appeared identification of disorder, identification of the implementation time, the high cost of identification, identification of the credibility of identification and identification of excessive attenuation. Cross examination, authentication problems.
The defect and reason of the third chapter of our personal injury judicial identification system. Analysis of defects existing > < decision from the legislative level: no provision for starting system of judicial identification, expert testimony provisions are too simple, without the establishment of judicial appraisal standard, do not pay enough attention to the identification of human rights, the conclusion of identification certification provisions is not enough concrete; then analyzes the existing problems from the level of judicial practice including empirical, judicial appraisal management is still in the disordered situation, judicial identification startup operation is not standardized, repeat identification, multiple identification problems, our method of identification of practitioners uneven in quality the charge of Identification Organization, no unified standard, appraiser rate is extremely low. The reason for these problems the analysis considers the following four items, namely, the legislation is not perfect, the identification and judges of the inert and slack, authenticators institutions and parties benefit, discrimination A person is affected by human feelings.
The fourth chapter perfecting personal injury judicial system. The author makes a comparison of civil judicial appraisal system of the two legal systems, we draw inspiration, transplant, there is no comprehensive and systematic analysis on how to improve its legal system, the system is not complete, from the concept and the specific stipulation. The value orientation is put forward the reconstruction of personal injury judicial identification system, on the basis of boldly put forward eight strategies to improve our personal injury judicial system and judicial identification of special legal content is developed and unified, standardized management of forensic institutions and experts, to improve the examination system, appraiser, strict start review or re identification procedures, specifications the judicial authentication fees, improve the certification rules, the identification of fault responsibility and security system and implement the comprehensive management of medical expenses, stop time, error of rationality Identify the project.
