【摘要】： 隨著網(wǎng)絡(luò)的普及和應(yīng)用,整個社會已經(jīng)進(jìn)入了一個信息化的社會,信息技術(shù)的發(fā)展極大地改變了人們傳統(tǒng)的工作、交流、消費方式,甚至影響到人類社會的模式。由于金融業(yè)在計算機的普及應(yīng)用中居于各行業(yè)之首,金融業(yè)務(wù)的處理越來越依賴于計算機和網(wǎng)絡(luò),金融的機密和財富也越來越集中于計算機和網(wǎng)絡(luò),網(wǎng)絡(luò)金融的模式已逐步形成。網(wǎng)絡(luò)在改變傳統(tǒng)的金融運行模式的同時,也引發(fā)了網(wǎng)絡(luò)金融犯罪。目前,我國金融業(yè)網(wǎng)絡(luò)犯罪無論在規(guī)模還是在種類上都在擴張。因此,認(rèn)真研究、防范和打擊金融領(lǐng)域內(nèi)的網(wǎng)絡(luò)犯罪、探討其中的法律規(guī)范問題便成為防止金融犯罪極其重要的一個方面。1 本論文在分析了我國的網(wǎng)絡(luò)金融的概念、特征之后,結(jié)合我國刑法學(xué)及犯罪學(xué)的理論,研究了我國網(wǎng)絡(luò)金融犯罪的概念、犯罪構(gòu)成及表現(xiàn)形式,從網(wǎng)絡(luò)金融犯罪產(chǎn)生的社會背景分析、網(wǎng)絡(luò)金融犯罪的客體分析、犯罪成本分析、金融管理角度分析及法治建設(shè)分析五個方面,探討了我國網(wǎng)絡(luò)金融犯罪的成因,并主要從打擊、防治網(wǎng)絡(luò)金融犯罪的法律和網(wǎng)絡(luò)技術(shù)兩個層面上提出了相應(yīng)的對策,以期有益于我國網(wǎng)絡(luò)金融的實踐,有利于我國金融業(yè)在網(wǎng)絡(luò)時代的健康發(fā)展。
[Abstract]:With the popularization and application of the network, the whole society has entered an information-based society. The development of information technology has greatly changed people's traditional work, communication, and consumption mode. It even affects the mode of human society. Because the financial industry is the first in the application of computers, the processing of financial business is more and more dependent on computers and networks. Financial secrets and wealth are increasingly concentrated in computers and networks, and the model of network finance has been gradually formed. While the network has changed the traditional mode of financial operation, it has also led to network financial crimes. At present, The scale and type of cybercrime in China's financial industry are expanding. Therefore, it is necessary to seriously study, prevent and crack down on cybercrime in the financial field. The discussion of legal norms has become one of the most important aspects of the prevention of financial crime.1. After analyzing the concept and characteristics of the network finance in our country, this paper studies the concept, the constitution and the manifestation of the crime of the network finance in our country in combination with the theory of criminal law and criminology. From five aspects: social background analysis, object analysis, crime cost analysis, financial management analysis and rule of law analysis, this paper discusses the causes of network financial crime in China. The corresponding countermeasures are put forward mainly from the aspects of law and network technology of attacking, preventing and controlling network financial crimes, in order to benefit the practice of network finance in our country and the healthy development of our financial industry in the network age.
