【摘要】： 近年來，但凡涉足勞動教養(yǎng)理論研究或從事勞動教養(yǎng)實(shí)際工作的同志，都會面對這樣一個不爭的事實(shí)，這就是，勞教立法的嚴(yán)重滯后和現(xiàn)有法律、法規(guī)的不完善而引發(fā)的困惑與尷尬。特別是隨著《刑法》的修訂完善和《立法法》、《行政處罰法》的頒布實(shí)施，勞動教養(yǎng)的存廢之爭一度也有愈演愈烈之勢�？墒侨绻麖睦碚摵蛯�(shí)踐兩個方面稍加觀察就會發(fā)現(xiàn)，雖然勞動教養(yǎng)的名稱有可能作些調(diào)整，勞動教養(yǎng)的決定程序和執(zhí)行方式有必要不斷完善(事實(shí)上創(chuàng)辦勞教特色的工作近年來未曾停止)，，但是從根本上廢除勞動教養(yǎng)制度的時機(jī)尚不成熟。因此，從勞教工作的實(shí)際出發(fā)，踏踏實(shí)實(shí)地尋求勞動教養(yǎng)制度改革的正確途徑和有效措施，對于完善我國的治安與法制建設(shè)，加強(qiáng)人權(quán)保障，構(gòu)建社會主義和諧社會，具有非常重要的現(xiàn)實(shí)意義。本文作者從社會主義法治理念的角度，對現(xiàn)行的勞動教養(yǎng)法律制度在保證公民權(quán)利、維護(hù)社會穩(wěn)定、與現(xiàn)行法律法規(guī)的沖突和實(shí)踐執(zhí)行中存在著嚴(yán)重的弊端等不足之處進(jìn)行分析，提出對未來勞動教養(yǎng)法律制度改革的一套模式。
[Abstract]:In recent years, any comrades who have set foot in the theoretical research of re-education through labor or engaged in the practical work of re-education through labour will face the indisputable fact that the legislation of re-education through labour is seriously lagging behind and the existing laws. The confusion and embarrassment caused by the imperfection of laws and regulations, especially with the revision and perfection of the Criminal Law and the promulgation and implementation of the Administrative punishment Law. The debate on the existence and abolition of re-education through labor was once intensified, but if we observe it from both theory and practice, we can find that the name of reeducation through labor may be adjusted. It is necessary to improve the decision procedure and execution mode of reeducation through labor (in fact, the work of establishing the characteristics of reeducation through labour has not stopped in recent years, but the time to abolish the system of reeducation through labour is not ripe. Starting from the reality of reeducation through labor, we should seek the correct ways and effective measures to reform the system of re-education through labor, which will improve the public order and legal system construction, strengthen the protection of human rights, and build a harmonious socialist society. From the point of view of the concept of socialist rule of law, the author of the current legal system of re-education through labor to ensure the rights of citizens and maintain social stability. Based on the analysis of the conflict with the current laws and regulations and the serious shortcomings in the practice, this paper puts forward a set of models for the reform of the legal system of reeducation through labor in the future.
