【摘要】： 隨著計(jì)算機(jī)和網(wǎng)絡(luò)技術(shù)的蓬勃發(fā)展，網(wǎng)絡(luò)時(shí)代來(lái)臨了。網(wǎng)絡(luò)的影響不斷擴(kuò)大，已成為我們不可或缺的工具。中國(guó)的網(wǎng)民也日益增多，其中青少年占很大的比例，是我國(guó)網(wǎng)民的主力軍。網(wǎng)絡(luò)對(duì)青少年影響巨大，有正面的也有負(fù)面的，其中負(fù)面的影響日益引人注目。網(wǎng)絡(luò)已經(jīng)成為新時(shí)期青少年犯罪的一個(gè)重要誘因，表現(xiàn)在：與網(wǎng)絡(luò)有關(guān)的青少年犯罪層出不窮，不僅嚴(yán)重危害社會(huì)治安和社會(huì)秩序，也給青少年自身和家庭帶來(lái)極大的不幸和災(zāi)難，已成為一個(gè)迫切需要解決的重大問(wèn)題。所以，本文旨在分析網(wǎng)絡(luò)與青少年犯罪的關(guān)系以及與網(wǎng)絡(luò)有關(guān)的青少年犯罪的表現(xiàn)類型，，并在此基礎(chǔ)上積極探索、努力研究有效的偵防對(duì)策，做到特殊預(yù)防與一般預(yù)防雙管齊下，防止青少年因受網(wǎng)絡(luò)的負(fù)面影響而走上違法犯罪的道路。 首先是本文的引言部分，該部分主要介紹了寫作本文的目的，即總覽世界，網(wǎng)絡(luò)興起，在整個(gè)世界尤其是中國(guó)發(fā)展迅速且影響深遠(yuǎn)。觀中國(guó)現(xiàn)實(shí)，中國(guó)的網(wǎng)民不斷增多，尤其是青少年網(wǎng)民更是與日俱增。網(wǎng)絡(luò)對(duì)青少年的影響不斷擴(kuò)大，其中負(fù)面影響日益凸顯，表現(xiàn)在許多方面，其中與網(wǎng)絡(luò)有關(guān)的青少年犯罪層出不窮。網(wǎng)絡(luò)成為誘使青少年違法犯罪的新的侵害源。為了解決這一問(wèn)題，為了減少網(wǎng)絡(luò)對(duì)青少年的負(fù)面影響，本文特從此方面進(jìn)行研究。 文章的正文分成以下三個(gè)部分進(jìn)行闡述，介紹網(wǎng)絡(luò)與青少年犯罪的關(guān)系、與網(wǎng)絡(luò)有關(guān)的青少年犯罪的表現(xiàn)類型及其偵查與預(yù)防對(duì)策。 本文的第一部分是介紹網(wǎng)絡(luò)與青少年犯罪的關(guān)系。文章首先提出問(wèn)題：網(wǎng)絡(luò)是否對(duì)青少年犯罪有影響?再運(yùn)用分析說(shuō)理、舉例、引用等方法加以說(shuō)明。在得出肯定結(jié)論后，又分為三個(gè)較小的部分對(duì)“網(wǎng)絡(luò)是如何影響青少年犯罪”的進(jìn)行具體闡述：一是網(wǎng)絡(luò)與青少年犯罪心理的形成。文章認(rèn)為網(wǎng)絡(luò)通過(guò)信息對(duì)青少年犯罪心理的形成造成影響，并從暗示、模仿、教唆、激發(fā)等方面介紹了這種影響。二是網(wǎng)絡(luò)特征與青少年犯罪的關(guān)系。文章分別闡述了網(wǎng)絡(luò)的巨大信息性、開放性、交互性等特征與當(dāng)代青少年的某些犯罪的聯(lián)系。三是網(wǎng)絡(luò)與青少年犯罪的原因。文章從六個(gè)更小的方面介紹了網(wǎng)絡(luò)是如何通過(guò)影響這些青少年犯罪的原因而達(dá)到影響青少年犯罪的目的的。這六個(gè)方面是：(1)家庭、學(xué)校教育缺失；(2)網(wǎng)吧的吸引而社會(huì)、國(guó)家監(jiān)管不力；(3)網(wǎng)絡(luò)的誘惑與青少年自身的生理、心理原因；(4)消極的網(wǎng)絡(luò)文化造成青少年各種觀念的偏離；(5)符號(hào)化的網(wǎng)絡(luò)交往和任意的網(wǎng)絡(luò)行為削弱了青少年的社會(huì)責(zé)任感；(6)沉溺網(wǎng)絡(luò)造成青少年的性格缺陷。 本文的第二部分是介紹與網(wǎng)絡(luò)有關(guān)的青少年犯罪的表現(xiàn)類型。文章認(rèn)為與網(wǎng)絡(luò)有關(guān)的青少年犯罪既包括與網(wǎng)絡(luò)有關(guān)的傳統(tǒng)犯罪也包括新興的網(wǎng)絡(luò)犯罪，可以分為貪財(cái)型犯罪、模仿型犯罪、獵奇型犯罪、報(bào)復(fù)型犯罪。并運(yùn)用各種說(shuō)明方法像舉例、列數(shù)字等具體介紹了它們的特征和表現(xiàn)形式。 本文的第三部分是介紹與網(wǎng)絡(luò)有關(guān)的青少年犯罪的偵查和預(yù)防對(duì)策。這是全文的重點(diǎn)部分，也是全文的主旨之所在，又分為兩個(gè)較小的部分： 一是與網(wǎng)絡(luò)有關(guān)的青少年犯罪的偵查對(duì)策。文章先闡述了偵查此類犯罪的指導(dǎo)方針和主要原則，然后接著闡述了偵查此類犯罪的具體的偵查策略與措施。文章認(rèn)為偵查此類犯罪的指導(dǎo)方針是要對(duì)青少年進(jìn)行教育、感化、挽救。主要原則包括以教育為主、懲罰為輔，保護(hù)社會(huì)秩序與保護(hù)青少年有機(jī)結(jié)合的原則；偵教結(jié)合、寓教于偵原則；全面調(diào)查原則；迅速及時(shí)原則等。這是從總的大政方針?lè)矫鎭?lái)闡述的，并將指導(dǎo)方針和每一條主要原則分別進(jìn)行了解釋與細(xì)化。至于偵查策略與措施，文章一邊分析與網(wǎng)絡(luò)有關(guān)的青少年犯罪的特點(diǎn)一邊闡述了相應(yīng)的偵查對(duì)策。文章認(rèn)為與網(wǎng)絡(luò)有關(guān)的青少年犯罪的特點(diǎn)有：(1)犯罪動(dòng)機(jī)簡(jiǎn)單但多樣；(2)犯罪手段簡(jiǎn)單，遺留線索較多；(3)犯罪誘發(fā)快，且與網(wǎng)絡(luò)有一定關(guān)聯(lián)；(4)犯罪大部分為共同犯罪；(5)犯罪具有模仿性，犯罪人具有可塑性、反復(fù)性；(6)犯罪中網(wǎng)絡(luò)犯罪占有一定的比例，偵查難度大。而特別強(qiáng)調(diào)的偵查對(duì)策包括分析判斷案情、現(xiàn)場(chǎng)勘查、調(diào)查訪問(wèn)、訊問(wèn)、教育與引導(dǎo)等等。 在此要特意加以說(shuō)明的是：文章的意思并不是說(shuō)只有出現(xiàn)了這些特點(diǎn)才能采用這些偵查對(duì)策。文章中提到的偵查對(duì)策是針對(duì)所有這一類犯罪的，適當(dāng)?shù)臅r(shí)候都可以也都應(yīng)該使用，有的甚至是自始至終都應(yīng)該使用的。而且由于篇幅問(wèn)題，文章也不可能將偵查此類犯罪要用的偵查對(duì)策都列舉出來(lái)加以說(shuō)明，只是揀了其中本人認(rèn)為應(yīng)該更加注意的加以說(shuō)明。 二是與網(wǎng)絡(luò)有關(guān)的青少年犯罪的預(yù)防對(duì)策。人們常說(shuō)：治理犯罪重在預(yù)防。的確，這才是我們的最終目的。所以文章也是用了重墨。文章分兩個(gè)層次總結(jié)了預(yù)防對(duì)策即綜合運(yùn)用多種手段治理網(wǎng)絡(luò)環(huán)境和社會(huì)各界分工合作、齊抓共管，對(duì)青少年進(jìn)行教育和引導(dǎo)。其中綜合運(yùn)用多種手段治理網(wǎng)絡(luò)環(huán)境部分又分為：(1)加強(qiáng)網(wǎng)絡(luò)資源建設(shè)，以健康的資訊占領(lǐng)網(wǎng)絡(luò)陣地；(2)以德治網(wǎng)，開展網(wǎng)絡(luò)道德教育；(3)以法治網(wǎng)，加強(qiáng)網(wǎng)絡(luò)法制建設(shè)；(4)以技治網(wǎng)，加強(qiáng)網(wǎng)絡(luò)監(jiān)控技術(shù)的開發(fā)應(yīng)用。社會(huì)各界分工合作、齊抓共管，對(duì)青少年進(jìn)行教育和引導(dǎo)部分又分為：(1)家庭的職責(zé)；(2)學(xué)校的職責(zé)；(3)社會(huì)的職責(zé)；(4)國(guó)家的職責(zé)。每一個(gè)對(duì)策都是與前文二、三部分介紹的情況相關(guān)聯(lián)的。正因?yàn)橛辛司W(wǎng)絡(luò)與青少年犯罪的關(guān)系和與網(wǎng)絡(luò)有關(guān)的青少年犯罪的各種表現(xiàn)類型，才能對(duì)癥下藥，也才有了這些對(duì)策。文章對(duì)每一對(duì)策都進(jìn)行了詳細(xì)深入的闡述，既擺明道理又注重操作性。
[Abstract]:With the rapid development of computer and network technology, the network era. The influence of the network continues to expand, has become an indispensable tool. The analysis reasoning, for example, reference methods are illustrated.
