【摘要】：2006年，為了降低戒毒人員的復(fù)吸率，我國(guó)依據(jù)美國(guó)的戒毒治療集體（TC）試運(yùn)行了“康復(fù)場(chǎng)所”戒毒模式，這一模式以公安機(jī)關(guān)或司法機(jī)關(guān)戒毒所為依托，是集戒毒人員身體恢復(fù)、心理矯治、勞動(dòng)技能培訓(xùn)的一個(gè)封閉式社區(qū)。“康復(fù)場(chǎng)所”戒毒模式填補(bǔ)了強(qiáng)制戒毒所與社區(qū)戒毒之間銜接的不足，在一定程度上讓戒毒人員在這一封閉場(chǎng)所禁絕了毒品，也發(fā)揮了回歸社會(huì)的一個(gè)功能。但康復(fù)場(chǎng)所在試運(yùn)行中存著性質(zhì)不清，執(zhí)法人員無(wú)權(quán)可依，戒毒人員權(quán)利缺乏救濟(jì)，各地戒毒“康復(fù)場(chǎng)所”存在難以運(yùn)行下去，這其中的原因有待探索，制度有待完善。本文從“康復(fù)場(chǎng)所”戒毒模式進(jìn)行了概述，分析了當(dāng)前吸毒的形式及我國(guó)現(xiàn)階段強(qiáng)制戒毒與社區(qū)戒毒存在的不足，闡述了“康復(fù)場(chǎng)所”戒毒模式存在的必要性。通過(guò)對(duì)其他國(guó)家相關(guān)戒毒模式的借鑒，分析了戒毒康復(fù)場(chǎng)所現(xiàn)狀及難以存續(xù)的原因，進(jìn)而提出改變執(zhí)法上的理念，明確性質(zhì)，完善相關(guān)法律制度等。 本文除引言、結(jié)論外分為四部份： 第一部分：康復(fù)場(chǎng)所戒毒模式簡(jiǎn)介。對(duì)“康復(fù)場(chǎng)所”戒毒模式、“康復(fù)場(chǎng)所”戒毒模式的發(fā)展史、當(dāng)前我國(guó)的吸毒人員形式、我國(guó)關(guān)于戒毒的法律制度、現(xiàn)階段我國(guó)的戒毒模式分析、“康復(fù)場(chǎng)所”戒毒模式存在的意義進(jìn)行了闡述。 第二部分：當(dāng)前“康復(fù)場(chǎng)所”戒毒模式的現(xiàn)狀及問(wèn)題分析。戒毒康復(fù)場(chǎng)所運(yùn)行中存在入住率低，對(duì)戒毒人員的變相關(guān)押，戒毒康復(fù)場(chǎng)所經(jīng)費(fèi)困難以生存等現(xiàn)狀，分析了存在這些現(xiàn)狀的原因是戒毒康復(fù)場(chǎng)所性質(zhì)定位不清、戒毒人員權(quán)利難以得到保障、康復(fù)場(chǎng)所社區(qū)定位與依附行政關(guān)押監(jiān)所性質(zhì)相沖突、康復(fù)場(chǎng)所戒毒力量太薄弱、戒毒手段需改進(jìn)等原因。 第三部分：其他國(guó)家相關(guān)戒毒模式簡(jiǎn)介。介紹了美國(guó)、英國(guó)、西班牙相關(guān)戒毒模式，并對(duì)我國(guó)的戒毒模式與其他國(guó)家相關(guān)戒毒模式進(jìn)行了比較。 第四部分：完善戒毒康復(fù)模式。戒毒需要從懲罰到教育挽救的觀念轉(zhuǎn)型，，明確戒毒“康復(fù)場(chǎng)所”法律定位，提出“康復(fù)場(chǎng)所”戒毒模式屬行政合同性質(zhì)，并建議改變執(zhí)法主體及執(zhí)法手段，完善法律救濟(jì)制度，引進(jìn)優(yōu)惠政策，讓全社會(huì)參與戒毒等措施。
[Abstract]:In 2006, in order to reduce the relapse rate of drug addicts, our country tried to run the "rehabilitation site" drug treatment model according to the American drug treatment collective. This model is based on the rehabilitation center of public security organ or judicial organ. It is a collection of drug addicts to recover their body and treat them psychologically. A closed community of labor skills training. The "rehabilitation place" detoxification model fills the gap between compulsory drug treatment centers and community detoxification, and to a certain extent allows drug addicts to ban drugs in this closed place. It has also played a function of returning to society, but the nature of rehabilitation sites in the trial operation is not clear, the law enforcement personnel have no right to rely on, the rights of drug addicts lack relief, and the existence of "rehabilitation sites" in various localities is difficult to run. The reasons for this need to be explored and the system should be improved. This paper summarizes the mode of detoxification in "rehabilitation place", and analyzes the current forms of drug abuse and the shortcomings of compulsory detoxification and community detoxification in our country at the present stage. This paper expounds the necessity of the mode of detoxification in "rehabilitation place", analyzes the present situation of rehabilitation place and the reasons why it is difficult to survive, and then puts forward the idea of changing the law enforcement. Clear nature, improve the relevant legal system and so on. In addition to the introduction, the conclusion is divided into four parts: The first part: a brief introduction of rehabilitation site detoxification mode. The development history of "rehabilitation place" detoxification mode, the current drug addicts form in our country, and the legal system of detoxification in our country. At present, the analysis of detoxification mode in our country and the significance of detoxification mode in rehabilitation place are expounded. The second part: the current "rehabilitation place" detoxification mode status and problem analysis. There is a low occupancy rate in the operation of rehabilitation sites, detoxification detoxification in disguised detention. It is difficult to survive in detoxification and rehabilitation sites. The reasons are that the nature of rehabilitation sites is not clear and the rights of drug addicts are difficult to be guaranteed. The community orientation of rehabilitation sites is in conflict with the nature of administrative detention institutions, the detoxification power in rehabilitation sites is too weak, and the means of detoxification need to be improved. The third part: the brief introduction of other countries' related detoxification models. It introduces the related drug treatment models in the United States, Britain and Spain, and makes a comparison between our country's detoxification models and other countries' related detoxification models. Part 4th: consummate the rehabilitation mode of detoxification. Detoxification needs to transform from punishment to educational rescue, make clear the legal position of "rehabilitation place", and put forward that the "rehabilitation place" detoxification mode belongs to the nature of administrative contract. It also suggests to change the subject and means of law enforcement, perfect the legal relief system, introduce preferential policies, and let the whole society participate in detoxification.
