【摘要】：高校司法鑒定機構(gòu)并不是新生事物，自從我國的司法鑒定工作開展以來，高校就一直有所參與，，但在2005年《全國人民代表大會常務(wù)委員會關(guān)于司法鑒定管理問題的決定》(以下簡稱《決定》)實施之前，我國的司法鑒定業(yè)務(wù)主要被公檢法三機關(guān)所壟斷，公檢法三機關(guān)均能內(nèi)設(shè)鑒定機構(gòu)且其內(nèi)部人員是鑒定人的主要來源，這種自偵自鑒、自審自鑒的現(xiàn)象，導(dǎo)致司法鑒定的中立性曾一度嚴重缺失，而《決定》實施后，廢除了法院內(nèi)設(shè)的鑒定機構(gòu)，標志著司法鑒定改革制度的正式啟動，高校司法鑒定機構(gòu)在原有的基礎(chǔ)上擁有了更大的發(fā)揮空間，高校的司法鑒定業(yè)務(wù)也得到了前所未有的發(fā)展。 在高校設(shè)立司法鑒定機構(gòu)，是集高質(zhì)量人才、先進技術(shù)，精良設(shè)備于一身，借助這些自身優(yōu)勢從事司法鑒定業(yè)務(wù)必然會使司法鑒定更上一個階梯，并且將高校司法鑒定機構(gòu)與其他社會鑒定機構(gòu)以及偵查機關(guān)內(nèi)設(shè)鑒定機構(gòu)相比，其最能體現(xiàn)司法鑒定的中立性與公信性，這意味著在司法鑒定未來的發(fā)展道路上它無疑會飾演主力軍角色。但高校司法鑒定機構(gòu)對于其在社會中的職能定位，在未來的發(fā)展中出現(xiàn)哪些問題以及該如何解決并加以完善目前還缺乏清晰的思路，因此筆者在查閱有關(guān)高校司法鑒定的著作學(xué)術(shù)資料的基礎(chǔ)上，結(jié)合在高校司法鑒定中心的實踐，從高校司法鑒定機構(gòu)的自身特性出發(fā)，比較了它與其他社會鑒定機構(gòu)以及偵查機關(guān)內(nèi)設(shè)鑒定機構(gòu)的異同，進而圍繞高校司法鑒定機構(gòu)的作用、出現(xiàn)的問題和發(fā)展構(gòu)想展開論述。本文共分五大部分： 第一部分概括總結(jié)出司法鑒定的概念及其基本屬性。 第二部分對我國司法鑒定機構(gòu)進行分類并詳細分析其各自特性。根據(jù)分析得知，高校司法鑒定機構(gòu)最符合司法鑒定本質(zhì)屬性，營利性不強，又最為中立還具有一定的權(quán)威性。 第三部分主要對我國高校司法鑒定機構(gòu)的發(fā)展現(xiàn)狀進行分析。通過將高校司法鑒定機構(gòu)與其他社會鑒定機構(gòu)以及偵查機關(guān)內(nèi)設(shè)鑒定機構(gòu)進行詳細的比較，發(fā)現(xiàn)高校司法鑒定機構(gòu)的優(yōu)勢和作用。 第四部分主要論述我國高校司法鑒定機構(gòu)在發(fā)展過程中出現(xiàn)的問題及其未來的發(fā)展構(gòu)想，重點從高校司法鑒定人的兼職身份入手詳細闡述高校司法鑒定機構(gòu)從事鑒定業(yè)務(wù)所出現(xiàn)的不足并進而提出解決問題的對策。 第五部分作為文章的結(jié)語，對高校司法鑒定機構(gòu)未來的發(fā)展前景充滿希望。
[Abstract]:The institution of judicial expertise in colleges and universities is not a new thing. Since the development of judicial expertise in our country, colleges and universities have been taking part in it. However, before the implementation of the decision on the Administration of Judicial expertise of the standing Committee of the National people's Congress on 2005 (hereinafter referred to as the decision). The judicial expertise business in China is mainly monopolized by the three organs of public procuratorial law. The three organs of public procuratorial law can set up their own appraisal institutions and their internal personnel are the main sources of experts. This phenomenon of self-detection and self-examination is a phenomenon of self-detection and self-examination. The neutrality of judicial expertise was once seriously lacking, and after the implementation of the decision, the judicial appraisal institution was abolished, which marked the formal start of the reform system of judicial expertise. The institution of judicial expertise in colleges and universities has a greater space to play on the basis of the original, and the business of judicial expertise in colleges and universities has also been developed unprecedented. The establishment of judicial expertise institutions in colleges and universities is a collection of high-quality personnel, advanced technology, sophisticated equipment in a body, with the help of these advantages to engage in judicial expertise business will inevitably make forensic expertise a step up the ladder. And compared with other institutions of social expertise and internal institutions of investigation, it can best reflect the neutrality and public credibility of judicial expertise. This means that in the future development of forensic expertise it will undoubtedly play the role of the main force. In the future development of what problems and how to solve and improve the current lack of clear ideas, so the author on the basis of consulting the academic materials of judicial expertise in colleges and universities. In combination with the practice in the judicial identification center of colleges and universities, this paper compares the similarities and differences between it and other social appraisal institutions as well as those established within the investigative organs from the characteristics of the judicial expertise institutions in colleges and universities. Then it discusses the functions, problems and development ideas of judicial expertise institutions in colleges and universities. This paper is divided into five parts: The first part summarizes the concept of forensic expertise and its basic attributes. The second part of the classification and detailed analysis of the characteristics of judicial expertise institutions in China. According to the analysis, the judicial identification institutions in colleges and universities are the most consistent with the nature of judicial identification, not profitable. And the most neutral and authoritative. The third part mainly analyzes the current situation of the development of the judicial identification institutions in colleges and universities in China. Through the comparison between the judicial identification institutions of colleges and universities and other social appraisal institutions as well as the internal identification agencies of the investigation organs, the author makes a detailed comparison. Find out the advantages and functions of judicial expertise institutions in colleges and universities. The 4th part mainly discusses the problems in the process of the development of the judicial expertise institutions in China's colleges and universities and the future development ideas. Starting from the part-time identity of judicial connoisseurs in colleges and universities, this paper expounds in detail the shortcomings of judicial expertise institutions in colleges and universities and puts forward countermeasures to solve the problems. As the conclusion of the article, the 5th part is full of hope for the future development of the forensic institutions in colleges and universities.
