【摘要】：社區(qū)矯正制度在我國是近幾年才施行的新興制度。通過近年來的試行,社區(qū)矯正工作發(fā)展迅速,矯正試行范圍不斷擴(kuò)大,矯正人數(shù)不斷增長。從其定位來看,社區(qū)矯正制度是與監(jiān)禁刑罰相對應(yīng)的刑罰執(zhí)行制度,是以非監(jiān)禁的形式代替原有的監(jiān)禁刑,執(zhí)行刑罰措施。但在試行過程中,立法與實踐中還是存在不少爭議。本文從筆者工作實踐出發(fā),對現(xiàn)下社區(qū)矯正制度進(jìn)行分析、研究,并對有關(guān)制度的完善提出自己的建議。 本文共分為三章,具體內(nèi)容為: 第一章主要是社區(qū)矯正制度的概述。第一節(jié)首先簡要介紹了社區(qū)矯正制度的基本概念,即何謂社區(qū)矯正。筆者首先以社區(qū)的概念入手,對社區(qū)概念進(jìn)行一定介紹。由于世界各國對于社區(qū)矯正制度的認(rèn)識和發(fā)展程度不盡相同,因此對社區(qū)矯正制度概念的解釋和闡述也各不相同。從主要學(xué)說來看,社區(qū)矯正的概念可分為廣義說和狹義說,我國目前采用的是狹義說社區(qū)矯正概念,即規(guī)定社區(qū)矯正是與監(jiān)禁矯正相對的行刑方式,是指將符合社區(qū)矯正條件的罪犯置于社區(qū)內(nèi),由專門的國家機(jī)關(guān)在相關(guān)社會團(tuán)體和民間組織以及社會志愿者的協(xié)助下,在判決、裁定或決定確定的期限內(nèi),矯正其犯罪心理和行為惡習(xí),并促進(jìn)其順利回歸社會的非監(jiān)禁刑罰執(zhí)行活動。第二節(jié)對社區(qū)矯正制度在世界主要國家的歷史、發(fā)展進(jìn)行介紹。第三節(jié)則對社區(qū)矯正的基本理念和價值定位作闡述,由此,我們可以發(fā)現(xiàn)正是基于其懲教結(jié)合,尊重人權(quán)、體現(xiàn)刑法謙抑精神的基本理念和價值取向,社區(qū)矯正制度能在世界各國法制歷史進(jìn)程中始終據(jù)有一席之地,一直發(fā)展和創(chuàng)新,也正因此,在我國轉(zhuǎn)變刑事司法理念、踐行寬嚴(yán)相濟(jì)刑事司法政策的今天,社區(qū)矯正制度顯得尤為引人注目,受到越來越多人關(guān)注和討論。 但是從我國目前社區(qū)矯正的試行情況來看,仍存在不少問題,值得我們引起注意,加以改進(jìn)。因此第二章開始,筆者結(jié)合自身的工作實際就我國現(xiàn)行的社區(qū)矯正制度中存在問題進(jìn)行分析,并嘗試提出一定解決辦法。從我國現(xiàn)行社區(qū)矯正制度上看,主要存在以下幾大部分的問題:第一,法律依據(jù)的缺位,體現(xiàn)在實際執(zhí)行中,缺乏明確、詳細(xì)的操作細(xì)則;第二,執(zhí)行主體的定位不明,法律、法規(guī)對于社區(qū)矯正執(zhí)行主體的規(guī)定不盡相同;第三,矯正范圍規(guī)制不合理;第四,社區(qū)矯正制度發(fā)展中存在的問題:首先,各地的社區(qū)矯正規(guī)范不一,發(fā)展不平衡;其次,社區(qū)矯正從業(yè)人員執(zhí)法水平參差不齊,社區(qū)矯正隊伍亟待規(guī)范和提高執(zhí)法水平;再次,雖然社區(qū)矯正已經(jīng)試行幾年,但受傳統(tǒng)刑事法律思想影響,民眾與司法機(jī)關(guān)對社區(qū)矯正的認(rèn)識還存在偏差;最后,矯正內(nèi)容過于簡單化,重監(jiān)管輕教育。隨后,筆者就前文所提出的存在問題提出一些解決對策。筆者認(rèn)為可以從以下幾個方面入手探索、解決之法:1、明確司法機(jī)關(guān)為社區(qū)矯正執(zhí)行主體;2、增加程序性規(guī)定,保障社區(qū)矯正執(zhí)行有法可依;3、建議以矯正對象戶籍地為矯正地進(jìn)行社區(qū)矯正;4、增設(shè)社區(qū)服務(wù)刑;5、設(shè)置刑罰易科制度;6、健全專業(yè)社區(qū)矯正隊伍建設(shè)。 第三章主要是對今后我國社區(qū)矯正制度的完善和發(fā)展進(jìn)行展望和建議。結(jié)合社區(qū)矯正制度對勞動教養(yǎng)制度的改革進(jìn)行分析。筆者認(rèn)為勞動教養(yǎng)制度雖然在我國歷史發(fā)展進(jìn)程中發(fā)揮了巨大的作用,但隨著時代的發(fā)展正受到前所未有的質(zhì)疑和批評,因此有必要對其進(jìn)行改革。結(jié)合實際工作,筆者認(rèn)為應(yīng)當(dāng)將勞動教養(yǎng)分解化,一部分歸入刑事法律調(diào)整,一部分由治安管理處罰法調(diào)整,另一部分科制定專門的法律調(diào)整,同時對調(diào)整后的監(jiān)管人員及場所使用情況作一定分析。其次,結(jié)合社區(qū)矯正制度對一些特殊犯罪案件,如兩懷婦女、未成年人犯罪,疑似艾滋病人犯罪行為的打擊處理提出自己的觀點。最后對社區(qū)矯正制度的立法模式提出自己的觀點。
[Abstract]:The community correction system is a new system in recent years in our country. Through the implementation of the trial in recent years, the rapid development of community corrections work, try expanding the scope of correction, correction of the number is growing. From the positioning point of view, the system of community correction is corresponding with the imprisonment penalty execution system, is based on the non imprisonment instead of the original form of imprisonment, execution of punishment measures. But in the trial process, many disputes still exist in legislation and practice. This paper from the author's work practice, to the current community correction system for analysis, research, and puts forward some suggestions to perfect the related system.
This article is divided into three chapters, and the specific contents are as follows:
The first chapter is an overview of the community correction system. The first section introduces the basic concept of community correction system, namely what is the community correction. The author firstly start with the concept of community, the concept of community must be introduced. Because the world community correction system for understanding and level of development is different, so the community correction the system concept explanation and elaboration are also different. From the main theory point of view, the concept of community correction can be divided into broad and narrow sense, our country is currently used in the narrow sense concept of community correction, namely the provisions of community correction is relative execution and prison correction, is to meet the conditions of community correction offenders in community in the special social groups in the relevant state organs and civil society organizations and volunteers, in the judgment, ruling or decision within the time limit, the correction of criminal The psychological and behavioral habits, and promote their successful return to society the non imprisonment penalty. The second section correction system of major countries in the world history of community development are introduced. The third section of the community correction of the basic concept and value orientation are elaborated, thus, we can find it is based on the combination with education, respect human rights, the basic idea and the value orientation of the restraining spirit of criminal law, the community correction system can always have a space for one person in the legal history of the world, has been the development and innovation, therefore, in the transformation of China's criminal justice practice, criminal justice policy today, the community correction system is particularly striking, by more and more attention and discussion.
But in China's current community correction system situation, there are still many problems worthy of our attention, to be improved. In the second chapter, the author on China's current problems in the community correction system analysis combined with their own work, and try to propose some solutions. From China's current community correction system look, the main problems of several parts: first, the absence of legal basis, lack of clear reflected in the actual implementation, and detailed rules for the operation; second, implementation of the main location is unknown, the law, regulations for the implementation of the main provisions of community corrections are not the same; third, the scope of regulation is unreasonable correction; fourth. The problems existing in the development of community correction system: first of all, around the community correction standards, development is not balanced; secondly, the community correction law enforcement practitioners uneven level of community correction The team needs to standardize and improve the level of law enforcement; thirdly, although community corrections have tried a few years, but by the ideological influence of the traditional criminal law, public and judicial deviation understanding of community correction; finally, correction is too simplistic, heavy light regulatory education. Then, the writer's earlier problems raised some countermeasures. I think we can start to explore from the following aspects: 1 solution, clear judicial organ for the implementation of community corrections subject; 2, increase the procedural rules, guarantee the implementation of the law of community correction; 3, recommended to correct the object domicile correction of community correction; 4, additional community service sentence; 5, setting the exchanged penalty system; 6, community corrections and improve professional ranks.
The third chapter is prospects and suggestions for improvement and development in the future of China's community correction system. With the community correction system reform of the system of reeducation through labor is analyzed. The author thinks that the system of reeducation through labor in China's historical development has played a huge role, but with the development of the times is questioned and criticized by the hitherto unknown therefore, it is necessary to reform. Combined with the actual work, I think that should be a part of the decomposition of reeducation through labor, in criminal law, a part of the public security administration law, also developed a special legal regulation, while the revised regulatory personnel and premises must analyze the use of second. And with the community correction system for some special crimes, such as the two pregnant women, minors crime, crimes against the suspected AIDS treatment are put forward Finally, it puts forward his own views on the legislative mode of the community correction system.
