【摘要】：隨著我國改革開放的進(jìn)一步深入,我國腐敗問題出現(xiàn)越來越多的新形勢(shì),相關(guān)研究工作通常圍繞社會(huì)生活中的現(xiàn)代腐敗(權(quán)錢交易)展開。然而,在中國傳統(tǒng)的人情社會(huì)土壤下,中國式腐敗仍然盛行,其一大主要表現(xiàn)就是庇護(hù)式腐敗。緣此,在中國特殊的人情文化背景下,分析庇護(hù)式腐敗的特點(diǎn),了解庇護(hù)式腐敗產(chǎn)生的原因?qū)Ψ锤ぷ饔兄匾饬x。本文將引入庇護(hù)主義的分析范式,以文獻(xiàn)探討、案例搜集、資料分析等方法,對(duì)我國傳統(tǒng)的庇護(hù)式腐敗從定義、現(xiàn)狀,到原因、影響等多角度進(jìn)行分析,并且提出現(xiàn)實(shí)治理途徑,提升國家整體廉能情況。本文認(rèn)為庇護(hù)式腐敗是一個(gè)特定的概念：即庇護(hù)式腐敗是公職人員利用公共資源或權(quán)威影響力,以互惠為基礎(chǔ),以利益均沾為原則,構(gòu)建持續(xù)的、穩(wěn)定的庇護(hù)者——被庇護(hù)者的封閉網(wǎng)絡(luò),謀取腐敗利益而違反法律和道德規(guī)范的行為。庇護(hù)式腐敗具有隱蔽性和穩(wěn)定性；群體性和低風(fēng)險(xiǎn)性；組織化和制度化；宗派化和抱團(tuán)化等特點(diǎn)。主要表現(xiàn)是：官員上下級(jí)之間的“庇蔭關(guān)系”；官商之間的庇護(hù)關(guān)系；官員與黑勢(shì)力之間的庇護(hù)關(guān)系；家族式腐�。蝗箮шP(guān)系腐敗。追本溯源,對(duì)庇護(hù)式腐敗的成因進(jìn)行分析,庇護(hù)式腐敗的主要原因有：“人情——報(bào)恩”的文化土壤培養(yǎng)；干部選拔任用制度的弊端；庇護(hù)網(wǎng)絡(luò)中利益均沾原則的誘惑；庇護(hù)腐敗的低風(fēng)險(xiǎn)性誘惑；公務(wù)員回避意識(shí)和回避制度設(shè)計(jì)的缺失。對(duì)癥下藥,為治理庇護(hù)式腐敗提出建議。定位好公職人員的角色,清除關(guān)系權(quán)力；加強(qiáng)制度設(shè)計(jì),破除“人身依附”人事制度等；重視庇護(hù)式腐敗微觀成本—收益機(jī)制研究,消除庇護(hù)式腐敗產(chǎn)生的動(dòng)力；完善相關(guān)法律法規(guī),進(jìn)一步構(gòu)建法治政府和透明政府。另外,通過宣傳教育等手段,轉(zhuǎn)變?nèi)藗儭坝嘘P(guān)系,才能辦事”思想觀念,同時(shí)動(dòng)員全社會(huì)投入到抵制揭發(fā)“關(guān)系”權(quán)力的運(yùn)動(dòng)中,破除庇護(hù)式腐敗,消除這一危害。
[Abstract]:With the further development of China's reform and opening up, more and more new situations of corruption appear in our country. The related research work usually revolves around the modern corruption (power and money transaction) in the social life. However, under the traditional Chinese social environment, Chinese corruption is still prevalent, one of its main manifestations is sheltered corruption. Therefore, it is of great significance to analyze the characteristics of sheltered corruption and understand the causes of corruption in the context of China's special human culture. This article will introduce the analysis paradigm of asylum doctrine, and analyze the traditional asylum corruption in our country from the definition, present situation, cause, influence and so on with the methods of literature discussion, case collection, data analysis and so on. And puts forward the realistic governance way, promotes the whole country to be honest and capable situation. This paper holds that sheltered corruption is a particular concept: that is, sheltered corruption is the use of public resources or authority by public officials, on the basis of reciprocity, on the basis of the principle of balance of profits, to build sustainable. Stable asylum-a closed network of sheltered persons who seek corrupt interests and violate the law and ethics. Sheltered corruption is characterized by concealment and stability; group and low risk; organization and institutionalization; sectarianism and agglomeration. The main manifestations are: the "shadow relationship" between officials and subordinates, the sheltering relationship between officials and businessmen, the sheltered relationship between officials and the black forces, family corruption and nepotism corruption. Tracing back to the source, the causes of sheltered corruption are analyzed. The main reasons of the corruption are as follows: the cultivation of cultural soil of "human feelings-repaying kindness", the malpractice of cadre selection and appointment system, the temptation of the principle of equal profit in the sheltered network; The low-risk temptation of sheltering corruption and the lack of avoidance consciousness and avoidance system design of civil servants. The remedy for the case, for the treatment of corruption sheltered type of recommendations. Position the public official's role, clear the relation power, strengthen the system design, break down the personnel system of "personal attachment", attach importance to the research of the micro-cost-benefit mechanism of the sheltered corruption, eliminate the motive force of the sheltered corruption; Improve relevant laws and regulations, and further build a government ruled by law and transparent government. In addition, by means of publicity and education, we should change people's ideology of "having a relationship, can handle affairs", and at the same time mobilize the whole society to put in a campaign to resist exposing the power of "relationship", to break down the sheltered corruption and to eliminate this harm.
