【摘要】：黨內法規(guī)可操作性評估是黨內法規(guī)評估的重要組成部分,是指有權評估主體通過一定的評估方法、評估程序對黨內法規(guī)的權利性、義務性、責任性、程序性等規(guī)則的可行性展開的評估,其目的在于增強黨內法規(guī)的操作性、實用性和科學性,提升黨內法規(guī)的實施效果。雖然,《中國共產(chǎn)黨黨內法規(guī)制定條例》已規(guī)定可對黨內法規(guī)的執(zhí)行情況、實施效果開展評估,但國內尚未對黨內法規(guī)的可操作性評估展開理論研究和實踐探索。因此,有必要在借鑒立法評估一般理論的基礎上,對我國的黨內法規(guī)可操作評估進行系統(tǒng)性的建構,包括其結構要素、評估維度、評估結果的回應機制等,為黨內法規(guī)可操作性評估實踐提供有益的指導和參考。
[Abstract]:The operability evaluation of inner-party laws and regulations is an important part of the inner-party law evaluation, which means that the subject has the right, obligation and responsibility to evaluate the inner-party laws and regulations through a certain evaluation method. The purpose of the feasibility evaluation of procedural rules is to enhance the operability, practicability and scientificalness of inner-party laws and regulations, and to improve the implementation effect of inner-party laws and regulations. Although the "regulations on the Establishment of CPC Inner-Party laws and regulations" has stipulated that the implementation and effect of the inner-party laws and regulations can be evaluated, the theoretical study and practical exploration on the feasibility evaluation of the inner-party laws and regulations have not been carried out in our country. Therefore, on the basis of the general theory of legislative evaluation, it is necessary to systematically construct the operational evaluation of inner-party laws and regulations in China, including its structural elements, evaluation dimensions, response mechanism of evaluation results, and so on. To provide useful guidance and reference for the practice of inner-party regulation operability evaluation.
