【摘要】：在網(wǎng)絡(luò)反腐愈演愈烈、民眾參與熱情極度高漲的當(dāng)下,網(wǎng)絡(luò)反腐在我國反腐體制中到底發(fā)揮著怎樣的效用是一個(gè)值得探討的問題。 本文選取了2012年1月至2014年10月間被處理的、具有較大影響力的34個(gè)網(wǎng)絡(luò)反腐典型案例作為切入點(diǎn),梳理了網(wǎng)絡(luò)反腐的脈絡(luò),根據(jù)網(wǎng)絡(luò)反腐的特征及效用評(píng)判依據(jù),從網(wǎng)絡(luò)舉報(bào)的主要來源、網(wǎng)絡(luò)舉報(bào)案件的類型、網(wǎng)絡(luò)反腐案例的地區(qū)與行業(yè)分布、網(wǎng)絡(luò)反腐的形式等四個(gè)角度對(duì)其現(xiàn)狀展開分析,同時(shí)從網(wǎng)絡(luò)舉報(bào)的真實(shí)性、網(wǎng)絡(luò)反腐的結(jié)案情況、網(wǎng)絡(luò)反腐的優(yōu)勢(shì)與局限性、網(wǎng)絡(luò)反腐在我國反腐體系中的定位等四個(gè)方面對(duì)網(wǎng)絡(luò)反腐的效用進(jìn)行深入探討。 綜合以上分析,得出結(jié)論：網(wǎng)絡(luò)反腐的社會(huì)成本相對(duì)較低、取得了良好的社會(huì)效應(yīng),其風(fēng)險(xiǎn)主要集中在網(wǎng)絡(luò)謠言、網(wǎng)絡(luò)暴力方面。同時(shí)網(wǎng)絡(luò)反腐在揭露腐敗環(huán)節(jié)發(fā)揮了良好的作用,然而在調(diào)查、審理腐敗案件與執(zhí)行懲罰等階段發(fā)揮的效用有限,仍依賴于政府公權(quán)力與領(lǐng)導(dǎo)人的意志。 為了促進(jìn)網(wǎng)絡(luò)反腐效用的最大化,對(duì)其未來的發(fā)展方向提出了一些建議,包括推進(jìn)網(wǎng)絡(luò)反腐的立法進(jìn)程、將網(wǎng)絡(luò)反腐納入日常反腐體系、加強(qiáng)網(wǎng)絡(luò)舉報(bào)與反腐職能部門的聯(lián)動(dòng)、促進(jìn)網(wǎng)絡(luò)反腐與傳統(tǒng)媒體的互動(dòng)等。同時(shí)具體的提出了實(shí)名舉報(bào)保護(hù)制度、推進(jìn)官員財(cái)產(chǎn)公開制度、組建網(wǎng)絡(luò)反腐隊(duì)伍、搭建官方網(wǎng)絡(luò)反腐平臺(tái)、加快陽光政府的打造等建議。
[Abstract]:At a time when the network anti-corruption is becoming more and more fierce and the popular participation enthusiasm is extremely high, it is worth discussing how the network anti-corruption is playing an important role in the anti-corruption system of our country. From January 2012 to October 2014, 34 typical cases of network anti-corruption are selected as the starting point, and the context of network anti-corruption is combed. According to the characteristics and utility evaluation basis of network anti-corruption, this paper selects 34 typical cases of network anti-corruption which have great influence as the starting point. From the four angles of the main source of network report, the type of network report case, the region and industry distribution of network anti-corruption case, the form of network anti-corruption, the paper analyzes its current situation, and at the same time, analyzes the authenticity of network report. This paper probes into the effectiveness of network anti-corruption in four aspects, such as the closing of network anti-corruption, the advantages and limitations of network anti-corruption, and the orientation of network anti-corruption in the anti-corruption system of our country. Based on the above analysis, it is concluded that the social cost of network anti-corruption is relatively low, and good social effect has been obtained, and its risk is mainly concentrated in network rumors and network violence. At the same time, network anti-corruption has played a good role in exposing corruption, but its effectiveness in the stages of investigation, trial of corruption cases and execution of punishment is limited and still depends on the public power of the government and the will of the leaders. In order to maximize the effectiveness of network anti-corruption, this paper puts forward some suggestions for its future development, including promoting the legislative process of network anti-corruption, integrating network anti-corruption into the daily anti-corruption system, and strengthening the linkage between network reporting and anti-corruption functional departments. Promote network anti-corruption and traditional media interaction. At the same time, it puts forward some suggestions, such as the protection system of real name report, the promotion of official property disclosure system, the establishment of network anti-corruption team, the establishment of official network anti-corruption platform, and the acceleration of the building of Sunshine Government.
