【摘要】：十八屆四中全會(huì)提出完善以憲法為核心的中國社會(huì)主義法律體系,這是依法治國的一個(gè)基本前提。未成年人網(wǎng)絡(luò)保護(hù)條例的起草是我國目前完善和加強(qiáng)重點(diǎn)領(lǐng)域立法的一個(gè)重要舉措。征求意見稿的基本思路在于處理好各類法律主體權(quán)利、義務(wù)的關(guān)系和引導(dǎo)、預(yù)防、懲罰的關(guān)系,處理好國家干預(yù)和行業(yè)自律的關(guān)系,處理好網(wǎng)絡(luò)創(chuàng)新行業(yè)發(fā)展與未成年人權(quán)利保護(hù)的關(guān)系,處理好表達(dá)自由和法律監(jiān)管的關(guān)系。
[Abstract]:The fourth Plenary session of the 18th CPC Central Committee proposed to perfect China's socialist legal system with the Constitution as the core, which is a basic prerequisite for governing the country according to law. The drafting of the regulations on the protection of minors is an important measure to perfect and strengthen the legislation in the key areas. The basic ideas of the draft for soliciting opinions lie in handling the relationship and guidance of the rights and obligations of various legal subjects, the relationship between prevention and punishment, and the relationship between state intervention and industry self-discipline. To deal with the relationship between the development of network innovation industry and the protection of minors' rights, and the relationship between freedom of expression and legal supervision.
