紀(jì)委與監(jiān)察委員會(huì)合署辦公的理論內(nèi)涵、現(xiàn)實(shí)意義與優(yōu)化路徑

【摘要】:對(duì)權(quán)力的監(jiān)督與制約一直是執(zhí)政黨建設(shè)的核心問(wèn)題之一。強(qiáng)化對(duì)權(quán)力的監(jiān)督與制約,既是法治中國(guó)建設(shè)的關(guān)鍵所在,也是黨風(fēng)廉政建設(shè)和反腐敗斗爭(zhēng)要解決的核心問(wèn)題,更是推進(jìn)國(guó)家治理體系與治理能力現(xiàn)代化的重要途徑。中國(guó)共產(chǎn)黨長(zhǎng)期執(zhí)政,面臨的重大問(wèn)題之一就是對(duì)權(quán)力的監(jiān)督。全面從嚴(yán)治黨,最終是要探索出一條黨長(zhǎng)期執(zhí)政條件下實(shí)現(xiàn)自我監(jiān)督的有效途徑!都o(jì)委與監(jiān)察委員會(huì)合署辦公的理論內(nèi)涵、現(xiàn)實(shí)意義與優(yōu)化路徑》一文指出,紀(jì)委與監(jiān)察委員會(huì)合署辦公是國(guó)家監(jiān)察體制改革的一項(xiàng)重要內(nèi)容。從權(quán)力監(jiān)督視角出發(fā),紀(jì)委與監(jiān)察委員會(huì)合署辦公的理論內(nèi)涵體現(xiàn)為兩者在監(jiān)督主體、監(jiān)督對(duì)象、監(jiān)督內(nèi)容和監(jiān)督手段四個(gè)方面的分工與融合。紀(jì)委與監(jiān)察委員會(huì)合署辦公具有加強(qiáng)和改善黨對(duì)反腐敗工作的領(lǐng)導(dǎo)、優(yōu)化中國(guó)特色社會(huì)主義權(quán)力監(jiān)督體系的主體結(jié)構(gòu)與內(nèi)容結(jié)構(gòu)、提升我國(guó)治理腐敗的有效性和合法性等現(xiàn)實(shí)意義!豆街:權(quán)力監(jiān)督目的的生態(tài)學(xué)分析》一文指出,立足生態(tài)學(xué)的視角,監(jiān)督主體的私利有其必然性與合理性,但持續(xù)膨脹的私利則會(huì)掣肘權(quán)力監(jiān)督的應(yīng)有效能,引發(fā)權(quán)力與權(quán)利的互抑與失衡,加劇監(jiān)督生態(tài)的退化。為此,權(quán)力監(jiān)督應(yīng)當(dāng)追求監(jiān)督目的的公益化,實(shí)現(xiàn)監(jiān)督雙方的共生互利,進(jìn)而統(tǒng)領(lǐng)和規(guī)范多樣性的監(jiān)督訴求,確保監(jiān)督生態(tài)的整體性、平衡性和持續(xù)優(yōu)化!稒(quán)力規(guī)制:政治秩序場(chǎng)域中利益集團(tuán)的消極行為》一文指出,對(duì)利益集團(tuán)消極行為的規(guī)制,中國(guó)應(yīng)著眼于政府自主性、執(zhí)政黨自身建設(shè)和公民個(gè)體的政治理性來(lái)增強(qiáng)政治實(shí)體的防范能力,著眼于嚴(yán)格執(zhí)行政治制度、增加政治制度供給和營(yíng)造政治生態(tài)來(lái)發(fā)揮政治規(guī)則的效力,著眼于強(qiáng)化政治權(quán)威、掌控政治資源和彰顯法治來(lái)提高政治控制的水平。三篇文章皆有真知灼見(jiàn),期望通過(guò)本期的討論,給全面從嚴(yán)治黨的相關(guān)研究和工作實(shí)踐提供更多的理論解讀和實(shí)踐參考。
[Abstract]:The supervision and restriction of power has always been one of the core problems in the construction of the ruling party. To strengthen the supervision and restriction of power is not only the key to the construction of China under the rule of law, but also the core problem to be solved in the construction of the party style and clean government and the struggle against corruption. It is also an important way to promote the modernization of the national governance system and governance capacity. One of the major problems the CPC faces in its long-term administration is the supervision of power. Finally, we should explore an effective way to realize self-supervision under the long-term ruling conditions of the Party. The article "the theoretical connotation, practical significance and Optimization path of Co-office of Disciplinary Commission and Supervision Commission" points out that It is an important content of the reform of the state supervision system that the discipline Inspection Commission and the Supervision Commission are co-located. From the perspective of power supervision, the theoretical connotation of co-office work of discipline Inspection Commission and Supervision Committee is embodied in the division and integration of supervision subject, object, content and means of supervision. The co-location of the discipline Inspection Commission and the supervisory committee will strengthen and improve the Party's leadership in anti-corruption work and optimize the main structure and content structure of the socialist power supervision system with Chinese characteristics. It is pointed out in this article that based on the ecological perspective of ecology, the self-interest of the subject of supervision has its inevitability and rationality. However, the self-interest will restrict the efficiency of power supervision, cause the mutual inhibition and imbalance between power and rights, and aggravate the degradation of supervision ecology. Therefore, power supervision should pursue the commonweal aim of supervision, realize the symbiosis and mutual benefit of both sides of supervision, and then lead and standardize the demands of supervision of diversity, and ensure the integrity of supervision ecology. Power Regulation: negative behavior of interest groups in the political order Field. The article points out that China should focus on the autonomy of government to regulate the negative behavior of interest groups. The ruling party itself and the political rationality of the individual citizens to enhance the political entity's ability to guard, with a view to strictly implementing the political system, increasing the supply of the political system and creating a political ecology to give play to the effectiveness of political rules. Focus on strengthening political authority, control political resources and highlight the rule of law to improve the level of political control. All the three articles have insight and hope to provide more theoretical interpretation and practical reference for the related research and work practice of managing the Party strictly and comprehensively through the discussion in this issue.
