【摘要】：執(zhí)政黨強(qiáng)調(diào)黨內(nèi)法規(guī),源自特定的社會和政治環(huán)境。之前,黨內(nèi)政治生態(tài)存在一些問題,體現(xiàn)在政商關(guān)系、中央與地方"兩個積極性"、干部亂作為和不作為等方面,故黨內(nèi)法規(guī)體系的主要任務(wù)在于重構(gòu)良好的政治生態(tài),具體一是推進(jìn)反腐敗斗爭,二是增強(qiáng)黨內(nèi)政治生活的能動性。黨內(nèi)法規(guī)應(yīng)當(dāng)在"黨的領(lǐng)導(dǎo)"與"依法治國"的關(guān)系框架下予以定位,它是中國特色社會主義法治體系中的"擔(dān)綱者"。完善黨內(nèi)法規(guī)建設(shè)應(yīng)立足中國的憲制結(jié)構(gòu),增強(qiáng)黨在中國憲制結(jié)構(gòu)中的領(lǐng)導(dǎo)能力,為憲制運(yùn)行提供政治價(jià)值,發(fā)揮黨組織的能動性;同時健全運(yùn)行機(jī)制,促進(jìn)黨內(nèi)法規(guī)落到實(shí)處。
[Abstract]:The ruling party emphasizes the laws and regulations of the party, derived from a specific social and political environment. Before that, there were some problems in the political ecology within the Party, such as the relationship between politics and business, the "two positives" of the central and local governments, and the cadres' misdeeds and inaction. Therefore, the main task of the inner-party legal system is to reconstruct a good political ecology. One is to promote the fight against corruption, and the other is to enhance the political life within the party. The inner-party laws and regulations should be positioned under the frame of the relationship between "the Party's leadership" and "ruling the country according to law", and it is the "principal" in the socialist legal system with Chinese characteristics. In order to improve the construction of inner-party laws and regulations, we should base ourselves on China's constitutional structure, strengthen the Party's leadership in the constitutional structure, provide political value for the constitutional operation, and give full play to the initiative of the Party organization, and at the same time, improve the operating mechanism. To promote the implementation of laws and regulations within the Party.
