【摘要】：隨著網(wǎng)絡信息技術(shù)的廣泛應用,網(wǎng)絡反腐作為一種反腐敗的新形式應運而生。網(wǎng)絡反腐具有成本低廉、公開透明、高效便捷等諸多優(yōu)點,發(fā)展至今已經(jīng)戰(zhàn)果豐碩,出現(xiàn)了許多成功反腐的案例,為我國的反腐事業(yè)注入了新的活力。但是我國網(wǎng)絡反腐制度還不夠完善,存在一些不足,例如容易遭到強權(quán)干涉,易發(fā)生侮辱、誹謗等侵權(quán)事件,很難與制度反腐有效對接等等。網(wǎng)絡反腐若要解決當前困境,法治化與制度化是必由之路。本文對網(wǎng)絡反腐中舉報者的權(quán)利保障問題展開研究,并思考如何從法治化與制度化著手解決該問題。本文首先對網(wǎng)絡反腐進行簡單的概述,對網(wǎng)絡反腐的內(nèi)涵、特點、方式、作用四個方面逐一介紹,以便對網(wǎng)絡反腐有一個總體上的了解。接著論述了網(wǎng)絡反腐中的舉報者在網(wǎng)絡反腐的過程當中都享有哪些主要權(quán)利,以及這些權(quán)利的特點。在明確了網(wǎng)絡反腐中舉報者享有的權(quán)利后,對保障這些權(quán)利的必要性進行了分析。從保障的法理基礎、保障的法律現(xiàn)狀及不足和保障的意義三個角度確認了舉報者權(quán)利的保障勢在必行。接下來,討論了網(wǎng)絡反腐中舉報者權(quán)利保障的邊界問題,明確了應當以被舉報者的合法權(quán)益、其他相關(guān)人員的合法權(quán)益以及公共利益為邊界,確立舉報者權(quán)利保障的限度。最后,在對網(wǎng)絡反腐中舉報者的權(quán)利保障進行了諸多理論分析后,對權(quán)利保障的具體路徑展開了構(gòu)思。詳細論述了如何從法律、制度、技術(shù)、文化這四種方式入手對舉報者的基本權(quán)利進行保障,充分發(fā)揮舉報者在網(wǎng)絡反腐中的作用。
[Abstract]:With the wide application of network information technology, network anti-corruption as a new form of anti-corruption emerged as the times require. Network anti-corruption has many advantages, such as low cost, transparency, high efficiency and convenience. There have been many successful cases of anti-corruption, which have injected new vitality into the anti-corruption cause of our country. However, China's network anti-corruption system is still not perfect, and there are some shortcomings, such as being vulnerable to interference by power, prone to insulting, libel and other infringement incidents. It is very difficult to effectively connect with institutional anti-corruption and so on. In order to solve the current predicament of network anti-corruption, the only way is to rule by law and institutionalize. This paper studies the protection of the rights of whistleblowers in network anti-corruption. And how to solve this problem from the point of view of the rule of law and institutionalization. Firstly, this paper gives a brief overview of the network anti-corruption, introduces the connotation, characteristics, ways and functions of the network anti-corruption one by one. In order to have a general understanding of the network anti-corruption. Then it discusses the main rights enjoyed by the network anti-corruption whistleblowers in the course of the network anti-corruption. And the characteristics of these rights. After defining the rights enjoyed by whistleblowers in the network anti-corruption, the necessity of safeguarding these rights is analyzed. The current legal situation and the deficiency of the protection and the significance of the protection confirm that the protection of the rights of the whistleblower is imperative. Next, the paper discusses the boundary of the protection of the rights of the whistleblower in the network anti-corruption, and clarifies that the legitimate rights and interests of the whistleblower should be taken as the basis. The legal rights and interests of other relevant personnel and the public interest are the boundary to establish the limits of the protection of the rights of whistleblowers. Finally, after a lot of theoretical analysis on the protection of the rights of whistleblowers in the network anti-corruption, This paper discusses in detail how to protect the basic rights of whistleblowers from the four ways of law, system, technology and culture, so as to give full play to the role of whistleblowers in the network anti-corruption.
