【摘要】：黨章作為最根本的黨內法規(guī),是制定其他黨內法規(guī)的基礎和依據。從考察中國共產黨黨章的歷史沿革出發(fā),結合黨的幾代領導集體核心對于黨章性質和地位的論述,詳細地闡述了黨章在黨內政治生活中的地位以及黨章對于黨組織和黨員行為所具有的規(guī)范作用;基于黨的十八屆六中全會提出的全面從嚴治黨的要求,詳盡分析了黨章在保障全面從嚴治黨中的根本法規(guī)的地位和作用,黨內法規(guī)和規(guī)范性文件要服從黨章的最高效力,并不得與黨章相抵觸;黨章作為具有最高效力的黨內法規(guī),在約束黨組織、黨員行為方面具有最高性、普遍性、權利與義務相統一性、重點與一般相結合等特征,只有真正地以黨章為根本遵循,才能確保黨組織、黨員以及各級領導干部嚴格遵守黨章,按照黨章辦事,維護黨章的根本法規(guī)的權威;從執(zhí)政黨對國家和社會生活實行政治領導的方式出發(fā),按照"依法執(zhí)政""依憲執(zhí)政"的要求,探尋了解決黨章與國家憲法法律不一致的程序性機制:對黨章和國家憲法法律作出適應性的修改,使得黨內法規(guī)既能很好地維護黨章的權威,同時又不違背國家憲法法律的規(guī)定。在中國共產黨處于執(zhí)政地位的政治體制下,執(zhí)政黨的黨章應當處于國家政治生活的最頂端,具有最高的正當性和合法性。
[Abstract]:As the most fundamental laws and regulations of the party constitution, is the foundation and basis for the formulation of other regulations of the party. Starting from the history of the Communist Party of Chinese investigation, combined with the several generation of collective leadership core for the nature and status of the paper illustrates the role of normative constitution in the political life of the party and the constitution of the party the behavior of the party organizations and Party members; the the sixth Plenary Session of the 18th CPC Central Committee proposed comprehensive strict requirements based on the detailed analysis of the status and role of the basic laws and regulations in the comprehensive protection strictly in the highest potency Party regulations and normative documents should be subject to the constitution, and shall not contravene the constitution; constitution as the party has the highest potency in the regulations, constraints of Party organization, Party member behavior has the highest, universality, unification of rights and obligations, and combining the characteristics of general key, Only to follow the party constitution as the basis, to ensure that the party organizations, Party members and leading cadres at all levels to strictly abide by the constitution, laws and regulations in accordance with the constitution law, safeguard the fundamental constitution authority; starting from the ruling party to implement the political leadership of the state and society, in accordance with the "ruling by law" and "rule by constitution", explore to solve the procedural mechanism in the party constitution and state constitutional law inconsistent: to make adaptive changes to the constitution of the Constitution and the national laws, the regulations of the party can well maintain the constitution authority, also does not violate state constitutional law. In Chinese Communist Party in the ruling position of the political system, the ruling party's constitution it should be at the top of the country's political life has the legitimacy and legality of the highest.
