【摘要】：飛速發(fā)展的網(wǎng)絡(luò)信息時(shí)代給人們的生活帶來(lái)巨大的影響,自媒體的產(chǎn)生可以說(shuō)是網(wǎng)絡(luò)傳播技術(shù)的一個(gè)新起點(diǎn)。自媒體是一種更自主、更大眾甚至更個(gè)人的傳播者,通過(guò)使用現(xiàn)代的電子高科技技術(shù),向一些有相似背景或者沒(méi)有相似背景的單個(gè)人以及群體,傳遞不規(guī)范性和規(guī)范性信息內(nèi)容的新媒體的總稱(chēng)。而網(wǎng)絡(luò)自媒體更主要以論壇、博客、微博、微信等形式,給人們的生活帶來(lái)了方方面面的巨大影響。然而新時(shí)期網(wǎng)絡(luò)反腐作為反腐的一種新形式,在反腐的領(lǐng)域中以其特有的運(yùn)行模式展現(xiàn)出了旺盛的生命力,并切成為了一把不可忽視的反腐尖刀。網(wǎng)絡(luò)反腐通過(guò)對(duì)腐敗現(xiàn)象起到強(qiáng)力的威懾作用,使廣大群眾的權(quán)利意識(shí)和政治參與的積極性萌發(fā),完善了制度反腐,促進(jìn)了政府作為,同時(shí)它又是一把“雙刃劍”,它本身也有一定的缺陷,會(huì)產(chǎn)生傷及無(wú)辜他人、侵犯他人人隱私、污染網(wǎng)絡(luò)環(huán)境、擾亂社會(huì)生活等后果。通過(guò)對(duì)自媒體時(shí)代網(wǎng)絡(luò)反腐公眾參與監(jiān)管機(jī)制整個(gè)核心概念的分解解讀,有利于準(zhǔn)確把握文章的主旨,對(duì)公眾參與反腐的監(jiān)管機(jī)制進(jìn)行研究;對(duì)自媒體時(shí)代網(wǎng)絡(luò)反腐公眾參與的監(jiān)管機(jī)制研究的現(xiàn)狀、產(chǎn)生的問(wèn)題及原因進(jìn)行研究,現(xiàn)狀包括立法規(guī)定與實(shí)行狀況,立法規(guī)定主要指在憲法,行政法規(guī),以及刑法、刑訴法、民法相關(guān)規(guī)定下,政府監(jiān)管機(jī)制如何運(yùn)行,而實(shí)行狀況則指公安機(jī)關(guān)監(jiān)管、紀(jì)檢監(jiān)察機(jī)關(guān)監(jiān)管、檢察機(jī)關(guān)的監(jiān)管;問(wèn)題則包括法律法規(guī)缺失、監(jiān)管機(jī)制不夠完善、監(jiān)管主體不明,監(jiān)管責(zé)任不清、監(jiān)管范圍有限、監(jiān)管手段不力、對(duì)實(shí)名舉報(bào)人保障不力、對(duì)違法參與者追究不利;而原因則包括:參與主體素質(zhì)參差不齊、政府反腐敷衍塞則致使公民參與反腐言行出格;對(duì)自媒體時(shí)代網(wǎng)絡(luò)反腐公眾參與的監(jiān)管機(jī)制的完善,包括:完善法律法規(guī);完善監(jiān)管機(jī)制,具體又包括:全面推行公務(wù)員財(cái)產(chǎn)申報(bào)與公示制度、相關(guān)部門(mén)加強(qiáng)技術(shù)創(chuàng)新手段,加大對(duì)網(wǎng)絡(luò)內(nèi)容的技術(shù)監(jiān)管、推行實(shí)名制注冊(cè)、建立信息共享機(jī)制、建立網(wǎng)絡(luò)監(jiān)督投訴平臺(tái);明確監(jiān)管主體,分清監(jiān)管責(zé)任;擴(kuò)大監(jiān)管范圍;加強(qiáng)監(jiān)管力度;加大對(duì)實(shí)名舉報(bào)人的保障力度;嚴(yán)厲制裁違法犯罪行為。
[Abstract]:The rapid development of the network information age brings great impact to people's life, since the media can be said to be a starting point for a new network communication technology. Since the media is a more independent, more popular and even more personal communicators, by using modern high-tech electronic technology, to some similar background or single person no the similar background and new media group, general transfer of non standardization and standardization of information content. However, the new era of network anti-corruption as a new form of corruption, in in the field of anti-corruption to run its unique mode shows strong vitality, and has become a noticeable anti knife. Through the network anti-corruption to strong deterrent against corruption phenomenon The role of positive right consciousness and political participation of the masses of the germination, improve the anti-corruption system, promote the government as, at the same time it is a "double-edged sword", it also has some defects, will hurt the innocent people, infringement of privacy, network environment pollution, disrupt social life etc. the consequences. By decomposing the interpretation of the media since the era of Network Anti-corruption public participation and supervision mechanism of the core concept, is conducive to accurately grasp the point of supervision, mechanism of public participation in anti-corruption; current situation of the study on the regulatory mechanism of the era from the media network of corruption of public participation, research problems and the causes, including the legislative status quo the provisions and implementation status, mainly refers to the legislative provisions in the constitution, administrative law, and criminal law, criminal procedure law, civil law, how the government supervision mechanism, and the implementation status Refers to the public security organs supervision, discipline inspection and supervision organs supervision, procuratorial supervision; problems include the lack of laws and regulations, the supervision mechanism is not perfect, the regulatory body is unknown, the regulatory responsibility is not clear, the scope of regulation, supervision means weak, ineffective protection of illegal real name informants, participants held negative; while the reason includes: participation in quality uneven, government corruption caused the citizen participation in anti-corruption plug with special words and deeds on the regulatory mechanism; perfect media since the era of Network Anti-corruption public participation include: perfecting laws and regulations; improve the regulatory mechanism, specifically including: the implementation of the declaration and the system of public servants property, the relevant departments to strengthen technological innovation, increase the technology content of network supervision the implementation of real name registration, the establishment of information sharing mechanism, the establishment of network supervision and complaint platform; clear regulatory body, clear regulatory responsibility; expansion The scope of great supervision, strengthening the supervision, strengthening the guarantee of the real name informants, and severely punishing the criminal offenses.
