【摘要】：黨內(nèi)法規(guī)建設(shè)是我國法治建設(shè)立足于中國國情的具體體現(xiàn),如果忽視黨內(nèi)法規(guī)在我國法治體系中的應(yīng)有地位,我國的法治體系建設(shè)必然是與現(xiàn)實脫節(jié)的。然而,黨內(nèi)法規(guī)在我國法治體系中究竟應(yīng)當(dāng)如何定位?學(xué)界對于這一基本問題至今莫衷一是,現(xiàn)有的黨規(guī)是法律說、法與政策說、軟法說均存在一定的缺漏。為了準確、合理地對黨內(nèi)法規(guī)進行定位,應(yīng)當(dāng)根據(jù)黨內(nèi)法規(guī)的調(diào)整對象不同,將黨內(nèi)法規(guī)區(qū)分為調(diào)整領(lǐng)導(dǎo)、執(zhí)政行為的黨內(nèi)法規(guī)與調(diào)整黨自身運行行為的黨內(nèi)法規(guī)兩種類別。調(diào)整領(lǐng)導(dǎo)、執(zhí)政行為的黨內(nèi)法規(guī)一般屬于憲法慣例,而調(diào)整黨自身運行行為的黨內(nèi)法規(guī)則屬于社會組織的自治規(guī)范。對黨內(nèi)法規(guī)的這一定位,既能夠合理地解釋部分黨內(nèi)法規(guī)作為國家機關(guān)運行依據(jù)的現(xiàn)象,又能夠維護憲法法律的權(quán)威,不至于陷入將黨內(nèi)法規(guī)與法律混同的理論誤區(qū)。
[Abstract]:The construction of inner-party laws and regulations is the concrete embodiment of our country's legal construction based on China's national conditions. If we ignore the due status of inner-party laws and regulations in our country's legal system, the construction of our country's rule of law system is bound to be out of touch with the reality. How should the inner-party laws and regulations be positioned in the legal system of our country? There is no consensus in academic circles on this basic issue. The existing party rules are the theory of law, the theory of law and policy, and the theory of soft law. According to the different objects of regulation within the Party, the law and regulations of the Party should be divided into two categories: the regulation of leadership, the regulation of ruling behavior, and the regulation of the Party's own running behavior. The inner-party laws and regulations governing behavior generally belong to the constitutional convention, while the rules of inner-party law regulating the Party's own running behavior belong to the autonomous norms of social organizations. It can not only reasonably explain the phenomenon of some inner-party laws and regulations as the basis for the operation of state organs, but also can maintain the authority of constitutional law, so as not to fall into the theoretical misunderstanding of mixing inner-party laws and laws.
