【摘要】：隨著我國反腐力度不斷增強,基層集體貪腐案件越來越多地暴露在公眾視野之中,為探究潛在貪腐個體轉(zhuǎn)變?yōu)閷嶋H貪腐群體的內(nèi)在邏輯,本文采用個案研究法,以海南省C縣的騙取征地補償款案為例,引入收益成本分析視角,從貪腐動機、制度約束、權(quán)力合謀、被查處風(fēng)險這四個維度將集體貪腐分為貪腐動機萌發(fā)期、潛在貪腐群體合謀期和貪腐風(fēng)險收益對比期三個階段。研究表明:合謀能促進權(quán)力聯(lián)合、增強信息不對稱、分?jǐn)偢瘮★L(fēng)險、實現(xiàn)利益分配,從而具有消解被揭發(fā)風(fēng)險、隱蔽腐敗謀劃的優(yōu)勢。產(chǎn)生貪腐動機后的潛在貪腐群體針對權(quán)力制衡的制度設(shè)計選擇合謀,使其在收益成本分析的主觀判斷過程中易提高貪腐的可行性,結(jié)合客觀懲處情況,潛在群體將進一步判斷是否加入貪腐群體。本文在基層集體貪腐的形成機理及個案深入研究方面作出了創(chuàng)新性探索。
[Abstract]:With the strengthening of anti-corruption in our country, grassroots collective corruption cases are more and more exposed to the public view. In order to explore the internal logic of the transformation of potential corruption individuals into actual corruption groups, this paper adopts a case study method. Taking the case of compensation for land requisition by fraud in C County of Hainan Province as an example, this paper introduces the perspective of income and cost analysis and divides collective corruption into four dimensions: corruption motive, institutional constraint, collusion of power, risk of being investigated and dealt with, and the collective corruption is divided into the germination period of corruption motive. The study shows that collusion can promote power union, enhance information asymmetry, spread the risk of corruption, and realize benefit distribution, so as to eliminate the risk of being exposed. Hidden corruption planning advantages. The potential corruption groups after generating corruption motive design collusion against the system of power checks and balances, make it easy to improve the feasibility of corruption in the subjective judgment process of profit and cost analysis, combined with objective punishment, The potential group will further judge whether to join the corruption group. This paper makes an innovative exploration on the formation mechanism and case study of grassroots collective corruption.
