【摘要】:基層領(lǐng)導(dǎo)干部作為懈怠是指基層領(lǐng)導(dǎo)干部負(fù)有積極履行崗位職責(zé)的義務(wù),且客觀上具備能夠作為的條件,但在過程及其結(jié)果上呈現(xiàn)為不作為或不充分作為的現(xiàn)象。基層領(lǐng)導(dǎo)干部作為懈怠具有行為違法性、現(xiàn)象隱蔽性和結(jié)果消極性等特征,并可劃分為慵懶無為、推諉延誤、消極避事等類型。當(dāng)代中國基層領(lǐng)導(dǎo)干部作為懈怠現(xiàn)象的生成邏輯,可以從觀念、體制和環(huán)境三個(gè)層面切入,包括領(lǐng)導(dǎo)干部權(quán)力觀異化、管理體制缺陷和監(jiān)督問責(zé)機(jī)制處置乏力以及高壓反腐背景等因素。對(duì)基層領(lǐng)導(dǎo)干部作為懈怠施以剛性約束的問責(zé)處罰,應(yīng)具備的構(gòu)成要件為:有具體有為要求的崗位職責(zé)、有怠于履行崗位職責(zé)的行為事實(shí)和造成一定危害后果的社會(huì)影響等。
[Abstract]:The slacking of grassroots leading cadres means that they have the obligation to actively perform their post duties, and objectively have the conditions to be able to do so. However, in the process and its results, there is a phenomenon of omission or insufficient action. As a result of slacking, the grass-roots leading cadres have the characteristics of illegal behavior, hidden phenomenon and negative result, and can be divided into idleness and procrastination, which can be divided into idleness and procrastination. Negative avoidance and other types. As the formation logic of slack phenomenon, the leading cadres at the grass-roots level in contemporary China can be cut into the following three aspects: concept, system and environment, including the dissimilation of leading cadres' view of power. The defects of the management system, the weak handling of the supervisory accountability mechanism and the background of high pressure on anti-corruption, etc. The key elements of the accountability punishment, which imposes rigid constraints on the grassroots leading cadres as slacking, should be: having specific duties and responsibilities, Conduct facts and social impact of harmful consequences, etc.
