【摘要】：近幾年來,行政規(guī)范性文件的備案審查開展得較為成熟,而黨內(nèi)規(guī)范性文件卻在很長一段時間內(nèi)缺乏相應(yīng)的監(jiān)督,從而造成部分黨內(nèi)規(guī)范性文件合法性、合理性存在問題,如:程序、內(nèi)容違反相關(guān)法律法規(guī),制定政策滯后,甚至成為某些行政規(guī)范性文件規(guī)避監(jiān)督的“避風(fēng)港”等等。這些問題的存在,危害了黨內(nèi)法規(guī)制度的嚴(yán)肅性、權(quán)威性、統(tǒng)一性和科學(xué)性,損害了黨的形象和公信力。因此,自2012年起,中央自上而下逐漸推動黨內(nèi)規(guī)范性文件備案審查工作,并制定相關(guān)制度予以規(guī)范。目前,在實施地方黨內(nèi)規(guī)范性文件備案審查工作中,存在一些問題,在一定程度上影響了該制度的深入實施。然而,學(xué)術(shù)研究對此還缺乏足夠的關(guān)注。為此,本文就黨內(nèi)規(guī)范性文件備案審查制度在地方的實踐進(jìn)行研究,以期為這一領(lǐng)域的研究添磚加瓦。本文主要由五部分構(gòu)成。第一部分交代了本文的研究背景、目的、思路,以及相關(guān)文獻(xiàn)綜述;第二部分主要是黨內(nèi)規(guī)范性文件及其備案審查制度的相關(guān)概述,包括黨內(nèi)規(guī)范性文件的內(nèi)涵及其備案審查制度的由來等;第三部分梳理了當(dāng)前地方黨內(nèi)規(guī)范性文件備案審查制度運(yùn)行的實踐情況,如具體內(nèi)容、制度結(jié)構(gòu)等;第四部分分析當(dāng)前地方黨內(nèi)規(guī)范性文件在合法性、規(guī)范性、統(tǒng)一性和權(quán)威性等方面存在的突出問題、備案審查制度運(yùn)行面臨的困難及其原因;第五部分提出完善地方黨內(nèi)規(guī)范性文件備案審查制度的建議。
[Abstract]:In recent years, the record review of administrative normative documents to carry out more mature, and the normative documents but the corresponding lack of supervision in a long period of time, resulting in some party normative documents legitimacy, rationality of the existence of problems, such as: program, in violation of relevant laws and regulations, policy lag even as some administrative normative documents to avoid the supervision of the "safe harbor" and so on. These problems, serious harm, the regulations of the authority, unified and scientific, damage the party's image and credibility. Because of this, since 2012, the central party from top to bottom and gradually promote the normative documents filing and review work, and establish relevant system to be standardized. At present, in the implementation of local party normative documents filing and review work, there are some problems, to a certain extent affected the further implementation of the system. However, Academic research are also lack of enough attention. Therefore, this paper will research and practice within the party standard filing and examination system files in place, in order to contribute to the research in this field. This paper consists of five parts. The first part introduces the research background, the purpose, ideas, and related literature review; second the main part is overview of related party and normative documents filing and examination system, including the connotation of the normative documents filing and examination system and its origin; the third part reviews the practice of the local party normative documents filing and examination system, such as the specific content of the system structure; norms in the legitimacy of the local the fourth part is the analysis of normative documents, problems of unity and authority of the other aspects of the difficulties and reasons facing operation record review system; Article The five part puts forward suggestions to improve the system of the record and review of the local party normative documents.
