【摘要】：任何一種復(fù)雜的政治文明形態(tài)都面臨著合法性追問(wèn)。執(zhí)政的合法性議題,實(shí)際上是對(duì)這一追問(wèn)的具體涵蓋。執(zhí)政合法性議題內(nèi)涵豐富,其理論爭(zhēng)鳴的焦點(diǎn)是關(guān)于合法性的判斷標(biāo)準(zhǔn)。以合法律性或被統(tǒng)治者認(rèn)可等"一要素論"、"二要素論"或"三要素論"為判斷標(biāo)準(zhǔn)的西方傳統(tǒng)合法性理論存在一定限度。從馬克思主義法哲學(xué)視角看,應(yīng)以合法律性、合民意性、合價(jià)值性、合規(guī)律性四個(gè)構(gòu)成要件作為執(zhí)政合法性的判斷標(biāo)準(zhǔn)。中國(guó)共產(chǎn)黨執(zhí)政的合法性基礎(chǔ)也需要從判斷標(biāo)準(zhǔn)的四個(gè)維度出發(fā),在實(shí)踐重構(gòu)中予以夯實(shí),以此鞏固黨的長(zhǎng)期執(zhí)政地位,確保國(guó)家長(zhǎng)治久安。
[Abstract]:Any complex form of political civilization is facing the legitimacy of the question. The legitimacy of governance, in fact, is the specific coverage of this question. Governance legitimacy is rich in content. The focus of its theoretical contention is on the criterion of legality, which is based on the theory of "one element", which conforms to the legal nature or is accepted by the ruler. The western traditional legitimacy theory based on "two elements theory" or "three elements theory" has certain limits. From the point of view of Marxist philosophy of law, we should accord with law, public opinion and value. The legality basis of the ruling of the Communist Party of China also needs to be tamped in the reconstruction of practice from the four dimensions of the judgment standard. So as to consolidate the long-term ruling position of the party, to ensure long-term stability of the country.
