【摘要】：孤兒作品是指在享有著作權(quán),但其權(quán)利人無法被找到的作品。由于著作權(quán)的長期自動保護(hù)原則、以及網(wǎng)絡(luò)傳播媒介的發(fā)展等原因使得孤兒作品在國內(nèi)外大量出現(xiàn),并在實(shí)踐中產(chǎn)生了很多問題,如潛在使用人因承擔(dān)責(zé)任過大而會放棄對孤兒作品的利用,最終導(dǎo)致公共領(lǐng)域的規(guī)�？s小,不利于知識的傳播。建立合理的孤兒作品利用制度不僅符合著作權(quán)保護(hù)的目的要求,同是也會提高知識產(chǎn)品的社會使用率,創(chuàng)造更多的價值。要解決孤兒作品問題首先明確對“合理勤勉搜尋”的界定,再者要解決權(quán)利人復(fù)出后的解決措施,目前各國對孤兒作品的利用模式主要有登記許可模式與侵權(quán)抗辯模式兩大類,但是都不能完全解決孤兒作品難題。國際條約以及我國的國內(nèi)法,對孤兒作品規(guī)定幾乎是空白狀態(tài)。因此本文試圖將逆權(quán)侵占運(yùn)用到知識產(chǎn)權(quán)領(lǐng)域,呼吁建立一種針對孤兒作品的抗辯理論,可以讓潛在使用者在勤勉搜尋三年未找到作者或權(quán)利人的情況下使用孤兒作品,并讓因此而被利用的孤兒作品在十年無人主張權(quán)利的情況下進(jìn)入共有領(lǐng)域。這種理論能在一定程度上解決大部分孤兒作品問題,同時不會帶來目前的解決機(jī)制中所存在的諸如壟斷等種種問題。
[Abstract]:Orphan works refer to works that enjoy copyright, but whose rights holders cannot be found. Due to the principle of long-term automatic protection of copyright and the development of network media, a large number of orphan works appear at home and abroad, and there are many problems in practice. If the potential user is too responsible and will give up the use of orphan works, which will eventually lead to the reduction of the scale of the public domain, which is not conducive to the dissemination of knowledge. The establishment of a reasonable utilization system of orphan works will not only meet the requirements of copyright protection, but also improve the social utilization rate of knowledge products and create more value. In order to solve the problem of orphan works, the definition of "reasonable and diligent search" should be clearly defined, and the measures to solve the problem after the return of the obligee should be solved. At present, there are two main types of modes of utilization of orphan works in various countries: registration license mode and tort defense mode. However, none of them can completely solve the difficult problems of orphan works. International treaties and the domestic law of our country, the provisions on orphan works are almost blank. Therefore, this paper attempts to apply inverse encroachment to the field of intellectual property rights, and calls for the establishment of a defense theory against orphan works, which can allow potential users to use orphan works without finding the author or obligee for three years. And allow the orphan works used as a result to enter the common domain without claiming rights for ten years. This theory can solve the problem of most orphan works to a certain extent, at the same time, it will not bring about all kinds of problems such as monopoly and so on in the current solution mechanism.
