【摘要】：合理使用制度在著作權(quán)理論中有著非常重要的地位,在傳統(tǒng)環(huán)境下合理使用制度一直起著平衡著作權(quán)人與社會(huì)大眾間利益的作用,得到了各國(guó)的普遍認(rèn)可,在各國(guó)屬于通行的制度。然而,隨著網(wǎng)絡(luò)技術(shù)迅速發(fā)展,傳統(tǒng)的合理使用制度受到了極大的沖擊,網(wǎng)絡(luò)環(huán)境下的著作權(quán)侵權(quán)案件層出不窮。傳統(tǒng)著作權(quán)合理使用制度已經(jīng)不能夠很好的去應(yīng)對(duì)網(wǎng)絡(luò)環(huán)境下的著作權(quán)法律關(guān)系,相關(guān)的法律制度需要進(jìn)行調(diào)整和完善。 本文分為三章：第一章主要閘述了傳統(tǒng)的著作權(quán)合理使用制度的基本理論,還有網(wǎng)絡(luò)環(huán)境下我們所受到的挑戰(zhàn)。第二章主要闡述了國(guó)外的相關(guān)立法和判斷標(biāo)準(zhǔn)以及網(wǎng)絡(luò)環(huán)境下的判斷標(biāo)準(zhǔn)的構(gòu)建問題。第三章主要介紹我國(guó)該如何去完善自己的合理使用制度。
[Abstract]:The system of reasonable use plays a very important role in the theory of copyright. Under the traditional environment, the system of reasonable use has always played a role in balancing the interests between copyright owners and the public, and has been widely recognized by all countries. It is a common system in all countries. However, with the rapid development of network technology, the traditional reasonable use system has been greatly impacted, and copyright infringement cases emerge in endlessly under the network environment. The traditional fair use system of copyright has been unable to deal with the legal relationship of copyright in the network environment, and the relevant legal system needs to be adjusted and improved. This paper is divided into three chapters: the first chapter mainly introduces the basic theory of the traditional fair use system of copyright, as well as the challenges we face in the network environment. The second chapter mainly expounds the relevant legislation and judgment standards of foreign countries and the construction of judgment standards in the network environment. The third chapter mainly introduces how to improve our country's reasonable use system.
