【摘要】：教材類作品應(yīng)當(dāng)在多大程度上享有著作權(quán)的保護在出版實踐中存在著較大爭議。教材類作品的功能性和標準性等特征使教材在表達的選擇空間上低于其他類型作品。因此,與其他類型作品相比,應(yīng)對教材類作品著作權(quán)進行更大程度的限制�？梢酝ㄟ^教材類作品相關(guān)市場的界定及禁令救濟限制兩個具體維度來展開對著作權(quán)范圍的限制。
[Abstract]:The extent to which textbook works should enjoy copyright protection is controversial in publishing practice. The functional and standard features of teaching materials make the choice space of teaching materials lower than that of other types of works. Therefore, compared with other types of works, the copyright of textbook works should be restricted to a greater extent. The scope of copyright can be restricted through the definition of relevant market and the limitation of injunction relief.
