教案著作權(quán)保護(hù)問題研究

【摘要】:2002年重慶的教案官司一時(shí)被教育界、新聞界、法律界爭(zhēng)相關(guān)注,各大媒體紛紛報(bào)道了我國(guó)教案官司第一案。官司一波三折,歷經(jīng)三年零十個(gè)月,幾乎經(jīng)歷了司法的全部訴訟程序,同時(shí)引發(fā)了法學(xué)界對(duì)教案著作權(quán)問題的關(guān)注和思考。本文試圖通過對(duì)教案官司的探討引出對(duì)整個(gè)教案著作權(quán)保護(hù)相關(guān)問題的研究。全文由四部分組成。 第一部分是對(duì)教案基礎(chǔ)理論的探析。這部分主要討論和明晰教案的概念、類型、特征,并分析了教案的法律屬性,是全文的基礎(chǔ)理論鋪墊,其中關(guān)于教案法律屬性問題的分析是本部分乃至全文的重點(diǎn)。教案的作品定性對(duì)于教案著作權(quán)問題研究非常必要,因?yàn)槿绻贪覆粚儆谧髌肪驼劜簧辖贪傅闹鳈?quán)問題,尤其對(duì)于教案是否屬于職務(wù)作品的問題,司法界說法不一。本文認(rèn)為教案屬于一般職務(wù)作品,對(duì)于教案職務(wù)作品屬性的界定是全文的研究基礎(chǔ)。 第二部分是對(duì)教案侵權(quán)現(xiàn)狀的介紹。教案的侵權(quán)現(xiàn)象時(shí)有發(fā)生,這部分首先介紹教案的侵權(quán)主體。在此基礎(chǔ)上闡述了教案著作權(quán)的侵權(quán)種類和常見類型。教案侵權(quán)有其自身特點(diǎn),因此本文著重介紹了教案著作權(quán)侵權(quán)的常見類型。教案的侵權(quán)伴隨著網(wǎng)絡(luò)的發(fā)展有了不同的變化,本部分還分析了“遠(yuǎn)程教學(xué)”侵權(quán)的情形。 第三部分主要針對(duì)教案官司爭(zhēng)議的問題和透視出的立法空白進(jìn)行研究。在介紹了我國(guó)立法現(xiàn)狀的基礎(chǔ)上指出我國(guó)著作權(quán)法存在的立法缺陷。這部分主要探討了三個(gè)問題。分別是我國(guó)著作權(quán)法關(guān)于作品認(rèn)定制度的規(guī)定及不足;教案歸屬制度的規(guī)定及不足以及教案合理使用的規(guī)定及不足。其中前兩個(gè)問題是由教案官司引發(fā)的立法思考,而教案合理使用則是與教案的侵權(quán)制度相關(guān)的探討。三個(gè)問題分別以我國(guó)著作權(quán)法中作品的“獨(dú)創(chuàng)性”標(biāo)準(zhǔn)、一般職務(wù)作品的“優(yōu)先使用權(quán)”和與教案相關(guān)的合理使用規(guī)定的不足展開研究。 第四部分是本文的核心章節(jié)。這部分主要是針對(duì)第三部分闡述的我國(guó)教案著作權(quán)立法的不足提出的完善對(duì)策。在評(píng)析國(guó)外著作權(quán)法的基礎(chǔ)上,借鑒國(guó)外著作權(quán)法來完善我國(guó)教案著作權(quán)立法。其中對(duì)于作品“獨(dú)創(chuàng)性標(biāo)準(zhǔn)”、一般職務(wù)作品“優(yōu)先使用權(quán)”和與教案相關(guān)的個(gè)人使用、教學(xué)使用和科研使用的立法完善是文章的研究重心。本文提出其一,降低作品獨(dú)創(chuàng)性標(biāo)準(zhǔn),同時(shí)將教案列為著作權(quán)法保護(hù)范圍;其二,完善一般職務(wù)作品優(yōu)先使用權(quán)制度,保障作者的物質(zhì)利益;其三,在合理使用制度上,采用“因素主義”與“規(guī)則主義”并列的立法模式,同時(shí)完善與教案密切相關(guān)的個(gè)人使用、教學(xué)使用和科研使用。
[Abstract]:In 2002, the teaching case in Chongqing was concerned by the educational circles, the press and the legal profession, and the major media reported the first case of the teaching case in our country one after another. After three years and ten months, the lawsuit has gone through almost all the judicial proceedings, which has aroused the attention and thinking of the legal circles on the copyright of the teaching case at the same time. This paper attempts to lead to the study of the copyright protection of the whole teaching plan through the discussion of the teaching case. The full text consists of four parts. The first part is the analysis of the basic theory of teaching plan. This part mainly discusses and clarifies the concept, the type, the characteristic of the teaching plan, and analyzes the legal attribute of the teaching plan, which is the basic theoretical foundation of the full text, among which the analysis of the legal attribute of the teaching plan is the focus of this part and even the whole text. It is necessary to study the copyright of the teaching plan because if the teaching plan does not belong to the work, the copyright of the teaching plan cannot be discussed, especially whether the teaching plan belongs to the position work, the judicial circles have different opinions. This paper holds that teaching plan belongs to the general work of duty, and the definition of the attribute of teaching plan is the basis of the research. The second part is the introduction of the current situation of teaching case infringement. The infringing phenomenon of teaching plan occurs from time to time, this part first introduces the subject of teaching case infringement. On this basis, the author expounds the types and common types of copyright infringement. Teaching case infringement has its own characteristics, so this paper mainly introduces the common types of teaching case copyright infringement. The infringement of teaching plan has changed with the development of network. This part also analyzes the situation of "distance teaching" infringement. The third part mainly focuses on the legal disputes and legislative gaps. On the basis of introducing the present situation of our country's legislation, this paper points out the legislative defects of our country's copyright law. This part mainly discusses three problems. They are the provisions and deficiencies of copyright law on the system of the identification of works, the regulations and deficiencies of the system of teaching case ownership, and the regulations and deficiencies of the rational use of teaching plans. The first two problems are the legislative thinking caused by the teaching case, and the rational use of the teaching case is related to the tort system of the teaching case. The three problems are studied according to the standards of "originality" of works in China's copyright law, the "preferential right to use" of general official works and the deficiencies of the regulations on the rational use of teaching plans. The fourth part is the core chapter of this paper. This part mainly aims at the third part elaborated our country teaching plan copyright legislation insufficiency proposed the consummation countermeasure. Based on the analysis of foreign copyright law, this paper makes use of foreign copyright law to perfect the copyright legislation of teaching case in our country. Among them, the focus of the article is the "originality standard" of the works, the "priority right" of the general post works and the legislative perfection of the personal use, the teaching use and the scientific research use related to the teaching plan. In this paper, the author puts forward the following points: first, to reduce the originality standard of the works, and at the same time, to make the teaching plan the protection scope of copyright law, second, to perfect the system of the preferential use right of the general post works and to protect the material interests of the author; Thirdly, in the system of rational use, we should adopt the legislation mode of "factorism" and "rulesism", and perfect the personal use, teaching use and scientific research use which are closely related to teaching plan.
