【摘要】：電子書(shū)的普及和電子書(shū)相關(guān)產(chǎn)業(yè)的爆炸式發(fā)展引發(fā)了大量的版權(quán)問(wèn)題。當(dāng)前我國(guó)亂象重生的電子書(shū)版權(quán)保護(hù)形勢(shì)不僅制約著電子書(shū)產(chǎn)業(yè)的持續(xù)、快速發(fā)展,導(dǎo)致眾多的權(quán)利糾紛,還增加社會(huì)成本,浪費(fèi)社會(huì)資源。電子書(shū)產(chǎn)業(yè)的健康發(fā)展離不開(kāi)版權(quán)保護(hù),而版權(quán)保護(hù)的首要任務(wù)就是要建立一套完整的電子書(shū)版權(quán)保護(hù)機(jī)制。 本文首先將電子書(shū)概念限定為附著在電子載體(數(shù)字化內(nèi)容讀取識(shí)別硬件)上,通過(guò)數(shù)字技術(shù)轉(zhuǎn)換、加工、制作、生產(chǎn)出的作品(主要是文字作品)的數(shù)字化表現(xiàn)形式,區(qū)別于電子書(shū)閱讀器,從而使討論其版權(quán)保護(hù)問(wèn)題具有意義。其次,本文闡述了我國(guó)電子書(shū)版權(quán)保護(hù)的現(xiàn)狀,深入分析了電子書(shū)版權(quán)保護(hù)的特征。指出電子書(shū)與傳統(tǒng)書(shū)籍的版權(quán)保護(hù)相比,存在著版權(quán)人對(duì)其權(quán)力控制能力減弱、版權(quán)保護(hù)的權(quán)利位次發(fā)生了改變、版權(quán)保護(hù)技術(shù)依賴性增強(qiáng)、保護(hù)成本和難度加大等特殊性,并論證了電子書(shū)與其它數(shù)字出版物版權(quán)保護(hù)的差異,為電子書(shū)版權(quán)保護(hù)機(jī)制的建立奠定了基礎(chǔ)。最后,本文從授權(quán)轉(zhuǎn)讓、法律保護(hù)和侵權(quán)防范三個(gè)維度論證如何構(gòu)建完整的電子書(shū)版權(quán)保護(hù)機(jī)制。健全授權(quán)轉(zhuǎn)讓機(jī)制是從正面破解版權(quán)保護(hù)困境的有效措施;完善法律保障機(jī)制,是構(gòu)建完整保護(hù)機(jī)制的核心任務(wù);建立侵權(quán)防控機(jī)制是保護(hù)電子書(shū)版權(quán)的長(zhǎng)效機(jī)制。其中,在授權(quán)使用方面本文提出了利用集體管理、知識(shí)共享許可協(xié)議和權(quán)利管理電子信息等非傳統(tǒng)授權(quán)轉(zhuǎn)讓模式,以適應(yīng)電子書(shū)版權(quán)保護(hù)的需要;在法律保障方面本文明晰了電子書(shū)版權(quán)保護(hù)的內(nèi)容,確定了版權(quán)所有者和使用者各自行為的法律效果及相應(yīng)的法律責(zé)任,并提出了一些完善和改進(jìn)法律制度的建議;在侵權(quán)防控方面,本文提出了推廣技術(shù)保護(hù)、提高行政管理、加強(qiáng)行業(yè)自律和培養(yǎng)付費(fèi)習(xí)慣等一系列措施。
[Abstract]:The popularity of e-books and the explosive development of ebook-related industries have caused a lot of copyright problems. The current situation of e-book copyright protection in China is not only restricting the sustained and rapid development of e-book industry, resulting in numerous rights disputes, but also increasing social costs and wasting social resources. The healthy development of e-book industry can not be separated from copyright protection, and the primary task of copyright protection is to establish a complete set of e-book copyright protection mechanism. In this paper, the concept of ebook is first limited to the digital expression form of the works (mainly text works) which are attached to the electronic carrier (digital content reading and identification hardware), and are converted, processed, produced and produced by digital technology. The difference from an e-book reader makes it meaningful to discuss its copyright protection. Secondly, this paper expounds the present situation of the copyright protection of e-books in China, and analyzes the characteristics of the copyright protection of e-books in depth. It is pointed out that compared with the copyright protection of traditional books, there are some particularities, such as the copyright owner's ability to control its power is weakened, the right rank of copyright protection has changed, the dependence of copyright protection technology has been strengthened, and the cost and difficulty of copyright protection have been increased. The difference of copyright protection between ebook and other digital publications is demonstrated, which lays a foundation for the establishment of copyright protection mechanism of ebook. Finally, this paper demonstrates how to construct the complete copyright protection mechanism of e-book from three dimensions: transfer of authorization, legal protection and protection against infringement. Perfecting the mechanism of authorization transfer is an effective measure to solve the dilemma of copyright protection from a positive perspective; perfecting the legal protection mechanism is the core task of constructing a complete protection mechanism; establishing a mechanism of infringement prevention and control is a long-term mechanism to protect the copyright of e-books. In order to meet the need of copyright protection of e-books, this paper puts forward some non-traditional modes of authorization transfer, such as collective management, knowledge sharing license agreement and rights management electronic information, in order to meet the needs of e-book copyright protection. In the aspect of legal protection, this paper clarifies the content of the copyright protection of e-book, determines the legal effect and corresponding legal responsibility of the copyright owners and users, and puts forward some suggestions to perfect and improve the legal system. In the aspect of tort prevention and control, this paper puts forward a series of measures such as popularizing technical protection, improving administration, strengthening industry self-discipline and cultivating paying habit.
